Q&A published 4.29.25 (Amd 7) RFP No. 75D301-25-R-73216 World Trade Center Health Program Third-Party Administrator ATT110, Questions and Answers
| Item No. | RFP Page No. | RFP Section No. | Question | Answer |
| 258 | Amendment 0003, page 37 | 4.6.4 Medical Claims Submission and Processing, Explanation of Benefits (EOB) | The fourth bullet states, "Check Number (if check issued)." Should this be Check Number or Electronic Fund Transaction? | EFT number should be reflected. Please see Amendment 7 to the RFP. |
| 259 | Amendment 0003, page 37 | 4.6.4 Medical Claims Submission and Processing, Claims appeals | Section 4.6.4, Claims appeals, last sentence of the Amendment 0002 changes states, "Copies of invalid appeals and resulting communications to the provider on why the appeal is invalid shall be made available to the Program.” How often do the copies of invalid appeals and reasoning to the provider need to be sent to the Program? | Weekly. Please see Amendment 7 to the RFP. |
| 260 | Amendment 0003, page 44 | 4.7.5 Data and Information Exchanges | Added in Amendment 0002, the last paragraph states, "At a minimum, the TPA Contractor shall participate in healthcare EDI transactions for which HHS has adopted a standard, including the X12N 837, X12N 835, X12N 276/277, X12N 270/271, X12N 834, X12N 278, and X12N820." Please provide the intended purpose of the X12N820 referenced, which is Payroll Deducted and Other Group Premium Payment for Insurance Products. | Please see Amendment 7 to the RFP. X12N820 and X12N834 are removed as inapplicable to this Program. |
| 261 | Amendment 003, page44 | 4.7.7 Comprehensive Data Extract | Please provide the intended purpose for the requirement, "8. Reports and all scripts, templates, and data objects used to create the reports; business needs statement showing who requested the report and who signed off on final format and delivery." | This requirement, and all those listed in the Comprehensive Data Extract, are included to permit the Government a full understanding of the data used by the contractor in performance of this contract. |
| 262 | Amendment 0004, page 8 | C.2 Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Products and Commercial Services (JAN 2025)(DEVIATION FEB 2025) (c)(7) | Executive Order 14236 was signed on March 14, 2025 that revokes EO 14026. Please confirm that FAR 52.222-55, Minimum Wages for Contractor Workers Under Executive Order 14026 (Jan 2022) no longer applies to the solicitation. | Because EO 14026 was revoked, it is no longer being enforced by the Department of Labor (see https://www.dol.gov/agencies/whd/government-contracts/sick-leave/faq). We are pending the recission of the regulations implementing EO 14026, including the clause at FAR 52.222-55. While FAR 52.222-55 has yet to be removed from the FAR, offerors should assume that this clause will not apply to this solicitation or any resulting contract. Please see Amendment 7 to the RFP, where we have removed the requirement for offerors to address compliance with FAR 52.222-55 in Part A (Pricing) of Volume 8 (Business volume). |
| 263 | Amendment 0003, pages 98-99; Amendment 0004, page 15 | C.8 HHSAR 352.239-79 Information and Communication Technology Accessibility (FEB 2024) (DEVIATION) | Amendment 0003 changed HHSAR clause from 352.339-74 to 352.339-79 (and was included in Amendment 0004). We are unable to locate HHSAR 352.339-79 on acquisition.gov or the HHS website under HHS Acquisition regulations. Please provide further guidance. | A number of the HHSAR provisions/clauses added or modified in Amendments 3 and 4 are not yet codified in the HHSAR yet and therefore don't appear online. These provisions and clauses were issued by HHS as a class deviation to the HHSAR to implement new policies in advance of the rulemaking process that is needed to make these changes to the HHSAR. Therefore, they don’t appear in the HHSAR currently. Please only reference the provisions and clauses in the solicitation, as those govern the solicitation. |
| 264 | Amendment 0004, pages 26 - 55 | C.27 through C.36 | We are unable to locate the agency specific HHSAR clauses added in Amendment 4 in the HHS supplement to the FAR. Please provide further guidance. | Please see the answer to question 263. |
| 265 | Amendment 0003, Attachment page 2 | ATT111_TPA_CorporateExperienceQuestionnaire+(v3+revised+04.08.25) | Instructions allow the inclusion of a contract list index limited to six specific elements but does not permit adding the name of the contractor or contractor role/description for each contract. In order for the index to provide a more complete picture of each corporate experience, would the government please expand the elements to include 1.) "Contractor Name", and 2.) "Described Role" to reflect each contractor's TPA role, such as offeror, affiliated company, or planned subcontractor? | Yes - please see Amendment 7 to the RFP. |
| 266 | Amendment 0003, Attachment page 7 | ATT111_TPA_CorporateExperienceQuestionnaire+(v3+revised+04.08.25) | Question 5 asks offerors to describe "…experience using industry-leading analytics platforms…" The instructions on page 2 also state that responses to questions should "…include concrete details from past contracts to clearly illustrate how your company and/or other entities have the corporate experience in the relevant area." In order to make the responses clearer, more concise, and less cluttered, would the government allow offerors to forego associating specific contracts for each example and list the analytic platforms in which they have experience? | Yes, this is acceptable. Offerors are encouraged to just not list analytic platforms but ensure their responses express how they used the platforms. We are interested in understanding the context for the platforms' use in healthcare services and their impact. However, it is not necessary to associate the platforms with specific contracts. Note that this exception to the instructions for the Corporate Experience Questionnaire apply only to Question 5. |
