Building 3000 Back Deck Replacement
1. Introduction: This Statement of Work describes the requirements for an outside contractor to provide the following material and labor to build a deck for egress purposes for the Day Treatment Program.
a. Background: Replace the back deck of Building 3000 (Quarter Maintenance
Office/Shop and the Day Treatment Program) for safety and egress purposes.
b. Place of Performance: Worksite is at Building 3000 on Aspen Street and is associated with the Indian Health Service – Northern Navajo Medical Center; Shiprock, NM 87420.
c. Scope: The contractor shall:
i. This proposal is for the labor and materials for replace the back deck of Building
3000. Estimate work to be completed is approximately 3-4 weeks, approximately 1-5 days for delivery time of supplies/material. The contractor shall meet the following criteria but not limited to daily jobsite clean-up, debris to be hauled off to a qualified landfill, utilize their company trucks to haul debris, pick up supplies/material and bring their equipment and or tool trailer.
ii. Contractor and their staff are to mobilize on site and begin demo of old decking and begin to form a new deck framing structure. Install a 55’ x 4’ deck to connect the two back doors of Building 3000. Materials to install for proper framework are new composite decking, 4” x 4” posts, cement post holders, (1) 55’ ledger, lag screws to anchor to wall, screws, redwood for 55’ x 4’ 4” hand rails (to match pre-existing rails) and all composite deck materials to complete landing. Included are: screws, hangers (if needed), hand tools, consumables, (blades, drill tips etc.), extension cords, ladders, cones, caution tape etc. New deck to reconnect to already existing concrete ramp and will have no steps. The sections of the deck with and open edge (south and west sides) will have handrails similar to the ones before. Installs will be treated wood & composite wood to withstand the exterior elements.
iii. Work will commence between 7:00 am to 5:30 pm Monday-Friday. No Davis bacon wages or prevailing wages. Restrooms and utilities to be provided by client as per site visit.
iv. Other inclusions in bid are but not limited to mobilization/demobilization, labor (no prevailing or Davis Bacon wages), materials to install, safety equipment, dollies for furniture removal/replacement, basic hand tools, equipment, ladders, drop clothes, extension cords, clean up supplies, shop vac, clean up equipment, cones and caution tape to complete this project. Bid may also include daily JHA, Evacuation Plan, Timeline Updates if necessary. PLEASE PROVIDE Davis Bacon Wages if they Apply. Bids should include all necessary labor, product installations, supervisory labor, any cost for deliveries and imports of materials on company trailers and vehicles. Contractors may leave trucks, trailers and or vehicles on work premises to save on mobilization fees until job is complete but
IHS will not be responsible for any damage or theft to contractor’s property.
Building is to provide all utilities: electric, water and use of restrooms.
Contractor’s may request for a 30% bill out to purchase materials and to assist with mobilization.
d) Special Conditions: The Quarters Compound is accessible and IHS-NNMC Staff are available for questions and or coordination from Monday to Friday 7:00 am to 5:30 pm;
excluding Government Holidays.
2. Performance Period: The contractor shall accomplish all work in a timely manner according to their work schedule 120 days from date of award.
3. Government Furnished Property:
a. The Government will NOT provide tools, labor, materials, supplies, transportation, equipment, supervision or other items to perform required services.
b. The government shall make all reasonable required utilities available to the Contractor from existing outlets.
4. Contractor’s Furnished Property:
a. The Contractor shall provide their own tools, labor, materials, supplies, transportation, equipment, supervision or other items to perform requested services.
b. Provide written recommended care and maintenance guidelines.
c. Provide a written 20-year warranty on material and labor on finished project.
d. Deliverable: The Contractor will coordinate with Quarter Maintenance Supervisor Marvin Bitah who will be the Point of Contact at (505) 368-6153 or by email at Marvin.Bitah@ihs.gov.
5. Contractors Requirements:
a. Contractor shall furnish all material, equipment, tools and any other items to complete the task.
b. Provide all personal protective equipment (PPE) required by the contractor’s personnel for safe execution of their duties.
6. Administrative Requirements:
a. The contractor shall report to the Point of Contact (POC) before and after service project.
b. The contractor shall perform work during their business hours as outlined in their proposal.
c. The contractor is responsible for any damages to Government Property caused by the Contractor’s employee or equipment.
d. The contractor shall coordinate all work with the Point of Contact (POC).
7. Quality Assurance:
a. Safety Data Sheets (SDS).
b. Standards as required by Federal Statues of substance, material or products must be provided for all projects. They must meet or exceed the performance specification when replace deck.
c. Defective materials/latent defects caused by the manufacturer must be replaced at no charge.

