About this file

This document is an Amendment (A0004) to a Request for Proposals (RFP) for a Tribal Injury Prevention Cooperative Agreement Program (TIPCAP) issued by the Indian Health Service (IHS). The amendment updates several sections of the original RFP, including Section L.4.1 (Past Performance), Section L.2 (Proposal Preparation and Submission Instructions), and provides a Questions and Answers (Q&A) document dated October 27, 2025. Key updates include clarifications on past performance submissions, allowing the use of Contractor Performance Assessment Reporting System (CPARS) instead of Past Performance Questionnaires (PPQs), and guidance on using subcontractor or sister subsidiary past performance. The amendment also addresses documentation requirements for Indian Economic Enterprise representation, specifically detailing the proof needed to demonstrate tribal ownership or membership.

The Q&A section covers a range of technical and administrative questions, including contractor staffing requirements, government-furnished property, system access, key personnel definitions, and travel cost restrictions. Notable responses include confirming that the TIPCAP coordinator position applies only to grantees, not the contractor, and that contractors must provide their own computing equipment. The solicitation is set aside for Indian Economic Enterprises, with specific requirements for demonstrating tribal ownership. The current incumbent is the University of Colorado, and the contract maintains restrictions on applying G&A or overhead to travel costs, which will be reimbursed at actual rates according to Federal Travel Regulations.

For Part II – Injury Prevention Program Projects, the tribal project coordinator may be a staff member from a Tribe or Tribal organization.”

Please clarify whether this requirement applies to TIPCAP grantees only, or if the contractor must also provide a program coordinator as part of its proposed staffing.

The TIPCAP coordinator position applies to TIPCAP grantees only.

The contractor does not provide and is not involved in the grantee staffing and they do not need to provide the program coordinators as part of their staffing.

Under C.6. Tasks, Deliverables, and Reporting, X. Other details Contractor Qualifications for a Project Director and Research/Technical Advisor. Can you tell me if these personnel are required to be employed directly by the contract recipient or if they are allowed to subcontract out for these staff person(s)?

10/06/2025

This decision is at the discretion of the Offeror.

However, Offerors are reminded that for service contracts under this ISBEE Set-Aside, the Prime Contractor must ensure that no less than 50 percent of the cost of contract performance incurred for personnel is performed by the Prime and/or “similarly situated entities.”

Accordingly, if these positions are subcontracted, they must be accounted for within the self-performance calculation to ensure compliance with 13 CFR §125.6 and FAR 52.219-14 (Limitations on Subcontracting).

Can the government provide the historical level of effort on the incumbent contract, including, by year, the labor categories utilized, number of hours in each labor category, and any other direct costs included in the budget?

10/15/2025

The Government does not have historical level-of-effort (LOE) data available in a format suitable for release under this solicitation.

Additionally, certain information contained in the incumbent contract may be proprietary to the current contractor and therefore cannot be disclosed under the Federal Acquisition Regulation (FAR) Part 3.104 and FAR 15.201(f).

Offerors are advised to develop their proposed staffing and cost approaches based on their independent assessment of the requirements described in the Performance Work Statement (PWS) and other solicitation documents. Any assumptions made regarding historical workload or level of effort should be clearly identified in the proposal submission.

The Government will not release any additional cost or labor data related to the incumbent contract.

RFP Page 4 / Section B / Table 1: Schedule of Items The RFP indicates in Section B, "Travel-Not-to Exceed (actual cost for all travel will be paid in accordance with the Federal Travel Regulations, and no G&A, overhead, or profit may be applied)," G&A is considered cost and part of cost recovery consistent with Total Cost Input (TCI) accounting systems as defined in and applied consistently per FAR CAS 9904.403, Allocation of Shared Services Expenses to Segments and 9904.410, Allocation of Business Unit General and Administrative Expense to Final Cost Objective. This is considered to be allowable cost recovery under the JTR, FAR, and CAS. Will the government consider changing this section and remove the word “G&A” and leave only Fees?

10/15/2025

The language in Section B of the RFP stating that “no G&A, overhead, or profit may be applied” to travel costs is intentional and reflects the Government’s position on this procurement.

While we acknowledge that G&A can be an allowable indirect cost under CAS and FAR, for the purposes of this solicitation, travel costs will be reimbursed at actual cost in accordance with the Federal Travel Regulations (FTR), and no indirect costs (including G&A) or fee may be applied. This approach is consistent with internal agency policy and cost control measures.

As such, the Government will not revise the clause and will maintain the current restriction on applying G&A to travel.

RFP Page 38 / Section L.4.1 / Factor 4: Past Perforance The Prime’s use of subcontractor past performance is unclear in the RFP response instructions. Excluding subcontractor past performance unnecessarily limits competition, especially since Joint-Venture past performances are explicitly allowed. Will the Government please confirm that:

2)A subcontractor’s past performance will be evaluated equally/with the

RFP Page 38 / Section L.4.1 / Factor 4: Past Perforance Many companies are structured with multiple divisions or multiple legal entities that individually perform Prime Contracts but fall under a broader corporate umbrella.

Recognizing such corporate structures exist across the industry, the procurement rules and numerous GAO decisions have made clear that procuring agencies may evaluate and credit an offeror with the past performance and corporate experience of sister subsidiary companies where the offeror’s proposal demonstrates that the resources of the sister subsidiary (e.g., workforce, management, facilities, or other resources) will be meaningfully contributed to contract performance. See GM–Bulltrack, B- 414591.6 (Comp. Gen. Oct. 30, 2018) (holding that an agency may properly attribute the experience or past performance of a sister subsidiary), and Iyabak Construction, LLC, B-409196 (Comp. Gen. Feb.6, 2014) (holding that the agency failed to articulate a rational basis for solicitation’s refusal to consider experience and past performance of sister subsidiaries).

Would the Government please confirm that the Offeror may cite the prime contract past performance and corporate experience of a sister subsidiary company as prime so long as the Offeror demonstrates how the resources of the sister subsidiary will meaningfully contribute to the performance of the opportunity?

10/27/2025

Required documentation includes evidence that the entity submitting a proposal is owned by tribal person(s) or a tribal entity (reference definition of Indian Economic Enterprise (IEE) provided in HHSAR 326.601). If owned by individual(s), this includes an official document from the owner’s tribe identifying that they are a recognized tribal member, such as a scanned copy of a Tribal Enrollment card or certificate of Degree of Indian Blood Documentation. If the entity is owned by the tribe rather than individual(s), identify the name and ownership percentage of the federally recognized tribe that owns/ controls the entity. Please ensure the documentation has all PII sensitive data redacted.
