ADDENDUM TO 52.212-2 — EVALUATION—COMMERCIAL PRODUCTS AND
COMMERCIAL SERVICES
The provision at FAR 52.212-2, Evaluation—Commercial Products and Commercial Services, applies to this solicitation and is supplemented as follows.
(a) (1) Evaluation Process:
The Government will make an award, to the responsible Offeror whose offer conforming to the RFP will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate proposals: Technical Acceptability, Price and Past Performance. This acquisition will be conducted using the policies prescribed in FAR Part 12, Acquisition of Commercial Products and Commercial Services, in conjunction with the procedures of FAR Part 15, Contracting by Negotiation, and award will be made using the lowest-price-technically-acceptable source selection process (as described in FAR 15.103-2). Award will be made on the basis of the total lowest evaluated price for each proposal meeting or exceeding the acceptability standards for non-cost factors.
(1) Offerors will be checked against the List of Parties Excluded from Federal Procurement and Non-procurement programs. Offerors who appear on the List will be eliminated without further consideration.
(2) The Government will establish a price ranking for all CLINS combined from lowest to highest based on the total evaluated price. The lowest price will be evaluated for technical acceptability. If the lowest price is determined to be technically acceptable, then award will be made to that Offeror.
(3) If the Government is unable to make a technical acceptability/unacceptability determination for the lowest priced offer, the Government reserves the right to hold exchanges only with the lowest priced Offeror prior to evaluating the second lowest priced proposal for all CLINS combined. Proposal revisions will not be accepted.
(4) If after exchanges conclude and the lowest priced proposal for all CLINS combined is determined technically acceptable, award will be made to that Offeror. If after exchanges conclude and the lowest priced proposal for all CLINs combined is determined not technically acceptable, the Government will evaluate the second lowest priced proposal for technical acceptability. This process will continue until the lowest priced technically acceptable proposal is identified.
(5) When the contracting officer determines exchanges on matters unrelated to technical acceptability (e.g., industry terms and conditions such as a warranty clause or pricing omissions, discrepancies or other irregularities preventing the Government from determining an Offeror’s total evaluated price) to be necessary, the Government reserves the right to conduct exchanges to resolve these matters.
(6) A written notice of award or acceptance of an offer will be furnished to the successful Offeror within the time for acceptance specified in the offer and shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(2) Price Evaluation:
(a) The Government will evaluate the price proposal in accordance with FAR 15.404 proposal analysis to ensure a fair and reasonable price.
(b) For purposes of source selection, the total evaluated price will consist of the sum of CLINS (1), (4), and (5) if the Offeror proposes Two Rechargers - Truck Mounted or CLINS (2), (3), (4) and (5) if the Offeror proposes Two Rechargers Trailer/ Tractor.
(1) The Recharger – Truck Mounted price per unit will be multiplied by the Quantity (Qty).
(2) The Recharger – Trailer price per unit will be multiplied by the Qty.
(3) The Tractor price per unit will be multiplied by the Qty.
(4) Spare Parts – cold ends per unit will be multiplied by the Qty.
(5) Spare Parts – relief valves. Relief valves will be multiplied by the Qty.
(3) Technical Acceptability:
(a) The Technical Acceptability Factor will be evaluated on a pass/fail basis based on the Offeror’s compliance with the requirements specified in Attachment J-01, Statement of Work (SOW). Only proposals that are individually rated "Acceptable" or "Potentially Acceptable" are evaluated for past performance. An "Unacceptable" rating will result in an overall proposal being rated "Unacceptable", which eliminates the proposal from further consideration and makes the proposal ineligible for award.
(b) Technical Acceptability ratings:
(1) "Acceptable" means the proposal meets the minimum requirements identified in the solicitation for the respective area.
(2) "Unacceptable" means the proposal does not meet the minimum requirements identified in the solicitation for the respective area.
(3) A proposal may be rated "Potentially Acceptable" under a respective area when the Government is unable to make an "Acceptable" or "Unacceptable" determination and clarifications are necessary to validate the information provided to make such a determination. Although an Offeror may receive a rating of "Potentially Acceptable," it does not guarantee that the Offeror will be provided an opportunity to revise its proposal. Because clarifications may enhance the Government's understanding of a proposal, allow reasonable interpretation of a proposal, or facilitate the evaluation process, the Government may assign a rating of "Unacceptable" at the conclusion of clarifications.
