First in Section 1.9 of the PWS, the below is stated, The Contractor/Project Manager shall possess three years of recent experience in managing and overseeing employees who perform construction inspection activities, or a total of five years of experience in overseeing employees performing a combination of residential care facility, and commercial construction inspections, with a minimum of one of those five years being residential care facilities.

It appears there are two ways to accomplish the experience.

The first part of the statement says that, The Contractor/Project Manager shall possess three years of perform construction inspection activities [...]

And the later appears to state that if the Contractor/Project

Manager does not have "three years of recent experience" then they need, [A] total of five years of experience in overseeing employees performing a combination of residential care facility, and commercial construction inspections, with a minimum of one of those five years being residential care facilities.

Are we to understand that if the Contractor has three years of perform construction inspection activities that the latter is immaterial? In this, we possess over a decade in overseeing employees whom perform construction inspection activities verifiable vis-a-vis US Government contracts so is the residential care facility oversight experience necessary?

Per Section 1.9 of the PWS, the Contractor/Project Manager shall possess:

Three years of recent experience in managing and overseeing employees who perform construction inspection activities. The contract manager ... must also have at least three years of satisfactory experience in performing construction inspections which demonstrate the knowledge and experience listed below for inspectors. Also see

PWS Section 4.5.2.2 for additional required qualifications.

OR

A total of five years of experience in overseeing employees performing a combination of residential care facility, and commercial construction inspections with a minimum of one of those five years being residential care facilities. The contract manager ... must also have at least three years of satisfactory experience in performing construction inspections which demonstrate the knowledge and experience listed below for inspectors. Also see PWS Section 4.5.2.2 for additional required qualifications.

3 General What is the number of inspections that have been completed in years past?

Approximately 2,000 inspections were completed under the last contract.

4 General How many facilities have been inspected in the past? Approximately 80 facilities over the period of contract

5 General

There were several references to housing and multifamily housing. Please confirm the focus of this program is residential healthcare facilities.

Residential Healthcare Facilities only.

6 General

Historically, the inspections for this program have been completed in person. Will HUD allow remote inspections to be completed rather than in-person inspections? If so, would remote inspections be allowed long-term or only during

COVID-related restrictions?

Under the current contract, virtual inspections are being allowed by virtue of a Mortgagee Letter issued by HUD but are not considered to be the norm. Interim procedures were put in place to address site access issues related to Section 232 Mortgage Insurance Applications

During the COVID-19 Pandemic. On July 31, 2020, Mortgagee Letter

(ML) 2020-25 was issued to mortgagees notifying them of an extension of interim procedures detailed in ML 20-15 which address site access issues related to Section 232 mortgage insurance applications during the COVID-19 pandemic. Part of the ML states the following:

Inspections on New Construction, Substantial Rehabilitation and

Section 241(a)s

For monthly construction inspections on Section 232 new construction, substantial rehabilitation, or Section 241(a) within 60 days of the issuance of this Mortgagee Letter, ORCF will allow a deviation in the normal process for performing these meetings as follows:

• In lieu of an in-person inspection, a live, virtual inspection of building areas and construction that would normally be viewed in the inspection using a video app (e.g. FaceTime) will be allowed.

If this option is chosen, general contractor staff will direct the video from the construction site, and the supervisory architect and HUD contract inspector may participate virtually (if either or both are not attending the inspection in-person).

• The HUD-92448-ORCF (Contractor’s Requisition) may be signed electronically.

• Pictures must be sent electronically to the supervisory architect and the HUD contract inspector.

The program office will work with the contractor as issues such as

COVID-19 come to light.

Section 5.2.1.4.2 refers to printed photographic records. Please clarify if this means printed, printable, or something else?

PWS Section 5.2.1.4.2. states, "Observe and report on construction activities of on-site and off-site construction."

8 General Will HUD provide inspection scheduling and tracking software, or will that be the contractor’s responsibility?

This is the responsibility of the contractor.

9 General

Will HUD provide all the required forms, checklists, and report templates or will those need to be developed by the contractor?

Please clarify the meaning of the inspections listed in Item

0001 through Item 0046. Does the number of inspections described there refer to a facility or physical location for with multiple inspections will be required? (e.g. that will each require a site visit)

Routine Inspections in Line Item Numbers (LINs) 0001 - 0046 shall be performed in strict compliance with the Performance Work

Statement (PWS), Quality Assurance Surveillance Plan (QASP), Attachments 0003 - 0005, and all specifications, terms, conditions, clauses, and all other provisions contained in the solicitation and subsequently, in the contract. Routine inspections in LINs 0001 -

0046 tie back to the required work in the PWS and Attachments 0003

- 0005. For each of the LIN, the contractor shall perform routine inspection described in the PWS in the regions defined in

Attachments 0003 - 0005.

