About this file

This is a Scope of Work document for the Utah Department of Transportation (UDOT) establishing specifications for a pavement marking acrylic water-based paint contract. UDOT seeks qualified vendors to supply pavement marking waterborne traffic paint in white, yellow, and black colors meeting UDOT standard specification 02765. The contract will be awarded to a single bidder for an initial three-year term with two optional one-year renewals. Paint products must be ordered on an as-needed basis, with no guaranteed minimum quantities. The document provides detailed technical specifications for both "High Build" pavement marking waterborne paint and low temperature acrylic waterborne paint, including requirements for pigment content, total solids, viscosity, density, VOC limits, opacity, and reflectance properties. Paint must be supplied in specified container sizes including 250-gallon cubical stainless steel totes, 250-gallon cubical polyethylene totes, 345-gallon cylindrical stainless steel totes, and five-gallon buckets. Estimated statewide annual purchases are outlined by region, with Region 1 (Ogden) requiring 135 square totes and 14 round totes, Region 3 (Orem) requiring 190 square totes and 6 round totes, and Region 4 locations requiring varying quantities of both tote types.

Pricing must be provided on a delivered cost per gallon basis to UDOT regional locations, with contract prices guaranteed for one year from award. After the initial guarantee period, any price adjustment requests require 30 days' notice and must include supporting documentation demonstrating a mathematical link between current and proposed pricing. All orders must be received by UDOT within 30 calendar days of the order date, with late deliveries subject to a five percent discount per 14-day period to a maximum of 20 percent. The contractor must notify UDOT of shipment within seven calendar days and provide an approximate delivery date. Paint received cannot be older than three months from the manufacture date. Tote replacement turnaround time cannot exceed 10 calendar days. The contractor must return completely emptied and cleaned totes with no "topping off," subject to penalties ranging from $100 to $500 per tote depending on violation frequency. All invoices must reference the purchase order or contract number and be submitted to regional UDOT accounts payable addresses. The solicitation is issued in accordance with the Utah Procurement Code and applicable administrative rules.
