3.5 NASA MISSION FREEZE CONDITIONS
There may be occasions when on-site work must be suspended to accommodate launch, on-orbit maneuvers and other high risk events in which NASA will
SECTION 01 00 00 Page 13 issue a “freeze” directive to support facilities. During the “freeze”, all construction and/or modification work will cease in order to reduce the risk of an unplanned event that would impact the mission. The N254 facility is subject to these freeze events, which have a typical duration of 1 to 14 weeks. During these events all N254-related construction shall be suspended. NASA will provide the Contractor as much advanced notice as possible of freeze events and will make every effort to mitigate construction impacts.
3.6 BURROWING OWL HABITAT
Western burrowing owl habitat and an owl breeding preserve presently exist north and east of the N254/N254A fence lines. Development and construction activity at Ames is regulated according to the Burrowing Owl Habitat Management Plan (BOHMP). Where there is a discrepancy between the BOHMP and these notes, the BOHMP takes precedence.
Pursuant to the BOHMP, the project is governed by the following:
a. No permanent development or temporary construction activity is permitted within the preserve to avoid impacts to owls.
i. Impacts to owls include disturbance within 160 feet of an occupied burrow, destruction of an active burrow, or destruction/degradation of foraging habitat within 300 feet of an occupied burrow.
ii. To avoid "take" under the Migratory Bird Treaty Act and CDFG Codes, disturbance of active nesting territories should be avoided during the breeding season, from March 1 to August 31.
iii. To avoid impacts, disturbances must be 160 feet from occupied burrows during the non-breeding season and at least 250 feet away during the breeding season.
b. Equipment will not be staged within any preserve.
c. Surveys will be done within 1-2 weeks before starting any construction activity, including staging equipment. NASA will provide a qualified wildlife biologist to survey for occupied burrows upon request.
d. In the event that an occupied burrow or active nest is found within the relevant buffer, NASA will provide a qualified on-site biological monitor to ensure that disturbances do not cause burrow or nest abandonment. Biological monitor may use standard methods, including temporary stop-work and changing the work schedule to avoid times of day most likely to affect owls. The Contractor will coordinate monitoring schedule with Chris Alderete by phone at 650-604-3532 or by email at christopher.s.alderete@nasa.gov.
e. During the breeding season, if an occupied burrow is found within the 250' buffer, work may be delayed until the NASA wildlife biologist determines that nestlings have fledged.
3.7 AIR EMISSIONS INFORMATION DURING CONSTRUCTION
The Contractor shall submit, annually (within the performance period) and upon request by the Contracting Officer (CO), information on construction
SECTION 01 00 00 Page 14 and demolition activities, including operational air pollutant emissions.