| 267 | CLIN-Level Summary Tab, All Option Period Tabs | ATT107_TPA_PricingTemplate (v2, revised 03.18.25).xlsx | We have noticed a variance/discrepancy with the way that the CLIN-Level Extended Price (Column H) is being calculated in the CLIN-level Summary tab versus the way that the Total Option Period CLIN total (Row 40) is being calculated in all of the Option Period tabs. In particular, the CLIN-level Summary tab rounds the Unit Price to 2 decimals but the Option Period tabs do not round the Unit Price. The result is the total by CLIN is different between the Option Period tabs versus what is shown on the CLIN-Level Summary tab. | In the Option Period tabs, the total of the labor and other direct costs tables drive the total in row 40. This total is then divided by the quantity (row 41) to produce a unit price (row 42). In the CLIN-Level Summary tab, the unit price from the associated Option Period tab is brought over and rounded to the nearest whole cent (column G). That rounded unit price is then multiplied by the quantity (column E) to produce the extended price (column H). To the extent that the unit price in the Option Period tabs contained a fractional cent, the CLIN total price in the Option Period tabs and the CLIN-Level Summary tab will be slightly different. This was done as our contract writing software does not accept fractional cents in a unit price. If this rounding distorts an offeror's price from what was intended, the offeror may adjust the price of the inputs in the labor and other direct costs tables to achieve the desired unit price (or vice versa). The unit price and extended price shown on the CLIN-Level Summary tab is what will be used to price any resulting contract from this solicitation. |
| 268 | 150 | 10.12.2 | The PWS states, "Assess the system security and privacy controls (or ensure an assessment of the controls is conducted) at least annually to determine the implemented security and privacy controls are operating as intended and producing the desired results (this may involve penetration testing conducted by the agency or independent third-party). " |
Is the TPA responsible for procuring a third party for annual security assessments and penetration testing as part of the program requirements or will this be managed by the government? Note: This was originally question 209, published 3/18/25 with Amendment 2. It was not answered at that time but is being answered now.
The specific auditing pathway will be dependent on the vendor solution; a 3PAO may or may not be required. However, for purposes of the proposal, the offeror should assume that the offeror is responsible for contracting with and paying for a 3PAO assessment on all vendor system(s). If the vendor has an existing FedRAMP auth, 3PAO test results may already be available that may be able to be used.
| 269 | How should Offerors handle inconsistencies between the Program Administrative Manual, other Program materials, and the PWS? | Please see Amendment 7 to the RFP. The TPA PWS controls and supersedes if inconsistent with the Administrative Manual or other Program materials. The Program is working to update the Administrative Manual and other Program materials to ensure they are consistent by the start of TPA Contract performance. | ||
| 270 | ATT002 | ATT002 indicates the TPA is responsible for appointment scheduling. Is this accurate? | Please see Amendment 7 to the RFP. The TPA will not be responsible for appointment scheduling. | |
| 271 | What is the role of the National Program Administrator and how does it differ from the current Nationwide Provider Network contract? | The National Program Administrator is the successor to the Nationwide Provider Network contract, renamed as the Nationwide Provider Network itself is shifting to be a requirement for the TPA. The NPA will, at a high level, serve as a member concierge service for members living outside of the NY metropolitan area. The TPA's interactions with the NPA for members outside of NYMA will be akin to the TPA's interactions with the CCEs for members within NYMA. See updated Attachment ATT002, Contractor Delineation, for more. | ||
| 272 | ATT101 - Summary Volume Data | Enrollment Tab | Can the Government confirm that the current percentage of suspended applications in 2024 is at 98% and only 2% of incoming applications are complete? | The numbers provided in the Summary Volume data are correct, but have been moved into a new table in the updated Attachment ATT101, Summary Volume Data, to better show that the volume of suspended applications (and appeals) being reported includes all applications suspended (or appealed) during the year, including on applications submitted in previous years. The large increase in suspended applications in 2024 is due to resource changes increasing review rates overall of older submissions. |
Program data analysis shows that approximately 45% of all incoming applications are "ever suspended" (suspended at least one time between application receipt through decision). For purposes of this solicitation, Offerors should assume that incoming applications will continue to be suspended at this rate.
273 ATT101 - Summary Volume Data Network Adequacy Tab The NYMA provider tab sums up to a total of 79,451 providers. Section 4.4.1 refers to a volume of 105,500 NYMA providers that need to be adopted into the network. Which value should offerors use as a basis for this function during transition-in? The 105,000 reflects the total number of providers within the EPN, including EPN providers located outside of the NY metropolitan area, while the 80,000 includes only those providers within the EPN that are located within the NY metropolitan area. This discrepancy is due to the current definition of the EPN to include all providers serving CCE members. As the EPN and NPN are consolidated under the TPA, which network a provider is in (EPN vs NPN) will be defined by geographic location. For transition-in, offerors should consider the list of 80,000 as a reasonable approximation of current EPN providers who may qualify to be in the future EPN.
