About this file
This is an Additional Requirements document for a State of Nevada, Division of Purchasing and Nevada Department of Transportation competitive bid for Temporary Impact Attenuator products under a one-year Open Term Contract. The contract is established to provide competitive pricing for temporary impact attenuators for the Department of Transportation, with quantities listed as estimates only and no obligation to purchase definite amounts. All bids must be submitted through NevadaEPro and are restricted to specific manufacturers or products listed in the bid specifications and referenced in Section 625.02.04 of the 2014 Edition of the Nevada Department of Transportation Standard Specifications for Road and Bridge Construction and the Department of Transportation's Qualified Product List (QPL). Bidders must recheck bid prices for errors prior to submission, as changes after the bid opening will not be permitted, and failure to furnish products at the bid price may result in removal from the bidder's list for one year.
The contract permits annual extensions provided there are no price increases, no changes in terms, and the extension is in the best interest of the State. Price increases will not be honored during the contract term; vendors unable to maintain bid prices due to supplier increases must request written cancellation from State Purchasing, after which the State will obtain products from the next lowest bidder. Either party may cancel items with 15 days' written notice for cause, including changes in manufacturer prices or freight rates. The contract is primarily for use by the Nevada Department of Transportation but may be extended to other State agencies, cities, counties, or political subdivisions as needed. Bidders must state any deviations from specifications on a separate sheet; absent such statement, the State will assume all requirements are met. All questions concerning the solicitation must be directed to the Purchasing Division's designee only, and discussions between agency employees and prospective vendors regarding the procurement contents may result in bid disqualification.
