About this file
This document is a Questions and Answers (Q&A) amendment for federal contract solicitation CSS NIH NCI 75N98026Q00070.
The amendment clarifies five key aspects of the procurement: (1) this is a new contract award with no incumbent contractor; (2) the award will be made directly to the OEM manufacturer; (3) the Government will not procure equipment through small business distributors or resellers; (4) FAR 52.219-6 was inadvertently included in the solicitation and should be disregarded; and (5) equipment manufactured in Germany qualifies as TAA-compliant under the Trade Agreements Act because Germany is a designated country. The Government confirms that German-manufactured components or products substantially transformed in Germany into new articles of commerce meet TAA compliance requirements, provided the offeror certifies compliance with applicable FAR provisions. The estimated equipment value exceeds $730,000, triggering TAA applicability under FAR 25.402(a)(1), which restricts purchases to U.S.-made or designated country end products only.

Amendment 1 (one)
1. Q: We would like to know if this is a brand new contract OR if there is (was) an incumbent performing these services.
A: This is a new award.

A: Yes, the award be made directly to the OEM manufacturer This is a new award.
3. Q: Does the Government intend to procure the equipment through a small business distributor or reseller?
A: No, the Government does not intend to procure the equipment through a small business distributor or reseller.
4. Q: Is the inclusion of FAR 52.219-6 intentional in this context?
A: FAR 52.219-6 was inadvertently inserted into the solicitation.
5. Q: Can the Government confirm whether these components would be considered TAA-compliant if they are substantially transformed into a new product in a designated country, consistent with FAR country-of-origin rules?
A: Because the estimated value of the equipment exceeds $730,000, the acquisition is subject to the Trade Agreements Act (TAA) in accordance with FAR 25.402(a)(1). Under FAR 25.403(c) and the clause at FAR 52.225-5, Trade Agreements, only U.S.-made or designated country end products are permissible. Germany is a designated country under the TAA.
