Section M - Evaluation Factors for Award
Miscellaneous text in this section has been modified to:
FA557522R00020001
SECTION M - EVALUATION FACTORS FOR AWARD
A. Basis for Contract Award: This is a Lowest Price Technically Acceptable (LPTA) source selection conducted in accordance with Federal Acquisition Regulation (FAR) part 15, Contracting by Negotiation, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), the Air Force Federal Acquisition Regulation Supplement (AFFARS), DoD Source Selection Procedures, Appendix A, and Air Force Mandatory Procedures 5315.3. These regulations are available electronically at the Air Force (AF) FAR Site, https://www.
acquisition.gov/
B. Number of Contracts to be Awarded: The Government intends to award one (1) Firm Fixed Priced (FFP) contract in response to this solicitation to the offeror who are deemed responsible in accordance with the FAR Subpart 9.1, as supplemented, whose proposal conforms to the solicitation's requirements (to include all stated terms, conditions, representations, certifications, and all information required by Section L and M of this solicitation) and is judged, based on the evaluation factors to represent the lowest price technically acceptable proposal.
C. Rejection of Unrealistic or Unbalanced Offers: The Government may reject any proposal that is evaluated to be unrealistic in terms of program commitments, contract terms and conditions, or unrealistically high or low in price when compared to Government estimates, such that the proposal is deemed to reflect an inherent lack of competence or failure to comprehend the complexity and risks of the contract.
In accordance with FAR 15.404-1(g) - Unbalanced pricing may increase performance risk and could result in payment of unreasonably high prices. Unbalanced pricing exists when, despite an acceptable total evaluated price , the price of one or more line items is significantly over or understated as indicated by the application of cost or price analysis techniques. All offers shall be analyzed to determine if the prices are unbalanced. If cost or price analysis techniques indicate that an offer is unbalanced, the offer may be rejected if the contracting officer determines that the lack of balance poses an unacceptable risk to the Government.
D. Discussions: The Government intends to award without discussions; therefore, offerors should submit proposals that represent their best efforts. If, during the evaluation period, it is determined to be in the best interest of the Government to hold discussions, offeror responses to Evaluation Notices (ENs) and the Final Proposal Revision (FPR) will be considered in making the source selection decision. In the event discussions are to be conducted, a competitive range will be established IAW FAR 15.306(c)(2). The Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit effective competition. (10 U.S.C. 2305(b)(4) and 41 U.S.C. 3703).
E. Solicitation Requirements, Terms and Conditions: Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as factors and subfactors. Failure to comply with the terms and conditions of the solicitation may result in the offeror being ineligible for award. Offerors shall clearly identify any exception to the solicitation terms and conditions and shall provide complete supporting rationale. The Government reserves the right to determine any such exceptions unacceptable.
EVALUATION PROCESS
Step 1: Review proposals and rank them by total price from lowest to highest.
Step 2: Conduct technical evaluations beginning with the lowest priced proposal. If the lowest priced proposal is determined to be technically unacceptable, then the next lowest priced proposal will be evaluated. Technical evaluations will continue until the lowest priced technically acceptable proposal is identified. The Government, at its discretion, may continue technical evaluations until the Contracting Officer determines that a sufficient number of technically acceptable proposals have been identified to permit determination of price fair and reasonable. The Government reserves the right to award without discussions. Only those offerors determined to be technically acceptable, either initially or as a result of discussions, will be considered for award.
EVALUATION FACTORS -
The following evaluation factors and sub-factors will be used to evaluate each proposal. The Government will evaluate proposals for acceptability, but will not rank the proposals by the non-price factors.
Factor 1: Design-Build Project Price Factor 2: Technical Subfactor 1: Management, Technical Approach and Capabilities Subfactor 2: Past Experience Subfactor 3: Classification Certificates Subfactor 4: Agreements with Subcontractors
Factor 1 - Price: The evaluated price shall be the total price of the four CLINs proposed by the Offeror for this Design-Build project. The Offeror's total price proposal will be evaluated, using one or more of the techniques defined in FAR 15.404, in order to determine if it is fair and reasonable. Normally, adequate price competition establishes a fair and reasonable price (FAR 15.403-1(c)(1)(i)).
Factor 2 - Technical: For the purposes of technical evaluation, the term "Offeror" will include any proposed teaming arrangements. The Government's technical evaluation team shall evaluate the technical proposals on an acceptable or unacceptable basis, assigning one of the ratings described below for each factor. Any factor evaluated as "Unacceptable" will render the entire proposal unacceptable and, therefore, will not be eligible for award. Only those proposals determined to be technically acceptable, either initially or as a result of discussions, will be considered for award. However, the Offeror is reminded that the Government reserves the right to award this effort based on the initial proposal, as received, without discussion.
TECHNICAL ACCEPTABLE/UNACCEPTABLE RATING METHOD:
Acceptable: Proposal meets the requirement of the solicitation.
Unacceptable: Proposal does not meet the requirements of the solicitation.
