Any persons that do not attend the originally scheduled training shall complete the training and have an understanding of the required minimization measures prior to construction and staging activities.
2. SPECIAL CULTURAL RESOURCES REQUIREMENTS
a. In the event of any inadvertent (unanticipated) discovery of a cultural resource, the
Contractor shall stop work within 100-feet and immediately notify the COR and/or the Western SNR Natural Resources Supervisor. Western will have a qualified archaeologist, who meets the Secretary of the Interior’s Standard, evaluate and assess the find (in consultation with the SHPO and local tribes) if the site is prehistoric in nature.
3. SPECIAL BIOLOGICAL REQUIREMENTS:
a. The following are avoidance measures that the Contractor must adhere to in order to avoid impacts to sensitive plant and animal species in and around the construction area. The Contractor must meet with Westerns environmental team (including Westerns biologist and cultural resources specialist) at least 30-days prior to the start of project activities to review impact and avoidance areas.
b. Prior to the start of project activities, all personnel will participate in environmental awareness training which will inform them of the sensitive habitats within the vicinity of the construction area, species that have the potential to occur in or around the construction area and the avoidance and minimization measures that are to be adhered to during construction activities. Any new crew members that start after project activities have commenced will be given the environmental awareness training prior to working onsite.
(1) MIGRATORY BIRDS AND RAPTORS:
(a) Under the Migratory Bird Treaty Act of 1918, migratory bird species and their nests and eggs are protected from injury or death. Impacts to migratory bird nests shall be avoided during the nesting season (March 1 to August 15). If construction activities occur during the nesting season, Western will survey the construction area for migratory bird nests prior to construction activities and establish appropriate buffers around any nests that may potentially be disturbed. If work must be conducted within these buffers, a Western supplied biological monitor will be on site for construction activities within the buffers. If the biological monitor determines that activities are likely to cause nest impacts or nest abandonment, then construction activities in the area shall be postponed until nestlings have fledged or the nest is no longer active.
(2) BURROWING OWL
(a) From February 1 to August 31 activity will be prohibited within 250 feet of potential burrowing owl nesting dens. From September 1 through January 31, disturbance will be prohibited within 160 feet of potential burrowing owl dens.
Or a qualified biologist will conduct nesting and wintering surveys. If nesting or wintering activity is detected, a qualified biologist will mark and monitor an appropriate non-disturbance buffer in the vicinity of burrows that have been active within the last three years. Within the buffer zone, all activities will be prohibited from February 1 to August 31.
(3) VALLEY ELDERBERRY LONGHORN BEETLE (VELB)
(a) If any activities occur outside the Folsom substation fence, prior to project activities, a qualified biologist will flag elderberry shrubs within 100 feet of the project activities. A minimum buffer zone of 20 feet outside of the dripline of each elderberry plant will be provided during all activities.
(4) SEASONAL WETLAND HABITAT (INCLUDING VERNAL POOLS): Although construction activities will be inside the substation, there are sensitive wetland habitats south and southeast of the Elverta Substation where the transformer shell will be placed. The Contractor will adhere to the following measures:
(a) Vehicle access will only be permitted on well-established roads unless soils are dry. Soils will be considered sufficiently dry for vehicle access when they resist compaction, and after annual plants have set seed (generally June 1 to September 30, or as determined by a qualified biologist based on personal observation of the soils).
(b) When feasible, all maintenance activities will be routed around wet areas while ensuring that the route does not cross sensitive resource areas.
(c) If activities are proposed within 250 feet of a seasonal wetland a biological monitor will be present and/or a qualified biologist will clearly mark the limits of the feature(s) or appropriate buffers. A qualified biologist will clearly flag a 50 foot buffer around all seasonal wetland features if work is proposed during the wet season (generally October 1 to May 31) or flag the feature if work is proposed during the dry season (generally June 1 to September 30).
(d) All equipment will be stored, fueled, and maintained in a vehicle staging area 300-feet or the maximum distance possible from any vernal pool, vernal pool grassland, or seasonal wetland, and no closer than 200-feet unless a bermed (no ground disturbance) and lined refueling area is constructed and hazardous material absorbent pads are available in the event of a spill.
(e) Vehicles will be inspected daily for fluid leaks before leaving the staging area.
4. SPECIAL COMPLIANCE REQUIREMENTS: In addition to items in Section A of this Division 13, the Contractor shall adhere to the following:
a. Prevention of Air Pollution: Folsom Substation is located in Sacramento County, which is under the jurisdiction of the Sacramento Metropolitan Air Quality Management District (SMAQMD).