Please also note that requirements have been updated to only require re-affiliation for providers who have had a claim approved within the past 5 years in Amendment 7 to the RFP and the newly provided Attachment ATT118, TPA Network FAQs. The TPA may want to reference the full list to identify potential providers for recruitment to meet network adequacy requirements. The Government is also assessing whether additional data (e.g., rendering provider names and NPIs) can be provided prior to award.
| 274 | ATT008 - Transactional Comm Responsibilities | How are CARE letters produced and transmitted for mailing? Do letter batches include sequencing and page counts to facilitate automation? | CARE-generated letters are produced daily in batches based on the applicable letter template and language (e.g., English 30-day Suspend Letter, Spanish Inactive Letter). Batches do not include sequencing or page counts at this time; offerors should take this limitation for CARE-generated letters into account. Vendors may include sequencing, page counts, or other features to letters to facilitate automation for vendor-generated letters. | |
| 275 | ATT024 - Credentialing | Does the credential review committee required in TGD 032 need to separate and dedicated to the WTC Health Program? | No, though the credential review committee must ensure that WTC Health Program credentialing criteria is verified. | |
| 276 | ATT024 - Credentialing | What is the required timeline for "expedited" credentialing, as required in TGD 032? | An expedited credentialing process should target completion of credentialing verification within 30-45 days. | |
| 277 | ATT024 - Credentialing | Is direct credentialing of network providers required, or would usage of a shared credentialing program be acceptable? | A shared credentialing program would be acceptable for use, as long as Program requirements (as described in TGD 032) are met. | |
| 278 | Amendment 007, 110 | 4.5.1 | What are the TPA's responsibilities as it relates to the current WTC-5 process? | The Medical Code Change process, which involves the use of the WTC-5 form, serves as the mechanism through which CCEs/NPA may request the inclusion of specific diagnoses, procedures, or medical products in the WTC Health Program Codebooks. Currently, these WTC-5 forms are submitted to HPS team via email, where they are processed before being forwarded to the Program for final decision-making. The responsibilities of the TPA will closely mirror those of the HPS team, as the TPA will independently recommend coverage updates based on the WTC-5 submissions and will also be responsible for informing the CCEs/NPA of the Program's final approval and implementation of any changes. |
| 279 | Amendment 007, page 229 | E.3 - Instructions to Offerors, Volume 8, Business Volume | Is it acceptable for offerors to leave the unburdened subcontractor labor rates column blank in the pricing template (i.e., not filled out) if a subcontractor is sending that information directly to the Government under separate cover? | Yes, offerors are to leave the unburdened rate column blank when that information is being submitted separately by proposed subcontractors. Please see Amendment 7 to the RFP. |
| 280 | Pages 118-119 | 4.7.3 | What is the estimated frequency of ad hoc information requests/data reports? | Approximately 8 per year. |
| 281 | Amendment 007, page 110 | 4.5.2 - Utilization Management (Prior Authorization) | What is the role of the TPA Contractor's system as it pertains to housing approval/rejection determinations for PA2s and PA3s? | The CCE/NPA clinical director (or designee) will record in the TPA’s system whether that PA2/PA3 was approved or rejected (with the PA3 requiring further Program approval). The TPA Contractor's system is not just where that information is housed but where it is actually being recorded directly by the CCE/NPA clinical director (or designee). Please see Amendment 7 to the RFP. |
| 282 | Amendment 007, page 111 | 4.5.2 | Is an accredited Population Health program applicable to this PWS? | Please see Amendment 7 to the RFP. This accreditation requirement has been removed. |
| 283 | Amendment 007, page 110 | 4.5 | What is the Program looking for regarding modernization of medical benefits administration? | Initially, the TPA Contractor should maintain the status quo as it relates to interactions with other Program contractors to minimize risk during and immediately following the Transition-In Period. However, the Program is open to and seeks out modernization for other processes early in the contract, especially those areas and processes that are firmly within the TPA Contractor's domain. |
| 284 | E.3 - Instructions to Offerors | Can the Government provide guidelines as to the level of effort that is expected for CLINs xx09, Data and information exchanges, integrity, and governance? Can the Government provide a ceiling or plug value for this CLIN? | We appreciate that estimating level of effort for this CLIN is more challenging than other aspects of the PWS. Given the potential for different approaches to this task, it is difficult for the Government to provide a ceiling or plug value to standardize these costs among offerors. The Government has provided information as to the required data exchanges in Attachment ATT101; to the extent offerors need further information to develop estimates, the Government can address those questions to the best of its ability. The Government can additionally provide the following: |
The current environment includes the following, but is subject to change based on the awardee's technical approach and the scope of the TPA contract being wider than the incumbent HPS contract:
| • | 25+ different transfer methods | ||||
| • | 250+ different transfers | ||||
| • | 40+ different data formats | ||||
| • | 20+ different partners | ||||
| 285 | E.3 - Instructions to Offerors | Can the proposal instructions be revised to include a space for offerors to address their overall technical solution? | Please address your technical solution/approach within the current structure of technical volumes. The Government is using subject-matter-specific evaluators to evaluate the different technical volumes, and we do not intend to evaluate a separate, standalone volume for the entire technical solution. To the extent that offerors need to reference or discuss how various aspects of their technical solution interact with one another across volumes, offerors may incorporate by reference material from one technical volume (i.e., Volumes 1-7 and Volume 10) into another technical volume, and we have added language to the Volume 2 proposal instructions to require offerors to address how they will manage the overall integration of the PWS Functional Areas. Please see Amendment 7 to the RFP. | ||
| 286 | Amendment 007, 87 | 4.1.2 | Will the TPA be permitted to begin provider outreach, leveraging their provider management system shortly after contract award, even if/though the system likely will not receive an ATO until later in the transition-in process? | Usage of the provider management system prior to receiving an ATO is at the offeror's discretion. However, please note that the Government will only be providing the TPA with de-identified data or data authorized to be shared publicly prior to system authorization. |
The vendor will not be provided WTCHP data (as defined in Attachment ATT017) until an ATO is achieved. The vendor will be provided a de-identified data set for testing. If the vendor has work that needs to be accomplished without the WTCHP-provided data, then that can move forward.