(c) The Government will evaluate Technical Acceptability to determine whether –
(1) The Offeror’s proposal provided both the make and model information of the proposed Recharger - Truck Mounted or Recharger Trailer/Tractor and the description addresses each requirement listed in the Statement of Work.
(2) The Offeror provided a Process and Instrumentation Diagram (P&ID) that demonstrates compliance with ASME B31.3 consensus design codes for severe cyclic service. P&ID shall be provided and demonstrate compliance with ASME B31.3 requirements, including all required piping, valves, instruments, relief devices, controls, and equipment tags per SOW 5.1.h.iii.
(3) The maximum allowable working pressure of each of the Offeror’s rechargers meets or exceeds 10,000 psig. The proposed liquid nitrogen dewar's maximum working pressure is capable of receiving pressure offloaded LN2 at 40-50 psig per SOW 5.1.i.iii and includes ASME BPVC Section VIII documentation.
(4) Each of the Offeror’s rechargers (including any modifications) will reliably deliver the required flowrate of 12,000 scfm (720,000 scfh) at 10,000 psig minimum per SOW 5.1.g.iv and meet the pipeline test requirement of 9,500 scfm ± 400 scfm at 6,000-6,500 psig per SOW 5.5.3.b.i. (a-c).
(5) The Offeror’s proposed control logic provides adequate control capability to operate the recharger(s) without damage while maintaining required discharge pressure and temperature.
(6) The Offeror’s proposed protective coating method is equivalent to or meets NASA-STD-5008B requirements.
(7) The Offeror’s proposed spare parts for cold ends and relief valves must be consistent with the part numbers on the proposed rechargers.
(4) Past Performance Evaluation
(a) The Government will evaluate the Offeror’s past performance to determine whether the Offeror has demonstrated a record of satisfactory performance on relevant contracts or orders for similar products or requirements.
(1) Past performance will be evaluated on an acceptable or unacceptable basis. The Offeror’s recent and relevant past performance of work similar in size, content, and complexity to the requirements of this acquisition will be evaluated. Contracts cited by the Offeror shall meet the criteria established in the provision.
(2) The Government will evaluate the Offeror’s past performance in :
(a) Overall project management ability
(b) Completing a project within deadline
(c) Ability to complete project according to specifications
(d) Ability to ensure quality workmanship
(e) Complete deliverables as required
(f) Understanding and compliance with safety requirements
(g) Effectiveness and timeliness of corrective actions
(h) Contractor’s performance regarding cure notices, show cause letters, or terminations for cause/default.
(i) Overall Contractor Performance
(3) The Government may supplement the information contained in the proposal with information obtained from the Government organizations and personnel, commercial sources, public information sources, and, if applicable, data gathered during clarifications and negotiations.
(4) The Government will consider, among other things, the currency and relevance of the information, source of the information, context of the data, and general trends in the Offeror's performance.
(5) An Offeror with no relevant past performance history will not be evaluated Favorably or unfavorably on the basis of past performance.
(b) Past performance acceptability ratings:
(1) An “Acceptable” rating will be assigned when (1) the Offeror’s past performance record indicates at least a rating of “satisfactory” performance on relevant contracts or orders, therefore allowing the Government to have a reasonable expectation that the Offeror will successfully perform the required effort; or (2) the Offeror’s performance record is unknown. See note below in paragraph (c) of this section.
(2) An “Unacceptable” rating will be assigned when the Offeror’s performance record indicates an unsatisfactory record of performance, and therefore, the Government has no reasonable expectation that the Offeror will be able to successfully perform the required effort.
(c) Note: In the case of an Offeror with no record of relevant past performance, or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the Offeror shall be determined to have unknown or neutral past performance. In the context of acceptability/unacceptability, the “unknown” or “neutral” shall be considered “acceptable.”
(6) Responsibility
In addition, Offerors must be deemed responsible in accordance with FAR Subpart 9.1 prior to award.
(b) Not Applicable
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
