About this file

This document is a Phase 1 (Pre-Proposal) Requests for Information for NASA's Launch Complex (LC) 39 Area Duct Bank System Replacement solicitation (80KSC026R0007). The procurement involves a design-build contract for a duct bank system replacement with a proposed performance period of 2,009 calendar days (approximately 5.5 years). Key details include a Project Labor Agreement (PLA) requirement, two-phase proposal process, and submission of technical qualifications, past performance, and organizational information. The Phase 1 proposal is due on December 16, 2025, at 2:00 PM EST, with Phase 2 expected to include more detailed design criteria and specific project requirements. The solicitation seeks a comprehensive proposal demonstrating experience in secure or mission-critical environments, with emphasis on team capabilities, technical competence, and past performance in complex infrastructure projects.

Item # Solicitation or Attachment Reference Question Response

1 Attachment 9, Project Labor Agreement Has NASA requested an exception as allowed under Memorandums M-24-06 and M-25-29, and if not, will NASA consider eliminating the PLA requirement?

NASA has not requested an exception as none of the exception critieria outlined in FAR 22.5 are applicable to this requirement. NASA would consider eliminating the PLA requirement if it is determined to have prevented adequate competion at a fair and reasonable price; however, this is not expected since PLA only coordinates existing CBA's into one agreed to document that defines standard construction issues like work hours and other elements that allow the job to run smoothly.

2 Attachment 9, Project Labor Agreement Will NASA provide a copy of the PLA during this Phase 1 process that the successful design builder will be expected to sign or that will be incorporated into the final contract?

Refer to Provision FAR 52.222-33 Alt 1. The apparent successful offeror shall submit to the Contracting Officer a copy of the project labor agreement prior to contract award.

3 Attachment 9, Project Labor Agreement

Since this procurement will result in a sealed bid submission to NASA and considering the construction industry received no advance warning of a PLA in either the Sources Sought of Pre-solicitation notices, has NASA performed market research that demonstrates the expectation of receiving at least three qualified bids after the industry was made aware of the requirement for a PLA?

This procurement will not result in a sealed bid. Procedures utilized are in accordance with FAR Part 36 and FAR Part 15, Contract by Negotiations. NASA/KSC has active contracts that utilize PLAs and expects sufficeint interest.

4 Factor 3 Past Performance p g and ongoing reductions to the Federal Government workforce, obtaining a PPQ for a contract having a CPARS is duplicitative and may be difficult for an offeror to obtain. For these reasons, if a Federal Government contract is used in Offeror's response to this factor, please confirm the most current CPARS may be provided in the proposal in lieu of the Attachment 5 PPQ.

Confirm. Factor 3 - Past Performance paragraph b. has been updated to clarify. A note is also included in Attachment 5.

5 General Question Would you be able to provide drawings and specs to give us a better idea on items such as duct bank thermal performance specs, conduit specs (watertight vs sediment), conduit size & spacing, etc. Design Criteria and concepts specfic to the project will be provided in Phase 2 of the RFP.

6 Bid Bond Requirements Is there a minimum bid bond associated with this solicitation?

A Bid Bond is not required for Phase 1. Refer to Section L, Volume 1, Paragraph (e) for the bonding specifics.

7 Attachment 5 Attachment 5 indicates CPARS may be submitted in lieu of the questionnaire. Plesae confirm included CPARS do not count against the page count. CPARS will not count against the page count.

8 Section I - Contract Clauses

With the 2,009 calendar day period of performance (5.5 years) and the certainty that construction will be impacted by launch activities, please consider including FAR 52.216-4 Economic Price Adjustment - Labor and Materials. Inclusion of this clause for long-duration contracts is desirable for Offerors as it provides a backstop against catastrophic cost escalation.Having this backstop allows Offerors to estimate a lower value for speculative price-related continginces, leaving a larger portion of the budget for known work scopes like ductbank, conduit, and conductors. Other Federal agencies have incorporated this clause on large, complex, and longduration design-build to budget procurements and it has been favorably viewed by Offerors.

The period of performance is negotiable and may be expedited based on proposals/concepts in Phase 2. The estimated 2009 day duration is due to the historical production lead time of the major equipment. The price should be set early in the contract when the items start production.

Additionally, the perscription of this clause would not be applicable per FAR 16.203-4(c)(ii);

therefore FAR 52.216-4 Economic Price Adjustment - Labor and Materials will not be included.

9 Volume III, sub-factor 2 capability to perform.

The first item in this section requires submission of informaton on Offeror's organizational structure and key personnel qualifications. However, the RFP provides no guidance on the specific information needed on the organizational structure or the key personnel for which Attachment 8 (Sample Qualification Template) should be submitted. Futher, the prelimninary criteria for Phase 2 noted on page 45 of the RFP indicate key personnel and team organization information is required in this section. Please provide clarity on the Phase 1 submission requirement relative to organizational strucure and key personnel. If submission of Attachment 8 is required, please either provide the positions (project executive, project manager, construction superintendent, lead engineer, etc.) or indicate it is up to the Offeror to determine the positions. Should submission of Attachment 8 be required for Phase 1, please confirm these forms do not count against the 15-page limitation for Factor 2.

Phase 1 submission requirement relative to sub-factor 2 is up to the offeror to determine the key positions. Attachment 8 is a sample provided and does not count against the 15-page limitation for Factor 2. If selected into Phase 2, the Phase 2 criteria will be defined further considering the design crtiteria provided.

10 Volume IV - Factor 3 - Past Performance.

Please confirm the following items do not count against the page limitation for this Factor:

Performance Evaluation Questionnaires.

Safety and Health Questionnaire & OSHA 300A Financial Questionnaire.

The Performance Evaluation, Safety and Health, and Financial Questionanaires will not count against the page limitations for ths factor.

Volume III – Factor 2 – Technical Qualifications

– Sub-Factor 1

Specialized Experience and Technical Competence, requires offerors to describe their “Experience working in secure or mission-critical environments (e.g., NASA, DoD, DOE)”. Please confirm offerors can use the past performance of affiliates / subsidiaries (that often work together / collaborate on projects and belong to a family of companies) to demonstrate experience working in a secure or mission critical environment.

The experience is intended to correlate to the successful performance of this project. The experieince of the affiliates/subsidaries working together as a team can be used but ensure it is explained as described within the Volume *Provide a description of the Offeror's Teaming Agreement(s). Use of the DBIA Standard Teaming Agreement is preferred. Use of the American Institute of Architects and Associated General Contractors of America (AIA-AGC) Teaming Agreement is also acceptable.
