QUESTIONS AND ANSWERS 4

AK-47 and Parts

1. The solicitation states “All complete rifles, and/or parts, components, assemblies, and accessories shall be of new US manufacture in serial production at time of initial submission, and in new, unused condition. Rebuilt, refinished, overhauled, remanufactured, "seconds", or any condition that is other than new shall not be accepted.

All parts, components, assemblies, and accessories shall be of new manufacture at time of initial submission, and in new, unused condition. Rebuilt, refinished, overhauled, remanufactured, "seconds", or any condition that is other than new shall not be accepted."

Given that most commonly used AK parts are produced overseas, are the two paragraphs cited inferring the application of compliance with 18 US Code 922r? Meaning that the fully assembled rifle cannot have more than 10 foreign parts? Or do all parts have to be made in the U.S., regardless of 922r? We want to make sure we did not misunderstand that section to allow for compliance and accuracy in the prices quoted.

Answer: Completed rifles must undergo final assembly in the US. The use of foreign parts in assembly is acceptable, within the limitations of 18 US Code 922(r).

It should also be noted, however, that any/all spare or accessory parts provided (with both initial submission for evaluation, as well as those to be included in CLIN 002 post-award, must maintain complete ‘drop-in’ interchangeability / interoperability with the assembled complete rifles. While the use of foreign-made/sourced parts is acceptable (again, within the limitations imposed by 18 USC 922r), the requirement for customization or hand-fitting of replacement parts will be cause for rejection.
