NSSC-ELMT Addendum to NF 1823

Manufacture Name: ___________________________________

Restriction on Use of Funds for Acquisition of the Information Technology Systems

NASA is required to comply with Section 516 of the Consolidated and Further Continuing Appropriations Act, 2013, Public Law 113-6, enacted March 26, 2013. As a part of compliance, NASA IT Security conducts an assessment process, also referred to as Supply Chain Risk Management (SCRM), required by the Fiscal Year (FY13) appropriations language.

Section 516 (a) of the Consolidated and Further Continuing Appropriations Act, 2013 restricts the use of FY13 appropriated funds. The language requires an assessment of risks related to espionage and sabotage involving the People’s Republic of China before funds is expended on any IT system procurements. The specific language follows:

Sec. 516 (a) None of the funds appropriated or otherwise made available under this Act may be used by the Department of Commerce and Justice, the National Aeronautics and Space Administration, or the Nation Science Foundations to acquire and information technology system unless the head of the entity, has made an assessment of any associated risk with such system being produced, manufactured or assembled by one or more entities that are owned, directed or subsidized by the People’s Republic of China.

(b) None of the funds appropriated or otherwise made available under this Act may be used to acquire an information technology system described in an assessment required by subsection (a) and produced, manufactured or assembled by one or more entities that are owned, directed or subsidized by the People’s Republic of China unless the head of the assessing entities described in subsection (a) determines, and reports that determination to the Committees on Appropriations of the House of Representatives and the Senate, that the acquisition of such system is in the national interest of the United States.

To support the referenced assessment process within NASA, the NASA Information Technology (IT) Security Office has requested the NASA Shared Services Center (NSSC) Enterprise License Management Team (ELMT) to obtain the following information from Software Publishers to support an internal Request for Investigation (RFI)/IT Product Source Assessment.