The Contractor shall be required to (a) commence work under this contract within 1 days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 120 days. The time stated for completion shall include final cleanup of the premises.

NAIHS-ACQ-07 PRE-CONSTRUCTION RISK ASSESSMENT AUG 2021
The Indian Health Manual, Part 1, Chapter 9 Occupational Safety and Health (OSH) Program (The Manual) serves as a general outline for carrying out the OSH program. The provisions set forth in The Manual meets or exceeds the minimum requirements as set forth in Title 29 Code of Federal Regulations, Part 1960, entitled “Basic Program Elements for Federal Employee OSH Programs and Related Matters,” Section 19 of the Occupational Safety and Health Act; and Executive Order 12196, dated February 26, 1980. While not specifically mentioned in the OSH related regulations, executive orders, program guidance, etc., it is in the Agency and in the public interest to afford the same conditions to visitors, patients, contractors, and others present in Indian Health Service facilities.
As part of the implementation of The Manual, the Northern Navajo Medical Center uses a guide and checklist known as the Pre-Construction Risk Assessment or PCRA. The PCRA – included in all solicitations and awards for construction and construction-related work on GIMC premises – is completed by the government’s requiring activity, as coordinated with and approved by the GIMC’s Safety Program Office before any work on premises can proceed.

(a) Definition. “Contracting Officer’s Representative (COR)” means an individual designated in by the Contracting Officer as authorized personnel responsible for the technical aspects of the contract and serves as technical liaison with the contractor. The COR is also responsible for the final inspection and acceptance of all deliverables and such other responsibilities as may be specified in the contract.
(b) Per FAR Subpart 1.602-2(d): The Contracting Officer (CO) determines that this contract requires a Contracting Officer Representative (COR).The Contracting Officer Representative (COR) is:

(c) Upon award, the COR will receive a copy of the written designation, specifying the extent of the COR’s authority on behalf of the CO.
(d) Limitations. The COR is not authorized to make any commitments or changes that will affect price, quality, quantity, delivery, or any other term or condition of the contract. Any contractor request for changes shall be referred to the CO directly or through the COR. No such changes shall be made without the express written prior authorization of the CO.
NAIHS-ACQ-09 UNAUTHORIZED COMMITMENTS SEP 2023
(a) Definitions.
Contracting Officer means a person with the authority to enter into, administer, and/or terminate contracts and make related determination and findings.
Ratification means the act of approving an unauthorized commitment by an official who has the authority to do so.
Unauthorized Commitment (UAC) means an agreement that is not binding solely because the Government representative who made it lacked the authority to enter into that agreement on behalf of the Government.
(b) Policy.
The Government is not bound by agreements with, or contractual commitments made to, prospective contractors by individuals who do not have delegated contracting authority.
Unauthorized commitments do not follow the appropriate process for the expenditure of Government funds. Consequently, the Government may not be able to ratify certain actions, putting a contractor at risk for taking direction from a Federal official other than the contracting officer (see FAR 1.602-1) Government employees responsible for unauthorized commitments are subject to disciplinary action. Contractors perform at their own risk when accepting direction from unauthorized officials. Failure to follow statutory and regulatory processes for the expenditure of Government funds is a very serious matter.
(c) Procedure.
Any agreement, modification, or change to a contractual agreement made by a government personnel who lack authority will be deemed an unauthorized commitment. The Government is not liable to the Contractor or under the terms of the contract, financially or otherwise – unless the unauthorized commitment successfully passes the ratification process.
The ratification process does not have any lead time, nor does the Government make any promise that an unauthorized commitment will be ratified and, therefore, the Contractor would be paid.
The Contractor proceeds at its own risk if any of the terms of the contract are altered, changed, or modified without the written concurrence by a Contracting Officer.