| 287 | Amendment 007, 122 | 4.7.5 | Where contractor systems have different data structures, which Program contractor is responsible for ETL when that data needs to be shared between contractors? | The TPA Contractor will be responsible for performing the ETL to load the data from the trading partners into the TPA's new system. There may be opportunities for the data exchange partner to match the TPA's data structure, but the TPA has responsibility for performing ETL where the structures are not the same. |
| 288 | Amendment 007, 122 | 4.7.5 | How often does the TPA receive a list of CCE providers (sometimes referred to as “internal providers”) from the CCEs? | The CCEs provide a list of CCE providers on an ad hoc basis to the TPA for loading into the TPA's claims adjudication system so that services performed by CCE providers can be adjudicated and reimbursed appropriately. In calendar year 2024, there were 15 instances of a CCE provider registration request being pushed from the CCEs to the TPA. Please note that this question was incorrectly answered during discovery sessions as weekly. It is not weekly, but rather on an ad hoc basis. |
| 289 | Amendment 007, 112 | 4.6 | What happens if a member seeks care without the CCE/NPA scheduling or otherwise having visibility on the care being sought? As the Program doesn't have referrals, how would the TPA, e.g., handle a claim received for specialized services rendered to a member but for which the CCE/NPA did not evaluate for medical necessity or otherwise coordinate? | Answer pending from Government. |
| 290 | Amendment 007, 111-112 | 4.5.2 | Can you clarify the TPA's role in concurrent review? What is the CCE/NPA role in concurrent review? | The TPA Contractor is responsible for performing concurrent review, to include obtaining clinical documentation for review and determining medical necessity. The CCE/NPA has no formal role in concurrent review; however, if the CCE/NPA becomes aware of an inpatient stay, the CCE/NPA is expected to notify the TPA for the TPA to initiate concurrent review. The TPA is also responsible for notifying the CCE/NPA if/as the TPA becomes aware of an inpatient stay so that the CCE/NPA can prepare for post-discharge case management. |
Q&A published 4.8.25 (Amd 4) RFP No. 75D301-25-R-73216 World Trade Center Health Program Third-Party Administrator ATT110, Questions and Answers
| Item No. | RFP Page No. | RFP Section No. | Question | Answer |
| 257 | All Pages | ATT111_TPA_CorporateExperienceQuestionnaire.pdf | In the narrative fields for all questions, the field itself appears to be locked down to only allow full-sized text. So that the newly-allowed contract list index can be properly referenced, will CDC change the form to allow for superscript text? We understand that superscript text still counts towards the character count in each answer. | The narrative text fields for each question have been modified to allow rich text formatting. Offerors may apply bold, italic, underline, superscript, or subscript formatting. Offerors shall not modify the text size or font face, or any other aspect of the text formatting. Text in superscript or subscript will count towards the total character limit. These instructions have been added to Attachment ATT111. Please see Amendment 4 to the RFP. |
Q&A published 4.1.25 (Amd 3) RFP No. 75D301-25-R-73216 World Trade Center Health Program Third-Party Administrator ATT110, Questions and Answers
| Item No. | RFP Page No. | RFP Section No. | Question | Answer | |
| 238 | n/a | 4.4 | CDC issued sevreal WTC related RFI's in 2024 including : | ||
| 75D301-24-RFI-541690 titled PROVIDER NETWORK DATA INTEGRITY REVIEW. Can you clarify if a separate RFP will be issued for the Provider Network Data Integrity scope or is it included in the TPA scope under Section 4.4? | The TPA solicitation includes provider network integrity tasks, namely under Section 4.4 (Provider Network Management) and 4.2.7 (Quality Assurance). A separate requirement for a provider network data integrity review, as described in the referenced RFI, has not been solicited to date. | ||||
| 239 | n/a | n/a | CDC issued sevreal WTC related RFI's in 2024 including : | ||
| 75D301-24-RFI-541611 titled HEALTH PROGRAM EVALUATION FOR THE WORLD TRADE CENTER HEALTH PROGRAM. Can you clarify if a separate RFP will be issued for the Health Program Evaluation scope? | The Health Program Evaluation is a separate requirement. A task order for this requirement was awarded in February 2025 under task order no. 75D30125F20454. | ||||
