RLP No. 8KY2130 – Louisville, KY Amendment No. 4

Issued: May 18, 2023

The following amendments and clarifications are hereby made to Request for Lease Proposals (RLP) No.

8KY2130 issued December 13, 2022. All offerors must acknowledge receipt of this Amendment No. 4, by reviewing, signing and returning to General Services Administration and Public Properties no later than 5:00 PM., EST, May 26, 2023.

1.) Phase I Exhibit B.1 Program of Requirements (POR) V21.1 Paragraphs 9.4.A, B, C, and D Vehicle Barriers are hereby amended as follows:

Paragraph 9.4.A:

I. Lessor must provide barriers (HVB) at all vehicular ingress/egress points within the property perimeter that have been tested and certified to stop a 15,000lb vehicle traveling at 50 mph with penetration of less than 3’-0” (K12 rating). HVB must be Delta Scientific Model DSC501 or equivalent as approved by the LCO. In addition, Lessor may propose alternative HVB solutions using unique site design, ingress/egress configuration, etc. that provide an equivalent or greater level of protection for the government’s consideration. Acceptance of such an alternative is up to the LCO’s discretion.

II. The HVB must function 24 hours a day, 7 days a week, 365 days a year to minimum barrier specifications equal to or greater than a Delta Scientific Model DSC501 or approved equivalent.

The HVB will be actuated down and back up for each vehicle entering and/or exiting the premises.

A fully operational barrier is a mission critical physical security component that requires the lessor’s vendor technical expertise to restore operation within 48 hours of failure.

Paragraph 9.4.B:

HVB systems must be installed, maintained and repaired according to manufacturer’s specifications. Qualified technicians must have appropriate certification to maintain and repair the selected HVB system, as well as up to date FBI clearance on file to access the facility to perform maintenance, repair and/or replacement at any time of day as necessary in the event of equipment failure.

The cost of an escort may be at Lessor's expense in the event of system failure and a security cleared technician is unavailable to restore operation of the HVB system.

Paragraph 9.4.C:

I. The initial material/equipment cost of the HVB and related equipment proposed by the Lessor for installation, and accepted by the LCO, is typically considered a BSAC or tenant improvement expense.

II. HVB shall be maintained by the lessor and at the lessor’s expense as recommended by the manufacturer.

III. All preventative maintenance records must be provided upon request by the LCO or designated representative.

IV. Maintenance, repair, and replacement shall be a Lessor expense for the entire lease term.

V. If an HVB is non-functional for longer than 48 hours, 3 times per year the LCO may, within their discretion, require complete HVB replacement at no additional cost to the Government.

Paragraph 9.4.D:

All maintenance and repairs to the HVB systems must be performed:

I. A minimum of five (5) business days’ notice must be provided to the tenant in advance of planned maintenance.

II. Repair personnel must respond to the site and repair unit(s) within 48 hours of request, barring unusual circumstances where a long lead item must be ordered or a catastrophic failure occurs.

III. In the event of operational failure of the HVB(s), the government will be responsible for paying for the first 48 hours of qualified, armed physical security guard service for the affected access point at the Government's expense. Thereafter, the cost of the government contracted physical security service may be the responsibility of the lessor until such time the HVB equipment is fully restored to operational standards specified herein.
