RFP #72066821R00013

USAID/South Sudan MELS Activity

Amendment P00002

The purpose of this amendment is to respond to the offerors’ questions and comments to RFP No. 72066821R00013 MELS as amended.

Offerors Questions and Comments USAID Responses and comments

1) In Section L.8, Part 3 – Proposed Costs, b) Indirect Cost Information of the revised RFP, USAID states that major Subcontractors are defined as those Subcontractors individually reflecting 15% of the total prime budget. In Section L.8, Part 5 – Past Performance, USAID defines major subcontractors as those “valued at 25% or more of the contract value or performing 25% of more of the total LOE.” Could USAID clarify what value of the contract defines a major subcontractor?

The definition of major subcontractor varies as per the context. Indirect cost information is at 15% of the total prime budget and for Past performance is at 25% or more of the contract value or LOE.

2) On Page 7, Question 31, Amendment P00001 Question and Response, USAID indicated it discourages exclusive arrangements between primes and subcontractors. While we recognize USAID’s desire to receive the best services, we respectfully want to highlight that exclusive teaming arrangement are often developed to provide the government with the best combination of performance, cost, and delivery for the services being solicited.

Providing this combination of factors involves substantial collaboration and strategic conversations, which often involve sharing of confidential or proprietary information, strategies, financial data, etc. This free flow of information is critical to program design, which can be difficult to accomplish if partners do not have an exclusive relationship. Additionally, FAR Part 9.603 states that the Government will recognize the integrity and validity of team arrangements provided the arrangements are fully disclosed in the proposal and that the Government will not normally require or encourage the dissolution of teaming arrangements. Based on this additional information, would USAID reconsider its position on exclusive arrangements between non- Sudanese partners to allow for maximum collaboration and thus increase competition among bidders?

USAID discourages exclusive arrangements between primes and subcontractors for their challenges; however, offerors are free to make such arrangements.

3) Could USAID please clarify the definition of major Subcontractors as listed in Part 3 – Proposed Costs (RFP page 89): those Subcontractors individually reflecting 15 percent of the total prime budget. In part 5, Past