| 240 | General | Please confirm if the government anticipates any impact to the proposal due date of April 11th given communication delays impacting the pre-solicitation session and the release of attachments. | Please see the revised timeline in Amendments 2 and 3 to the RFP. | ||
| 241 | ATT108 | HHS Subcontracting Plan Template | Can the government please clarify that the goals within ATT108 HHS Subcontracting Plan have been updated to reflect FY25? | The 2025 agency small business subcontracting goals have been updated to FY25 in Attachment ATT108. Please see Amendment 2 to the RFP. | |
| 242 | 6 | Section B | Would the government consider including Dual Operations during OY1 as a separate CLIN? This structure would keep it consistent with the CLIN structure during Transition-Out Dual Operations. Dual Operations in OY1 will require additional activities during the 30 days such as data exchanges and quality related resources. | We acknowledge that the Dual Operations phase following the Transition-In Period will require a higher level of effort on the part of the TPA Contractor for some activities, including additional data exchanges with the outgoing HPS Contractor and NPN Contractor, both of which will be performing claims runout during this 30-day period. We have established the Data and information exchanges, integrity, and governance CLIN (CLIN 1009) on a time-and-materials basis, which will provide flexibility for variations in the level of effort required during this phase. |
We opted not to place the Dual Operations phase following the Transition-In Period into its own CLIN because the TPA Contractor will be performing the full scope of services during this Dual Operations phase (unlike the Transition-Out Dual Operations Period, where the TPA Contractor will be performing claims runout activities only). To the extent that offerors’ project a higher level of effort will be required in Option Period 1 owing to the Dual Operations phase following the Transition-In Period, this can be incorporated into offerors’ proposals.
243 6 Section B Can the government provide clarity around the factors driving Time & Materials pricing for CLINx009 Data and Information Exchanges, Integrity, and Governance throughout the life of the contract? This CLIN is priced on a time-and-materials basis for the duration of the Contract for the following reasons:
• During transition-in, the level of effort required to integrate a new TPA contractor into the existing data ecosystem and infrastructure of the Program is not able to be estimated with sufficient accuracy to use a firm-fixed-price contract type because of the highly technical nature of this work, the number of stakeholders, and the sensitive health information being exchanged (and the regulations that must be followed related to it).
• The new TPA contractor will be required to extract, migrate, convert, transform, and load a large amount of data that is not uniformly maintained or structured. The level of effort to perform these complex tasks is similarly not able to be estimated at contract award with sufficient accuracy to use a firm-fixed-price contract type, as the new TPA Contractor would not have clear visibility into all of the Program data and where and how it is stored until after the Transition-In Period begins.
• Even after the Transition-In Period, future changes to the Program (including new or changing other Program contractors) may require additional data exchanges and data integrity and governance work not presently planned.
As with the other time-and-material CLINs in this solicitation, this CLIN may be converted to a firm-fixed-price CLIN through mutual written agreement of the TPA Contractor and the Government after performance begins.
| 244 | 6 | Section B | Would the government consider releasing anticipated PA3 volume, so vendors can accurately size the operations team for CLINx006? | Historical PA3 volume is provided in Attachment ATT101, Summary Volume Data. We do not anticipate substantial increases in future PA3 volume relative to this historical volume. |
| 245 | 6 / 103 | Section B/PWS 4.4 | CLINx004 Provider Network Management is currently designated as a Firm-Fixed Price (FFP) during sustainment. Under this CLIN, the Third-Party Administrator (TPA) is responsible for managing both the External Provider Network (EPN) and the National Provider Network (NPN). |
Since pricing for this CLIN may vary based on the number of providers added to the NPN, bidders may propose varying provider volumes, resulting in inconsistent bid pricing. This variation could pose challenges for WTCHP in ensuring a fair price comparison among bidders. Would the government consider either?
