mailto:michael.kummer@usss.dhs.gov

The technical evaluations will utilize the ratings listed in Table 1 below; each offeror’s Technical Capability will receive one overall Technical Rating.

Risk of not meeting the Government’s requirement is very low.

Good Proposal meets or exceeds the SOW technical requirements, demonstrates an understanding of the requirements and offers advantages to the Government over basic SOW requirements. Risk of not meeting the Government’s requirement is low.

Satisfactory Proposal meets SOW technical requirements and demonstrates an adequate understanding of the requirements, but does not offer advantages over the basic SOW requirements. Risk of not meeting the Government’s requirement is moderate.

Marginal Proposal meets some but not all the SOW technical requirements but does not demonstrate an adequate understanding of the requirements.

Risk of not meeting the Government’s requirement is high.

Unsatisfactory Proposal demonstrates little to no understanding of the SOW requirements, or offer fails to adequately meet acceptable performance expectations. Proposal contains major errors or omissions. Proposal is un-awardable.

Basis for Award

The Government intends to generate a single award from this solicitation to the responsible offeror whose proposal represents the best value after evaluation in accordance with the factors in the solicitation. The Technical Capability factor will be considered significantly more important than Price.

The Government intends to award without discussions (although it reserves the right to conduct discussions). Therefore, the submitted proposal should represent the offeror’s best offer.

STATEMENT OF WORK

1. GENERAL INFORMATION

A. Title of Project / Identification of the Requirement

Blanket Purchase Agreement for AK/AKM (“AK-47”) pattern rifle (7.62x39mm) and Parts

B. Background

The United States Secret Service (USSS) / Rowley Training Center (RTC) Firearms Policy and Evaluation Section, and Weapons Distribution Section, maintain inventories of suitable and relevant weapon systems to support both training and operational functions. These weapon systems include a variety of designs and manufacturers, and include both USSS-issued weapons, as well as various military and law enforcement weapons of common domestic and foreign use.

The US Secret Service has identified a critical need for ‘AK-47 pattern’ rifles, and corresponding components, required to refresh existing/legacy USSS systems that have exceeded their operational lifecycle.

C. Scope / Purpose & Objective

The purpose of this procurement is to establish a multi-year (1 Base year and 4 Option Years) Single Award Blanket Purchase Agreement (BPA) to supply ‘AK-47 pattern’ rifles, and corresponding parts and accessories, needed to meet both operational and training requirements.

The United States Secret Service (USSS) / Rowley Training Center (RTC) has identified a critical requirement for ‘AK-47 pattern’ rifles, equipped with Blank-Firing Adapters, and optimized for safe firing of steel-cased 7.62x39 ‘blank ammunition’, and user familiarization within various training exercises.

This equipment is required to exhibit a ‘manual of arms’ consistent with current ‘AK-47 pattern’ rifles within the USSS inventory, and be compatible with existing/legacy accessories (i.e. magazines, scopes).

mailto:pamela.ante@usss.dhs.gov

Blank-Firing Adapter: All rifles must be provided with a removable, high-visibility muzzle-end attachment that, when installed, prevents the expulsion of a ‘live’ ammunition round (7.62x39mm) from exiting the barrel, thereby ensuring the safety of nearby personnel and equipment.

D. Security Requirements Non-Disclosure: Serial numbers provided for the weapons purchased by the U.S. Secret Service shall not be released to any non-US Government entity, without prior written approval of the Contracting Officer and the Special Agent-in-Charge (SAIC) of the USSS Rowley Training Center.

E. Delivery Date

Delivery is required not to exceed 90 (ninety) days from receipt of each follow-on Delivery Order/Task Order received under this BPA.

F. Warranty

The offeror(s) shall warranty the firearm for not-less-than five (5) years from the date of delivery of the firearm to the Government. The offeror shall replace any firearm that has a gross failure of the barrel, receiver, or operating system within the warranty period rendering the firearm unsafe and/or non-operational, due to defects in material or workmanship. Normal ‘wear and tear’ components associated with use shall be warranted to the life of the component as identified in the manufacturer’s provided documented preventative maintenance regimen (See 2.f.13).

The warranty shall cover and provide the USSS, with every firearm purchased, a complement of any and all parts prescribed by the successful offeror's suggested preventative maintenance schedule and/or replacement schedule. Additionally, should any new part be manufactured to rectify any unforeseen defect or deficiency, the successful offeror shall provide the USSS, if accepted, with the "upgraded" part, for every firearm purchased.

All furnished complete assemblies and/or related parts, components, and accessories conform to the Offeror’ standards and specifications for design and construction of the rifle system, and do not violate existing factory warranty terms for the rifle or the replacement parts, components, assemblies, accessories.

During the period of the warranty, the Government will ship defective item(s) back to the manufacturer's facility for repair or replacement. The successful offeror shall be responsible for all shipping charges. A courier with parcel tracking, from pickup to delivery (such as FEDEX or UPS) must be used and the parcel must be delivered utilizing overnight or next day service.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. (e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items.