11 General

What has the typical duration of an inspection been in this program?

The number of inspections is defined by the scope and duration of the project. For a 223(a)(7) or 223(f), the project may only require one inspection. For all others the range of duration is 12-18 months with a

9 and 12-month warranty inspection after construction is completed.

12 Solicitation

On Group 7 of the solicitation, the bid sheet calls for 80 inspections for the base period. Are these 80 different projects with 6 different inspections each or a total of 80 inspections for the entire base period?

Under LIN 7 of the base period, up to 80 Route Inspections in Group

7 (Region 3) Arizona, Iowa, Kansas, Montana, Nebraska, North

Dakota, Oregon, South Dakota, and Washington are required.

13 General

Besides being an 8(a) company, do you require any special certifications to qualify for this contract?

This requirement is set-aside for 8(a) Small business concerns on a competitive basis. Interested quoters are required to read the requirements of the PWS and solicitation and must submit all requested items. The evaluation of this solicitation will utilize evaluation criteria pursuant to FAR 13.5 in conjunction with FAR

19.8 with the aim of achieving best value. The Government intends to make an award to the Lowest Price Technically Acceptable responsible offeror who represents the best value to the Government.

14 General

Clarify/confirm if this solicitation is for contractors and/or

MEP FP design engineering consultants?

This requirement is set-aside for 8(a) Small business concerns on a competitive basis. The assigned NAICS is 541350 – “Building

Inspection Services”/541611 – “Administrative Management and

General Management Consulting Services” with a size standard of

$8M and $16.5M, respectively. The anticipated contract type is a

Firm Fixed Price (FFP).

15 General

Is this a new requirement or was there a previous HUD requirement? (if there was a previous requirement contract, what was that contract number?)

The requirement is not new. The requirement is a follow-on to the existing contract, DU100R-15-D-02. DU100R-15-D-02 was awarded as a Single Award Indefinite Delivery, Indefinite Quantity (IDIQ) contract to Maiden & Associates, PC on September 25, 2015.

20 General Does the government intend to award one or multiple awards as a result of this solicitation?

The government intends to award a single FFP contract

21 General Is there an incumbent contractor in place for this contract? If so, can you please provide the existing contract amount?

Please clarify what the government means by periodic inspections. Is it possible to get an accurate number of the inspections that will be required under this contract?

Monthly inspections will be required for each facility. In addition, a

9- and 12-month warranty inspection will be required for each facility.

Paragraphs 1.2 Background and 1.9 Special Qualifications appears to have contradictory information regarding who is required to assist other parties in utilizing HUD forms and procedures relative to the construction of OHP project development. 1.2 states that HUD is, while 1.9 states that the contractor is. Please clarify.

Section 1.2 provides historical and projected context for the requirement. The contractor will be required to assist as required in

Section 1.9 while performing inspections. HUD Construction

Manager will also assist as needed any other time.

Page 18, HUDAR 2452.208-71 states requirements for reproduction of reports. Would the government consider allowing electronic submissions of HUDAR 2452.208-71

Reproduction of Reports?

Note that HUDAR 2408.802-70, is required in solicitations and contracts where the Contractor is required to produce, as an end product, publications or other written materials. This clause does not limit reproduction of reports and/or documents solely to print or written format. For specifics regarding submission and/or production of reports, please see Attachment 0001, the PWS and the 508

Compliance Statement in the solicitation.

With regards to inspector's experience, Section 4.5.2.2 states that:

three years of recent residential care facility construction inspection activities or five years of experience in a combination of residential care facility, and commercial construction inspections, with a minimum of one of those five years being residential care facilities.

A) Would the government consider allowing inspectors with substantial experience in the field of construction but not specific to experience in residential care facilities in remote hard to reach areas?

B) Would the government consider allowing an in-house residential care facility inspector expert and/or PM to review and approve the inspections of qualified construction inspectors when an experienced residential care facility inspector is not available in certain remote areas?

I know that this RFQ is a SBA 8a compete requirement. Is a company that is currently in the 8a program eligible to be considered for award of this solicitation/contract if it teams through a teaming agreement with a company which has already graduated from the 8a program?

This requirement is set-aside for 8(a) small business concerns on a competitive basis. A company currently in the 8(a) programs can team with a company who is not in the 8(a) program. Ensure to adhere to any limitations on subcontracting and/or any SBA requirements regarding Joint Ventures.