The proposals shall be evaluated against the following Technical Subfactors:
A. Subfactor 1 - Management, Technical Approach, and Capabilities:
A.1. A-E Design Capabilities: The Offeror shall include in the proposal the proposed A-E design firm and the capabilities of the A-E design firm, demonstrating their experience performing design-build construction projects, as well as design of projects of similar type/scope and magnitude. Provided experience information must be detailed sufficiently to allow the Government to ascertain the Offeror's capability to perform works similar to this effort.
This requirement is met when the offeror demonstrates that the A-E firm has experience performing design-build construction projects and/or design of projects of similar type/scope and magnitude.
A.2. Management and Technical Approach: The Offeror shall include in his proposal the description of the Offeror's management and technical approach of all involved parties (Prime Contractor, Architect-Engineer Design Firm, and key subcontractors, if any). Describe the proposed management structure of the team, describing how the design and/or construction process will be managed and the authorities and/or the delegations of authority within the team. The Offeror should utilize this section to describe best practices of their company. Key elements include, but are not limited to:
a. Available headquarter management resources assigned to the project.
b. Organizational Chart: The Offeror must include in the proposal the organizational chart identifying roles and responsibilities of the key personnel, teaming partners and key subcontractors, if any.
c. Construction team involvement during the design phase.
d. Design team involvement during construction phase.
e. Problem avoidance and mitigation techniques/strategy.
f. Construction safety best practices.
g. PV Farm construction and installation and construction technical requirements and quality control (QC) processes: Including but not limited to milling and paving operations, aggregate sourcing, markings, signage, testing laboratory and asphalt batch plant.
This requirement is met when the Offeror demonstrates a clear and concise Management and Technical Approach that will allow for the accomplishment of this design-build project in compliance with all requirements specified in the Statement of Work.
A.3. Schedule Plan: The Offeror shall include in their proposal the description of its ability to execute the construction in relation to the design-build project, minimizing the impact on operations. The plan will include a preliminary summary schedule, including all events associated with the work. This plan shall be in the form of a bar chart schedule (Gantt chart), showing relationship between activities, the critical path and floats.
Additionally, the Offeror shall provide a description of potential scheduling issues and solutions in relation to this design-build scope.
The requirement for a schedule plan is met when the Offeror submits a complete, realistic and well-sequenced schedule plan that captures all Statement of Work requirements in relation to the design-build project and conforms to the period of performance. The Offeror shall demonstrate project completion showing all major elements of work to include percentage of each work element in accordance with the Statement of Work.
B. Subfactor 2 - Past Experience:
The Offeror shall include with the proposal projects that demonstrate the capabilities of the Offeror through past experience. Examples should at minimum describe magnitude, scope, and Offeror role.
B.1. (3) to (5) example projects demonstrating the design-build project management experience of the Offeror as the prime contractor of a project. Additionally, the offer should choose (1) of the example projects and provide further information within their proposal. Information should include specific applications of best management practices and lessons learned as it relates to Subfactor A.2 Management and Technical Approach.
B.2. (3) to (5) example projects demonstrating the experience and capability of the Offeror as a Construction Firm when a full design has been provided by the Government. Examples should demonstrate the capability to manage a construction contract of similar type and scope to this project, i.e. PV Farm construction and installation. Additionally, the offer should choose (1) of the example projects and provide further information within their proposal. Information should include specific applications of best management practices and lessons learned as it relates to Subfactor A.2 Management and Technical Approach.
This requirement is met when the Offeror demonstrates with examples that the Offeror has past experience with a minimum magnitude of $1,000,000 and demonstrated the capacity to apply best management practices with specific project examples.
C. Subfactor 3 - Classification Certificates:
C.1.: Classification Certificates: Offeror must include in proposal Current Classification Certificates held by the Bidder and/or key subcontractors, if any, and issued by the Spanish "Registro Oficial de Licitadores y Empresas Clasificadas del Estado" of the "Ministerio de Hacienda" in relation to this design-build contract. The certificate holder must execute the activities related to the certificate as specified. The submitted certificates shall be original or a notarized copy. The classification certificates are as follows:
Certificates listed in Section K
This requirement is met when the Offeror and/or key subcontractors submit the Classification Certificates for all the activities requested in the design-build project and demonstrate the capability of obtaining all certificates (including through subcontracts) as specified in the "Special Conditions" section of the Statement Of Work
(SOW).
D. Subfactor 4 - Agreements with Subcontractors:
D.1. Memorandum of Agreement between the Offeror and each Key Subcontractor, if any: Offeror must include in his proposal a memorandum of agreement between the Offeror and each key subcontractor in relation to this design-build contract, if any, establishing that the key subcontractor will perform the corresponding work activity if the contract is awarded to the Offeror. The memorandum of agreement has to be signed by the Offeror and the key subcontractor and shall be original or a notarized copy.
This requirement is met when the Offeror submits notarized agreements for all key subcontractors that will be involved in the completion of this design-build project.
