About this file

This is a Request for Proposals (RFP) issued by the Oregon Housing and Community Services Department (OHCS) for Rent Comparability Study (RCS) reviews under HUD's Project-Based Section 8 program. The RFP seeks proposals from State-Certified General Appraisers to conduct substantive reviews and evaluations of RCS submissions for multifamily housing projects renewing their HAP contracts with HUD. The scope of work includes reviewing RCS facts, reasonings, and conclusions; reaching out to appraisers for necessary clarifications and corrections; providing written RCS review reports within two weeks of assignment; and developing and maintaining an RCS review report template compliant with HUD requirements. The RFP anticipated the award of one contract with an initial term of two years beginning in spring 2023, with options to renew up to a cumulative maximum of six years. The closing date for proposals was March 28, 2023, at 4:00 PM Pacific Time, with the anticipated Notice of Intent to Award issued on April 18, 2023. No pre-proposal conference was held, and questions were due by March 16, 2023. Prospective proposers were required to submit electronic proposals via email to the SPC, with proposals limited to ten single-sided pages plus required attachments.

OHCS estimated the cost of each RCS review report at approximately $1,200.00 as an all-inclusive flat rate, with no guarantee of specific work volume or payment amounts since work would be assigned as needed based on HUD requirements and available funding. Minimum proposer requirements included State Certification as a General Appraiser in good standing, at least two years of experience appraising multifamily housing, active engagement in performing RCS or multifamily appraisals, compliance with USPAP competency provisions, familiarity with HUD Section 8 Renewal Policy guidance, and no current or prospective financial interests in Project-Based Section 8 properties or conflicts of interest. The evaluation criteria allocated 100 total points across six categories: Understanding of Requested Services (20 points), Methodology and Approach (20 points), Management Plan (20 points), Experience and Qualifications (15 points), References (10 points), and Cost Proposal (15 points). The contract was subject to HUD funding availability and could be amended or terminated at the agency's discretion. OHCS encouraged participation by certified disadvantaged businesses, small businesses, minority-owned businesses, women-owned businesses, service-disabled veteran-owned businesses, and emerging small businesses as defined by Oregon Certification Office for Business Inclusion and Diversity standards.

SECTION 1: GENERAL INFORMATION

1.1 INTRODUCTION

The State of Oregon, acting by and through the Oregon Housing and Community Services Department (“Agency”), is seeking Proposals from qualified professionals for the purpose of conducting Rent Comparability Study (“RCS”) reviews under the requirements of the U.S.

Department of Housing and Urban Development (“HUD”) Project-Based Section 8 Renewal Guide.

A State-Certified General Appraiser must oversee the RCS review process. Agency does not have a staff person who meets this requirement. For this reason, Agency is seeking Proposals from State-Certified General Appraisers to provide this service.

Agency currently holds the Annual Contributions Contract with HUD to provide statewide Performance Based Contract Administrator services. As part of this role, HUD requires Agency to complete an initial and Substantive Review of RCSs submitted for certain projects with its contract renewal request. HUD reviews samples of Agency's work annually.

Additional details on the scope of the Goods or Services or both are included in Section 2.4, Scope of Work.

Agency anticipates the award of one (1) Contract from this RFP. There is no regular schedule or predicted RCS review volume; therefore, there is no guarantee of any specific amount of Work or payment. Agency plans to pay an all-inclusive flat rate for each RCS review report completed and estimates the cost of each RCS review report will be approximately $1,200.00. Work will be assigned as needed by issuance of a Written Notice to Proceed from Agency substantially in the form and format shown in Attachment A (Sample Contract). Agency reserves the right to amend or terminate the resulting Contract contingent on the availability of HUD funding.

The initial term of the Contract is anticipated to be two (2) years beginning in spring 2023, with options to renew at Agency’s discretion up to a cumulative maximum of six (6) years.

The table above represents a tentative schedule of events. All times are listed in Pacific Time. All dates listed are subject to change.

1.3 SINGLE POINT OF CONTACT (SPC)

The SPC for this RFP is identified on the Cover Page, along with the SPC’s contact information.

Proposer must direct all communications related to any provision of the RFP only to the SPC, whether about the technical requirements of the RFP, contractual requirements, the RFP process, or any other provision.

SECTION 2: AUTHORITY, OVERVIEW, AND SCOPE

2.1 AUTHORITY AND METHOD

Agency is using the Competitive Procurement procedures pursuant to its statutory authority in Oregon Revised Statutes (“ORS”) 456 and 458, as well as applicable rules, including but not limited to OAR 813 Divisions 5 and 6.

2.2 DEFINITION OF TERMS

For the purposes of this RFP, capitalized words are defined in OAR 125-246-0110 unless provided within this document.

"Housing Assistance Payment Contract” or “HAP Contract” means HUD provides Project- Based Section 8 rental subsidies to the owners of certain mortgaged properties pursuant to a HAP Contract. HAP Contracts specify the number of units in a particular mortgaged property for which Project-Based Section 8 assistance will be provided. Under the HAP Contracts, HUD provides Project-Based Section 8 rental subsidies to the project owners in an amount equal to the difference between the HUD approved rent for a particular assisted unit and the HUD required rental contribution from eligible tenant families.

