NOTICE FOR FILING AGENCY PROTESTS
United States Coast Guard Ombudsman Program
It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO).
Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the Contracting Officer or Ombudsman.
Informal Forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer. If the Contracting Officer is unable to satisfy their concerns, interested parties are encouraged to contact the U.S. Coast Guard Ombudsman for Agency Protests. Under this informal process the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable).
Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions. If the protester’s concerns are unresolved, an Independent Review is available by the Ombudsman. The protester may file a formal agency protest to either the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103(d) (2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. To be timely protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program should be submitted electronically to OPAP@uscg.mil and the Contracting Officer of by hand delivery to the Contracting Officer.
Election of Forum. After an interested party protests a Coast Guard procurement to the Contracting Officer or the Ombudsman, and while the protest is pending, the protester agrees not to file a protest with the GAO or other external forum. If the protest is filed with an external forum, the agency protest will be dismissed.
The Ombudsman Hotline telephone number is (202) 372-3695.

Failure to address a specific factor clearly may be considered a deficiency. Unnecessarily elaborate brochures or other presentation materials beyond that sufficient to present a complete and effective proposal is neither necessary nor desired.
The Government advises Offerors that taking exception to or deviating from any term or condition of the RFP may result in the assessment of a deficiency to the proposal.
The Government will post all amendments to this solicitation at https://www.fbo.gov. Offerors shall include in any proposal an acknowledgment of all amendments to the solicitation. The term “principal subcontractor” is defined as a subcontractor who provides at least 20% of the proposed total price or cost (excluding the Offeror’s profit or fee) for the contract or which provides one or more Key Personnel. The notification will advise the Offeror of the Government’s recommendation to proceed or not to proceed to Phase II. Offerors which are rated most highly will be advised to proceed to Phase II. Offerors which were not among the most highly rated will be advised that they are unlikely to be viable competitors for award. The intent of this advisory notice is to minimize proposal development effort and costs for those offerors which do not appear to be viable candidates for an award. The Government’s advice will be a recommendation only and those Offerors which are advised not to proceed may yet elect to continue their participation in the procurement.
Following Government advisory notices of Phase I evaluation results, Offerors will have approximately two business days to notify the Government of the intent to proceed with Phase II.
The Government does not intend to provide debriefings after the completion of the Phase I evaluations. The specific dates will be communicated with the notification.
The Government will provide specific instructions for Phase II, within two business days of receiving the Offeror’s decision to proceed. Each Offeror will have approx. 4 weeks from the Government’s release of the Phase II-specific instructions to prepare a written proposal.
An offeror must submit a quote for Phase I to be considered for award; failure to submit a quote in Phase I precludes an Offeror from submitting a proposal in Phase II.
The Government will proceed with evaluations and conduct any exchanges (if necessary) based on the written proposals. The Government intends to evaluate proposals and award without communications or exchanges with Offerors. The Offerors should therefore propose their best approach to meeting the requirements of the SOW and solicitation. IX. FAR 52.212-2, Evaluation-Commercial Items (Oct 2014)
The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Factor 1: Technical Demonstration
The proposal will be evaluated for the ability to download data from the data server, the download speed from the data server, and the available products/coverage area of the products listed on the data server. Testing steps are listed below:
Offeror Provides URL/IP address and POC for testing.
Each of the functions from the Web Services section of the Task Order PWS
(Attachment 2, Appendix C) will be tested.
Download wind and current data for at least 5 geographic locations in US Territorial
Seas.
Download wind and current data for at least 2 geographic locations in International
Waters.
Conduct validation of data to ensure accuracy compared to NOAA products
Proposals will be evaluated on a scale of high to low confidence ratings. An offeror failing to provide a response to Technical Demonstration materials, as requested, will be ineligible for award. Proposals found to have deficiencies shall be ineligible for award.
Factor 2: Technical Approach
Proposed technical approach will be evaluated as to how well the approach reflects a clear understanding of the IDIQ PWS and Task Order 1 PWS requirements. The Government will consider the elements described above and will assign an overall rating of high, some, or low confidence.
Factor 3: Management Approach
The Government will evaluate a proposed management approach to determine consider a contractor’s use of management approach, labor mix (to include the qualifications of proposed labor categories), and transition plan to perform the requirements. The Government will further review the contractor’s proposed key personnel resume to ensure the requirements of the Task Order 1 PWS will be met. The Government will consider the completeness of any Small Business Subcontracting Plan, but will not evaluate the individual proposed approaches. The Government will consider the elements described above and will assign an overall rating of high, some, or low confidence.
Factor 4: Corporate Experience
The proposal will be evaluated for the degree to which the offeror demonstrates prior performance of the PWS tasks. The Government will consider the offerors prior experience and will assign an overall rating of high, some, or low confidence. Proposals failing to demonstrate recent experience in the areas of specific concern noted in the instructions will receive low confidence ratings.
Factor 5: Price
(a) Price Evaluation:
The Offeror’s pricing proposal submissions will be evaluated to determine whether the labor rates are reasonable. The Government will also analyze offers to determine whether proposed burdened labor rates are unbalanced.
IDIQ Labor Rates:
IDIQ Labor Rates will be evaluated for Reasonableness. Included in this analysis, the Government will consider if the proposed labor rates comply with the Service Contract Act requirements for each applicable Wage Determination included with this solicitation.
For evaluation purposes, the Government will multiply each labor category’s price by a number of hours for each of the five potential years of performance. The calculation will extend an Offeror’s burdened labor rates by the number of hours provided by the Government and will create an Extended IDIQ Price. As described below, this Extended IDIQ price will be used in calculating a Total Evaluated Price to be used as a basis for the Government’s best-value determination.
Task Order 1 Price:
The Government will evaluate the amounts proposed for the 12 month base, plus each of the four option years to ensure they are Reasonable and do not reflect unbalanced pricing. faThe Government will add the total annual price for all periods to create an Extended Task Order 1 price. As described below, this Extended Task Order 1 Price will be used in calculating a Total Evaluated Price to be used as a basis for the Government’s award determination.
Total Evaluated Price:
The Government will add the Extended IDIQ Price and the Extended Task Order 1 Price to create a Total Evaluated Price. The Total Evaluated Price will be used to determine which proposal is the most advantageous to the Government.
(b) FAR 52.217-8 will be evaluated through the consideration of rates proposed for all contract periods. Offerors shall assume that if the Government exercises clause 52.217-8 to extend performance, that the option will be priced at the rates in effect when the option is exercised. These rates will not be used for the creation of the Total Evaluated Price. The Government may determine that an offer is unacceptable if the prices are significantly unbalanced. Evaluation of option(s) shall not obligate the Government to exercise the option(s).
Basis of Award- In determining which proposal is the most advantageous to the government, the factors above will be considered in descending order of importance: Technical Demonstration, Technical Approach, Management Approach, Experience with Environmental Data and Aggregating Models, and Price. When combined all non-price factors are significantly more important than price.
The Government reserves the right not to award a contract depending on the quality of the proposals.
Offerors are advised that the award decision will be based upon the Government’s evaluation of the proposals. Although price is not the controlling factor in award, it is an important factor. Award may be made to other than the lowest priced proposal. As Price and technical factors converge, Price becomes more important. If competing proposals are substantially equal in Technical Demonstration, Technical Approach, Management Approach, Experience with Environmental Data and Aggregating Models; Price may be the controlling factor in an award.