| 1. | Publish a capped NPN provider volume with a defined range that guarantees adequate coverage for WTCHP members while maintaining pricing consistency across proposals Or |
| 2. | Publish current NPN network data in advance, including provider volumes by specialty and ZIP code, to ensure bidders can align their pricing with actual program needs. |
| Implementing these measures will help standardize CLIN pricing and facilitate transparent price evaluations | Please reference the Network Adequacy and NPN tabs in Attachment ATT101, Summary Volume Data. We have provided the breakdown of members and their needs, as well as information on providers, by zip code. Please also reference the answer to question #152 in this document. | ||||
| 246 | 103 | PWS 4.4 | Prior to our review of the QASP, will the government share the factors associated with the definition of provider adequacy? | Please reference the answers to questions #33 and #91 in this document, and the QASP in Attachment ATT003. | |
| 247 | 103 | PWS 4.4 | Which providers will be included in the NPN provider list upon award? Will the list include providers utilized since the inception of the Program or will it only include providers used by the current Contractor? | We will provide a list of NPN providers who have rendered services since the inception of the Program. | |
| 248 | 103 | PWS 4.4 | What data elements will be included in the NPN provider list to be released? For example, will the provider list include complete demographic information associated with the provider, Medicare number, NPI, etc.? | We intend to furnish all information we have for NPN providers. Of note, we do not have EFT information for all NPN providers. | |
| 249 | 103 | PWS 4.4 | Will mid-level reductions be taken when determining reimbursement for mental and behavioral health providers? We are defining mid-level as non-physician practitioners who are health care providers who assess, diagnose, and treat patients but do not have formal education or certification as a physician. | No, mid-level reductions are not taken when determining reimbursement for mental and behavioral health providers. | |
| 250 | Pg 1 | ATT112_TPA_PastPerformanceAuthForm.pdf | In this form, both "Company Name" fields are coded the same in the form so that when you fill out one company name field, the second one auto-populates. This does not work for cited jobs of a subcontractor --- in this situation the first "company name" field needs to be the name of the Prime Offeror and the second "company name" field is the subcontracting company. This explained, the form needs to be fixed. Can Offerors make slight tweaks themselves or will NIOSH issue a modified ATT112 form? | The “company name” filed in Attachment ATT112 is designed to be coded to the same value. The first instance of “company name” can refer both to: |
• The proposed prime contractor: “[Company name] is submitting a proposal to the Centers for Disease Control and Prevention (CDC) to serve as the prime contractor on the World Trade Center Health Program Third-Party Administrator contract…” (emphasis added)
• and a proposed subcontractor: “or is part of another firm’s proposal to serve as a subcontractor on this contract” (emphasis added).
If the form is being used by a proposed subcontractor to send to its past performance reference(s), the first instance of “company name” will properly identify it as a proposed subcontractor as part of another firm’s proposal.

Please see Amendment 3 to the RFP. |
| 253 | Pg 206 | 75D301-25-R-73216.pdf (E3.i.1.ii) | Volume 2 combines detailed requirements across Contract Management, Regulatory Compliance, and Transition-Out disciplines. As a result, providing a response in only 20 pages will not allow offerors to sufficiently address the requirements, even considering offerors' ability to refer to specific portions of other technical volumes. We respectfully request a 30 page limit in Volume 2 so that we can adequately address requirements. | The page limit for Volume 2 has been increased to 30 pages; please see Amendment 3 to the RFP. |
| 254 | Pg 212 | 75D301-25-R-73216.pdf (E3.i.1.viii) | For information after the cover page on ad hoc all-member and targeted letters, is the information to be printed on a single side or both sides per page? | Please assume printing on both sides of each page. An additional cover page is not required but may be used for addressing purposes. Please see Amendment 3 to the RFP. |
| 255 | Several Tabs | ATT107_TPA_PricingTemplate.xlsx | In several tabs in the pricing spreadsheet, the Government asks for "Unburdened Rate". For employees of the prime contractor – does the unburdened rate represent the proposed LCAT hourly salary (in the base year), or does it also include fringe? If so, please acknowledge in the affirmative or provide a definition of what unburdened rate is for employees of the prime contractor. | For employees of the proposed prime contractor and any proposed subcontractors, the unburdened rate is the employee’s direct, gross wage. The unburdened rate does not include fringe benefits, overhead, general and administrative expenses, or profit. |
| 256 | Several Tabs | ATT107_TPA_PricingTemplate.xlsx | In several tabs in the pricing spreadsheet, the Government asks for "Unburdened Rate". When integrating labor costs for employees of subcontracting partners in the prime contractror's pricing spreadsheet – does the unburdened rate represent the fully burdened rate (in the base year) that the subcontractor charges the prime (before the prime applies any additional burdens/fee)? If so, please acknowledge in the affirmative or provide a definition of what unburdened rate is for employees of a subcontracting partner. | The unburdened rate is defined the same for both the proposed prime contractor and any proposed subcontractors: the employee’s direct, gross wage. The unburdened rate does not include fringe benefits, overhead, general and administrative expenses, or profit. |
The unburdened rate provided for proposed subcontractor employees in an offeror’s proposal shall be the employees’ direct, gross wages, and not the rate that the subcontractor charges the prime, to the extent that the subcontractor burdens its unburdened labor rates with fringe, indirect costs, and/or profit in the rate that it charges to the prime.
Q&A published 3.18.25 (Amd 2) RFP No. 75D301-25-R-73216 World Trade Center Health Program Third-Party Administrator ATT110, Questions and Answers
| Item No. | RFP Page No. | RFP Section No. | Question | Answer |
| 148 | 100 | 4.3.8 | PWS Section 4.3.8 references that "Call center representatives shall be knowledgeable about the Program, have taken all required Program trainings, and have access to systems, resources, and scripting to resolve both administrative and clinical inquiries." For calls received by the call center, what do clinical inquiries include? Could the government provide more detail in terms of what clinical inquiries are required to be handled by the call center representatives versus escalated to a clinician? | |
| Clinical inquiries pertain to a member's medical screening or treatment, such as questions about prior authorizations, inpatient stays, or medical policy. There are no stated requirements for when a clinical inquiry should be escalated by the call center representative to a clinician; offerors should propose their approach for managing this escalation. | ||||
| 149 | 100 | 4.3.8 | Does the government have Average Handle Times (AHTs) for the topic areas reflected in Table 2 of Section 4.3.8 of the PWS they could share? | |
| Not at this time; however average handle times by month have been provided. Please see the new data added to Attachment ATT101, Summary Volume Data, in Amendment 2 to the RFP. | ||||
| 150 | 102 | 4.4.1 | EPN Contracting: The RFP requires the TPA Contractor to reaffiliate with the existing NYMA External Provider Network (EPN) on behalf of the Program, using the Program’s Terms & Conditions. However, the definition of re-affiliation is not provided, and the RFP does not clearly state whether the privity of contract is a.) between the TPA Contractor and EPN providers, or b.) existing agreements between the Program and EPN providers will remain in place. Additionally, PWS Section 4.4.1 states that the TPA Contractor must administer provider agreements on behalf of the Program, but it is unclear what contractual provisions exist that require EPN providers to reaffiliate with the new TPA Contractor. |
1. Does the government intend for the TPA Contractor to hold direct contractual agreements with EPN providers, or will existing agreements between the Program and EPN providers remain in place?