“Key Person” means Proposer’s personnel assigned to fulfill this RFP.

“Project-Based Section 8” means a program developed by HUD to provide rental subsidies for eligible low-income families. All such assistance is ‘project-based’, i.e., the subsidy is committed by HUD for the assisted units of a particular mortgaged property for a contractually determined period.

“Project-Based Section 8 HAP Renewal” means the process by which HUD renews HAP contracts with owners. Some forms for HAP Contracts grant the project owner the option to renew the HAP Contract for one or more incremental terms, up to a specified maximum term. If the HAP Contract is renewed, the provisions of the HAP Contract will remain in effect during the additional incremental term. During the additional term, HUD is obligated to make assistance payments to the owner in accordance with the HAP Contract, which payments will include any adjustments of the contract rents provided thereunder. Agency processes these HAP Contract Renewals with project owners and HUD.

“Rent Comparability Study” or “RCS” means HUD's tool for estimating market rents (the rent that a knowledgeable tenant would most probably pay for Project-Based Section 8 units, as of

DAS Procurement Services, Version 4.1 – June 11, 2018 Page 6 of 19 the date of the appraiser’s reports) for Project-Based Section 8 projects.

“State Certified General Appraiser” means an appraiser certified as a Certified General Appraiser by Oregon’s Appraiser Certification and Licensure Board.

“Substantive Review” means an assessment and evaluation of whether the RCS appraiser’s selection of comparables, adjustments, and rent conclusions are reasonable. This work must be completed by a State Certified General Appraiser.

2.3 OVERVIEW AND PURPOSE

2.3.1 Agency Overview, Background, and Purpose

Agency is Oregon's housing finance agency, providing financial and program support to create and preserve opportunities for quality, affordable housing for Oregonians of lower and moderate income.

Agency administers programs that provide housing stabilization – from preventing and ending homelessness, assisting with utilities to keep someone stable, financing multifamily affordable housing, to encouraging homeownership. Agency delivers these programs primarily through grants, contracts, and loan agreements with local partners and community-based providers and has limited direct contact with beneficiaries. Agency's sources of funds are varied and include federal and State resources that have complex regulatory compliance requirements, and thus stewardship, compliance monitoring, and asset management are all critical functions played by Agency.

The mission of Agency is to provide stable and affordable housing and engage leaders, to develop integrated statewide policy that addresses poverty and provides opportunity for Oregonians.

Agency’s HUD contract requires Agency to review the RCS for certain projects with its contract renewal request. Agency does not have a State Certified General Appraiser on staff and must contract for these Services.

2.4 SCOPE OF WORK

The successful Proposer will be required to conduct RCS Substantive Reviews and evaluations and provide associated RCS review reports.

Specific Services include but are not limited to the following:

• Comply with the requirements of HUD’s Project-Based Section 8 Renewal Guide as it may be amended from time to time;

• Complete all Substantive Reviews of RCS facts, reasonings, and conclusions;

• Reach out to appraisers as needed to ensure they make necessary clarifications and correct errors;

• Review any revised RCS as needed and requested by Agency;

• Provide a written RCS review report to Agency of RCS conclusions, including approval or denial of an RCS; and

• Develop and maintain an RCS review report template that complies with HUD

DAS Procurement Services, Version 4.1 – June 11, 2018 Page 7 of 19 requirements and obtain Agency’s approval of template prior to use.

The SPC may request further clarification and reserves the right to request additional information to assist the Evaluation Committee in gaining additional understanding of a Proposal. Agency may conduct additional evaluation rounds, interviews, discussions, and Negotiations with interested Proposers who submit Proposals found to be reasonably likely to be selected for an award. If such Negotiations are held, Agency may establish a date for best and final offers.

After selection of a successful Proposer, Agency may enter into Contract Negotiations with the successful Proposer. By submitting a Proposal, Proposer agrees to comply with the requirements of this RFP, including the terms and conditions of the Sample Contract (Attachment A), with the exception of those terms reserved for Negotiation such as the Statement of Work and insurance requirements.

In submitting its response to this RFP, a Proposer must review the attached Sample Contract and note exceptions.

To be considered in the Contract Negotiation stage, Proposers must submit those exceptions to Agency during the Questions/ Requests for Clarification period set forth in Section 1.2.

Unless Agency agrees to modify any of the terms and conditions, Agency intends to enter into a Contract with the successful Proposer substantially in the form set forth in Sample Contract (Attachment A).

It may be possible to negotiate some provisions of the final Contract; however, Agency is not required to make any changes and many provisions cannot be changed. Modifications to the standard provisions constitute increased risk and increased cost to the State. Therefore, Agency will consider the Scope of requested exceptions in the evaluation of Proposal. Any Proposal that is conditioned upon Agency’s acceptance of any other terms and conditions http://sos.oregon.gov/business/pages/register.aspx
