Use of NASA Resources

• Participants may request use of NASA facilities, personnel , equipment, or services that are unique or not reasonably commercially available.

• Participants planning to use such NASA resources may enter into separate Reimbursable Space Act Agreements (RSAA) directly with the appropriate NASA Center(s).

• Participants may also request Government Furnished Services or Equipment; however, such requests will require further negotiation, and potentially require additional articles within the SAA, and the adherence to additional requirements (i.e., such as CLDP-REQ-1130 Requirements and Standards for the Commercial Low Earth Orbit Development Program for crew and cargo transportation, ISS requirements for ISS assets, etc.).

• Any decision to pursue NASA facilities, equipment, or services shall be at the Participant’s discretion and risk; the Participant shall remain solely responsible for performance of this FSAA regardless of the availability (or non-availability), use or actual cost of the requested NASA resources.

• NASA is providing a Public-Private Partnership Support Guide (PPSG) to identify NASA services available to be requested by commercial partners to support development of a CLD using RSAAs.

For Planning Purposes:

Due with Industry Feedback on September 12, 2025

• Requesting Industry to identify potential GFS/GFE they may anticipate requesting within their FSAA Proposal, as well as

RSAAs they may anticipate to enter into with respective centers.

Appendix 3 - C3DO Insight Plan

• Purpose

– In order to collaborate with industry on future certification, AFPP is requesting industry provide an Insight Plan to outline how to provide insight data to NASA in the most expeditious and least impactful to commercial processes.

– The purpose of this Insight Plan is to document and detail the Participant’s approach to providing NASA insight into the design, development, operation, and demonstration of their crewed destination in LEO and the next phase for formal certification, including safety, human-rating, and operational integration.

– Additionally, general insight is needed to understand partner progress, identify areas NASA could provide assistance and expertise, and provide awareness of developing issues for resolution prior to major milestones.

• Content

– Should include design, development, and testing of the CLDS systems, including joint transportation systems, operations, mission and ground systems.

• Approach

– The intent is for NASA’s insight to be on a non-interference basis. The NASA Insight Team will be comprised of key subject matter focals to streamline communication and enable a joint approach to gaining insight.

• Types of insight could include

– Database/tool access, observation of internal boards (engineering, risk, test readiness etc.), observation of key development activities (test, verifications), review of safety products, operations and systems development, NASA resident office, etc.

Cooperative Data Sharing for NASA Certification

• NASA intends to pursue a future procurement to certify end to end services for commercial space station systems utilizing commercial crew and cargo transportation systems for habitation and utilization for NASA use.

– Partner agrees to provide to NASA additional insight data to aid in this effort.

– As resources allow and deemed necessary by NASA, NASA may perform analyses, tests and integration activities using the data, and to provide substantive feedback to the Partner concerning their progress towards potential NASA certification.

– The data to be used for this purpose would be a combination of data that is already being submitted as part of a milestone closure and insight data outside of the milestone closure process.

• NASA will request any insight data desired outside the milestone closure separately according to the Partner provided CD3O SAA Insight Plan (Appendix 3).

– The Partner’s submission of this represents the Partner’s consent for NASA to use this data for these purposes.

– This data would not be used for evaluation or selection of any future certification contract.

• Insight data is not a separate category of data for the purposes of establishing NASA or Partner Rights in Data. The Data NASA produces is considered Data First Produced by NASA under this Agreement in accordance with Article 13, Intellectual Property Rights – Data Rights and will be protected accordingly. Data provided by Partner as part of insight may be either Data produced by the Partner under the Agreement or Background Data under Article 13.

Background

In 2019, NASA established the Commercial Low Earth Orbit (LEO) Development Program (CLDP) to lead and facilitate LEO commercial destination agreements and contracts in close collaboration with commercial industry partners, International Space Station Program (ISSP) and the Commercial Crew Program (CCP) all with the goal to maintain a continuous human presence in LEO that advances human space exploration, scientific discoveries, and United States economic competitiveness and commercial participation and to stimulate private sector’s investment in LEO.

NASA is seeking to partner with U.S. Commercial LEO Destination Providers (CLD Providers) utilizing a Funded Space Act Agreement (FSAA) to further mature the design, development, testing and crewed demonstration of a commercially owned and operated Commercial LEO Destination Systems (CLDS).

NASA’s objective of the C3DO strategy is to expedite the development of multiple commercial space station destinations, advancing them to the stage of an on-orbit LEO crewed demonstration flight as soon as possible, with NASA's target set for no later than 2030. This will be achieved while ensuring cost-effectiveness, crew safety, adherence to potential customer needs, and enabling research and technology development on these space stations.