2. If the existing agreements remain between the Program and EPN providers, what contractual provisions require EPN providers to reaffiliate with the TPA Contractor?
3. Providers are required to undergo credentialing through the TPA Contractor. If credentialing is required through the TPA Contractor, does this apply to all EPN providers regardless of prior credentialing status? Further, what contractual provisions require EPN providers to align to TPA contracts, including credentialing requirements?
4. What are the responsibilities of the Third-Party Administrator (TPA) if a provider within the External Provider Network (EPN) decides to withdraw from participation during the re-affiliation period? 1. Yes. TPA Contactor will enter into agreements directly with EPN and NPN providers. The agreements shall include the Program Terms and Conditions (Attachment ATT016).
2. There is no explicit requirement for current EPN providers to reaffiliate with the new TPA Contractor, but the TPA Contractor shall make a good faith effort to re-affiliate with all existing EPN providers. It is expected that some providers may drop off during the transition-in period. This period should be used to refamiliarize continuing providers with the Program and updated Terms & Conditions.
3. The WTCHP mandates that providers must be credentialed upon initial enrollment. Recredentialing is required every three years for providers to remain part of the TPA. For instance, if a provider was credentialed in December 2023, they must be recredentialed by December 2026, regardless of which entity assumes TPA responsibilities. This policy ensures that all providers consistently meet the necessary standards and requirements without imposing more frequent credentialing than the standard timeframe.
4. If a provider within the EPN decides to withdraw during the re-affiliation period, the TPA Contractor's responsibilities include notifying the Program, managing the transition of patients to other providers, and ensuring continuity of care. The TPA Contractor would be expected to fill any gaps in the network over time consistent with the network adequacy standards in the QASP found in Attachment ATT003.
Please see changes to Section 4.4.1 in Amendment 2 to the RFP.
151 103 4.4.2 NPN Contracting: The RFP requires the TPA Contractor to develop and maintain a Nationwide Provider Network (NPN) that ensures adequate and efficient care for members residing outside the NYMA. Section 4.4.2 indicates that “the TPA contractor shall establish provider agreements on behalf of the Program, utilizing the Program’s Terms and Conditions.” It is unclear whether the privity of contract will be between the TPA Contractor and NPN providers.
1. Can the government confirm that the requirement is for the TPA Contractor to hold direct contractual agreements with NPN providers, rather than the government holding agreements between the Program and NPN providers, with the TPA acting as an agent of the Program?
2. If agreements are between the Program and NPN providers, what contractual provisions are in place to ensure NPN providers engage with the TPA Contractor for contract requirements such as credentialing and training?
1. Yes, the TPA Contractor shall hold direct contractual agreements with NPN providers. The TPA Contractor will have privity of contract with NPN providers. The Government will not have privity of contract with NPN providers.
2. This question is inapplicable per the answer to question 1.
152 102 4.4.1 Existing NPN and EPN Provider Information: To facilitate the transition and ensure network adequacy, will the government provide a comprehensive list of current NPN and EPN providers, including:
- Provider name
- Specialty
- Practice location (full address) (ZIP code)
- Practice Phone Number
- Practice Email, if possible
- National Provider Identifier (NPI)
- Provider Tax ID?
If a full provider list cannot be provided due to contractual or confidentiality limitations, can the government provide de-identified aggregated data on provider distribution by specialty and zip code?
| The full provider list for the EPN will be provided after award; the full list of NPN providers who have submitted claims since the start of the Program will also be provided upon award. The Summary Volume Data already provides information on NYMA provider distribution on the "Network Adequacy" tab, and we have added NPN provider distribution on the "NPN" tab. Please see the new data added to Attachment ATT101, Summary Volume Data, in Amendment 2 to the RFP. | |||
| 153 | 111 | 4.6.2 | Fee Schedule for Provider Contracts: The RFP references that “the Program’s fee schedule(s) generally reference established FECA and/or Medicare rates; however, the Program will provide the TPA Contractor with all current and applicable Fee Schedules.” |
1. Can the government provide the actual fee schedule that must be incorporated into provider contracts, including reimbursement rates by CPT code and specialty?
2. If the government cannot provide an exact fee schedule, what methodology should bidders use to set provider reimbursement rates?