(d) Inspection/Acceptance. The Contractor shall tender for acceptance only those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. The Government must exercise its postacceptance rights-
(1) Within a reasonable period of time after the defect was discovered or should have been discovered; and
(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.
(e) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence, such as acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.
(f) Termination for the Government's convenience. The Government reserves the right to terminate this contract, or any part hereof, for its sole convenience. In the event of such termination, the Contractor shall immediately stop all work hereunder and shall immediately cause any and all of its suppliers and subcontractors to cease work. Subject to the terms of this contract, the Contractor shall be paid a percentage of the contract price reflecting the percentage of the work performed prior to the notice of termination, plus reasonable charges that the Contractor can demonstrate to the satisfaction of the Government, using its standard record keeping system, have resulted from the termination. The Contractor shall not be required to comply with the cost accounting standards or contract cost principles for this purpose. This paragraph does not give the Government any right to audit the Contractor’s records. The Contractor shall not be paid for any work performed or costs incurred that reasonably could have been avoided.
(g) Termination for cause. The Government may terminate this contract, or any part hereof, for cause in the event of any default by the Contractor, or if the Contractor fails to comply with any contract terms and conditions, or fails to provide the Government, upon request, with adequate assurances of future performance. In the event of termination for cause, the Government shall not be liable to the Contractor for any amount for supplies or services not accepted, and the Contractor shall be liable to the Government for any and all rights and remedies provided by law. If it is determined that the Government improperly terminated this contract for default, such termination shall be deemed a termination for convenience.

Payment request means a bill, voucher, invoice, or request for contract financing payment with associated supporting documentation. The payment request must comply with the requirements identified in FAR 32.905(b), “Content of Invoices” and the applicable Payment clause included in this contract.
(b) Except as provided in paragraph (c) of this clause, the Contractor shall submit payment requests electronically using the Department of Treasury Invoice Processing Platform (IPP) or successor system. (c) The Contractor may submit payment requests using other than IPP only when the Contracting Officer authorizes alternate procedures in writing in accordance with HHS procedures.

The body of each wage determination lists the classifications and wage rates that have been found to be prevailing for the type(s) of construction and geographic area covered by the wage determination. The classifications are listed in alphabetical order under rate identifiers indicating whether the particular rate is a union rate (current union negotiated rate), a survey rate, a weighted union average rate, a state adopted rate, or a supplemental classification rate.
Union Rate Identifiers
A four-letter identifier beginning with characters other than ""SU"", ""UAVG"", ?SA?, or ?SC? denotes that a union rate was prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2024. PLUM is an identifier of the union whose collectively bargained rate prevailed in the survey for this classification, which in this example would be Plumbers.
0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The date, 07/01/2024 in the example, is the effective date of the most current negotiated rate.
Union prevailing wage rates are updated to reflect all changes over time that are reported to WHD in the rates in the collective bargaining agreement (CBA) governing the classification.
Union Average Rate Identifiers
The UAVG identifier indicates that no single rate prevailed for those classifications, but that 100% of the data reported for the classifications reflected union rates. EXAMPLE:
UAVG-OH-0010 01/01/2024. UAVG indicates that the rate is a weighted union average rate. OH indicates the State of Ohio.
The next number, 0010 in the example, is an internal number used in producing the wage determination. The date, 01/01/2024 in the example, indicates the date the wage determination was updated to reflect the most current union average rate.
A UAVG rate will be updated once a year, usually in January, to reflect a weighted average of the current rates in the collective bargaining agreements on which the rate is based.
Survey Rate Identifiers
The ""SU"" identifier indicates that either a single non-union rate prevailed (as defined in 29 CFR 1.2) for this classification in the survey or that the rate was derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As a weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SUFL2022-007 6/27/2024. SU indicates the rate is a single non-union prevailing rate or a weighted average of survey data for that classification. FL indicates the State of Florida. 2022 is the year of the survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. The date, 6/27/2024 in the example, indicates the survey completion date for the classifications and rates under that identifier.
?SU? wage rates typically remain in effect until a new survey is conducted. However, the Wage and Hour Division (WHD) has the discretion to update such rates under 29 CFR 1.6(c)(1).
State Adopted Rate Identifiers
The ""SA"" identifier indicates that the classifications and prevailing wage rates set by a state (or local) government were adopted under 29 C.F.R 1.3(g)-(h). Example: SAME2023-007 01/03/2024. SA reflects that the rates are state adopted. ME refers to the State of Maine. 2023 is the year during which the state completed the survey on which the listed classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination.
The date, 01/03/2024 in the example, reflects the date on which the classifications and rates under the ?SA? identifier took effect under state law in the state from which the rates were adopted.

2) If an initial decision has been issued, then any interested party (those affected by the action) that disagrees with the decision can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7).
