70Z04021R58050B00 Amendment 0003
Amendment 0003 – Responses to Additional Questions on the Centralized Cutter Boat
Pooling Combined Synopsis/Solicitation
1. Question: Can the government provide sample task order(s) for both CLIN 3 -
Scheduled Maintenance and CLIN 4 - Operational Maintenance for both the OTH III and OTH IV boats?
Answer: Each task order issued will be different depending on the results of the inspections.
Once the inspections are completed, the contractor and the COR will discuss the findings and a task order issued. The task order will include the various MPCs needed at the prices provided in Attachment 8 – Schedule of Pricing.
2. Question: Are OEM certifications required by the OEM(s) in order for us to work on the GFE equipment?
Answer: There are no specific OEM certifications required to work on GFE equipment, however the marine maintenance personnel should have the appropriate level of experience per the Specification.
3. Question: If a company has submitted DD Form 2345 to DLA for JCP certification, is there a way to have the review/acceptance process expedited with DLA in order for us to access the Technical Documentation before RFP due date for submission?
Answer: The proposal due date has been extended to 08 February 2021 at 11am EST.
4. Question: Would the government be willing to provide an extension since we are waiting on data pertinent to our response to the bid?
5. Question: The Government’s response to Q24 appears to be truncated and requires clarification. To reiterate/expand on the original question: Reference Section 3. Past Performance, page 15. Will the Government please confirm that completion/submission of two Past Performance Questionnaires (i.e., Attachment 2) is the only offeror action required for past performance, and written references/summaries do not have to be included with the technical proposal?
Answer: The Government requests that offerors provide a summary of their recent and relevant past performance, along with POC information in their proposal submission in the event that the contract specialist does not receive the completed Past Performance Questionnaires. The combined synopsis/solicitation has been updated to reflect these changes.
6. Question: Offerors please include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications – Commercial Items (OCT 2020) with your offer. Please be aware failure to provide a completed copy may result in elimination of proposal due to nonconformance. Does the government want the offeror to submit a copy of their Reps and Certs from the SAM site or just a copy of the clauses from the FAR website filled out?
Answer: As long as everything is completed and certified in SAM then there is no reason to fill out the FAR clause from the website.
7. Question: The Solicitation states "The Government will award a contract resulting from this solicitation based [on] evaluating proposals using a tradeoff process to determine the best overall value. All evaluation factors other than price, when combined, are approximately equal to price." However, it also states under the Technical factor, "The Government will evaluate this information for technical acceptability ONLY," providing an adjectival rating of Acceptable or Unacceptable. If the Technical factor is evaluated pass/fail, how will the government weigh proposal technical merit in its compilation of the best value evaluation? The lack of a graded Technical factor reduces the evaluation to considering only price and past performance.
Request that the Government change evaluation of Technical from pass/fail to graded to increase the impact of technical toward the best value determination.
Answer: The technical proposal should address and meet all the requirements within the specification. The Coast Guard believes that because all offerors will be following the same specification and processes and procedures outlined in the MCPs, the value is related to past performance, in how well the offeror has performed in the past, providing these services.
8. Question: The answer to Question 25 in Amendment 1 suggests no warranty is required once the Government accepts a boat after the operational test and delivery inspection.
Can the Government please clarify if a warranty on workmanship is required after delivery? If required after delivery, what is the required time period? Should the cost of warranty be included in costs for all CLINs/MPCs?
Answer: There is no implied warranty after the boat is delivered. Any existing or parts used for repairs/maintenance should carry that manufacturer’s warranty.
9. Question: FAR clauses incorporated by reference do not include (1) 52.222-41, Service
Contract Labor Standards (Aug 2018) (41 U.S.C. chapter 67). The labor required to perform the boat maintenance work described in CLIN 3 is typically subject to SCA, as required for the incumbent contract. Please provide wage determination for the current contract or confirm that the Government has determined that this work is not subject to SCA.
Answer: This requirement is for construction/repair on a USCG government vessel and is therefore covered under the Walsh-Healey Public Contracts Act, not the Service Contracts Act. The Walsh-Healey Public Contract Act has no specific wage determinations; instead, the minimum wages of the Fair Labor Standards Act apply.
10. Question: Request the Government provide format and content needed for all required reports. This information is necessary to account for administrative costs across all CLINs.
Answer: The specification has been updated to include the specific information required in the individual reports. There is no separate billable line for administrative costs. These costs should be built into your overhead rate or G&A rate and applied appropriately within the existing CLIN structure.
11. Question: Is there a requirement for recurring meetings (monthly, bi-weekly, etc.?) If so, where will these meetings occur, what is the duration of these meetings, and what is the contractor's role? How should this cost be allocated across the CLIN structure?
Answer: The Government anticipates bi-weekly meetings to be conducted via teleconference, however, there may be circumstances where an in person meeting may be necessary. There is no way to estimate how long each meeting will be. The contractor’s role is to provide a status of all work items on all boats and trailers in the contractor’s possession.
In addition, the contractor can discuss any problems they encounter with boats, trailers, long-lead times, part issues, etc. The costs associated with these meetings should be built into your Overhead or G&A rate and applied appropriately within the existing CLIN structure.
12. Question: Can the Government provide a sample of the required format for the Boat
Acceptance Report that the contractor will be required to generate?
Answer: There is no specific format for the Boat Acceptance Report as long as the minimum required information listed in the Specification is included.
13. Question: In light of the government's insurance requirements, are the following clauses invoked?
52.228-5 Insurance-Work on a Government Installation 52.228-7 Insurance-Liability to Third Persons
Answer: No, neither one of these clauses are applicable to this requirement.
14. Question: The answer to Question 7 in Amendment 1 indicates that estimated work hours to complete MPCs will be provided to bidders with the MPC data. Request the Government also provide an estimate of the time required to complete required administration and paperwork (documentation of completed procedures, condition found reports, inventory updates, parts ordering, parts receiving, inventory management etc.) to be added to CLIN/MPC pricing.
Answer: There is no separate billable line for administrative costs. These costs should be built into your overhead rate or G&A rate and applied appropriately within the existing CLIN structure.
15. Question: To which CLINs should the cost of the maintenance and storage facilities be allocated?
Answer: Any specific maintenance costs should be captured under either CLIN 0003-4003 or CLIN 0004-4004. The costs associated with the storage and maintenance facilities as defined under Work Item 5 in the specification, would be included in CLIN 0005-4005.
16. Question: Work Item 6 para. 3.6 the sentence is incomplete do not know what the intent is?
Answer: 3.6 Pick-up inspection. The Contractor shall conduct an inspection of the boat, trailer and kits at the time of the time of pick-up to ensure safe transportation back to the contractor’s facility.
17. Question: In accordance with Attachment 7 of Amendment 001, our PM has gone to the website to register. He was informed that his registration will take approximately a week for approval. It is estimated that he’ll receive approval around 1/15/2021. After that, he still has obtain the necessary drawings/cards. With potentially several hundred material items to be priced out, a delivery date of 1/20/2021 will not be enough time to provide a quality proposal to the government. Request this solicitation be extended to 1/29/2021 to facilitate time to receive the necessary technical documents and complete the proposal.
18. Question: Paragraph 3.3 of Work Item 5 states “The Contractor shall develop and submit a hazardous waste management plan in accordance with SFLC Std Spec 0000, Appendix A (Requirements for Environmental Protection). Is this plan due after contract award or as part of proposal submission?
Answer: The hazardous waste management plan will be due after contract award.