3. Will the government provide a hierarchy of reimbursement? Example: If the code is present on FECA, then it will be reimbursed at FECA. If not present on FECA, it falls to CMS, if not present on CMS, does the government have an additional Fee Schedule or would this fall to billed charges?
4. Will the government provide whether or not there are current providers on fee schedule exceptions?
1. The WTC Health Program fee schedule is updated quarterly; incorporating a static fee schedule into provider contracts would not be appropriate. Please find the current WTC Health Program fee schedule in Attachment ATT028, WTCHP Fee Schedule, in Amendment 2 to the RFP. The WTC Health Program fee schedule is updated quarterly.
2. See response to question 1. Furthermore, please note that provider reimbursement rates are exclusively set by the Program.
3. The Program generally uses OWCP (FECA). If the code is not present, CMS and/or other federal payers' fee schedules are referenced as a benchmark. Any unpriced codes would need to be escalated to the Program for the Program to set the appropriate rate(s).
4. There are a very limited number of providers on a fee schedule exception--for the most part, designated cancer hospitals and a couple of other facilities that we have agreed to pay at cost-to-charge ratio instead of DRG pricing. In rare cases (<10 currently), the Program has also authorized temporary exceptions to ensure continuity of care for members in active treatment.
| 154 | 107 | 4.4.6 | Claims Data to Support Network Adequacy Assessments: The RFP requires the TPA Contractor to ensure network adequacy. To assess the feasibility of meeting these requirements, will the government provide claims/utilization volume data to reflect claims or encounter volume by specialty, by provider type, by place of service (POS code), by zip code. We request that this summary data is provided for each of the past 3 years. |
| Please see the new data added to Attachment ATT101, Summary Volume Data, in Amendment 2 to the RFP. All available data has been provided. | |||
| 155 | 117 | 4.7.2 | Section 4.7.2 of the PWS notes that "Network providers shall be able to communicate directly with the TPA Contractor (e.g., secure chat, messaging, feedback mechanism); view the member profile and relevant clinical history for assigned patients; view claims and prior authorization decision statuses; upload medical records and claims; access a reference library of Program policies, coverage guidelines, training materials, and forms; and submit prior authorizations and associated documentation verifying that criteria have been met." |
Will the government please clarify specific requirements for:
1. Are there particular types of clinical data that should be excluded to protect Member privacy or comply with regulatory standards?
2. What is the criteria or process for determining information to be relevant in the member profile?
3. Which specific categories or types of clinical information could be considered relevant for providers within the portal? Can the government provide examples or use cases that illustrate the types of clinical information deemed relevant versus those that are not, to help guide our implementation strategy?
| The TPA Contractor shall adhere to the minimum necessary standard under the HIPAA Privacy Rule. Member clinical data shall only be disclosed to providers for the purposes of providing healthcare services, facilitating payment-related activities, and supporting essential healthcare operations. Please see the changes to Section 4.7.2 in Amendment 2 to the RFP. | |||
| 156 | 10.1 | To meet the security requirements that relate to intermingled data, for on-prem environments, will the government confirm that a logically isolated environment meets this requirement? | |
| Yes, a logically isolated environment would meet this requirement. However, the CDC reserves the right to perform a final assessment of the system once all security documentation is submitted. | |||
| 157 | 146 | 10.5 | PWS Section 10.5 indicates that "All contractors with routine access to PII requires both a valid need to know and requires a Tier 2S background investigation to ensure the individual being provided access is suitable. These requirements extend to developers of information systems containing PII and PHI." Will the government please provide details for how are tier 2s requirements defined? |
| Position Sensitivity Level 5 (Moderate Risk Public Trust) are positions with duties of considerable importance to the HHS or program mission that have potential for moderate to serious impact AND positions with potential for exceptionally serious impact involving duties especially critical to HHS. Investigation requires fingerprints, subject interview, a credit bureau check, completion of the Standard Form 85P through the e-QIP system, an investigation that includes the last 7 years of where the person has lived, worked, or attended school. |
This investigation does not result in a national security clearance.
| 158 | ATT107 | TPA Pricing Template | As there is a direct labor section related to travel, is the expectation for bidders to propose the annual direct labor costs related to travel? This will need to be an estimate since travel dates, times will be unknown at time of submission. | |
| The pricing template has been revised to remove the labor section for travel. All labor should be allocated to tasks underneath the respective CLIN. Travel costs are to include only other direct costs (e.g., airfare, transportation expenses, per diem, hotel) and now only for the Base/Transition-In Period (reference the answer to question 160). See Amendment 2 to the RFP. | ||||
| 159 | 195 | Volume 8: Business volume | Should bidders round hours and/or labor rates to the nearest cent ? | Hours and labor rates shall be entered to two decimal places. The pricing template (Attachment ATT107) has been updated to include data validation to enforce this format. See Amendment 2 to the RFP. |
| 160 | 196 | Volume 8: Business volume | The RFP states "and costs estimated for travel (e.g., airfare, transportation, hotel, meals and incidental expenses)"..are bidders required to price and display each cost element of travel? As costs can vary up until the time of travel and the Government would approve all travel is this level of detail required? Also, the long-term travel prices (i.e. OP 4 and beyond) are unknown and will be based upon CY 2025 estimates. |
