About this file

This is a Questions and Answers (Q&A) document that clarifies requirements for a Total Small Business Set-Aside RFQ involving the procurement of commercial kitchen equipment for TSA.

The RFQ includes seven CLINs (0001-0007) for various kitchen appliances with no optional line items. Key clarifications address CLIN 0006 (TurboChef i5 countertop microwave/high-speed oven or equal, requiring 208V power, 48 amp service, with specified features including touchscreen, rapid cook technology, and stainless steel construction); CLIN 0004 (commercial refrigerators with a maximum capacity of 21.3 cubic feet); CLIN 0007 (reach-in freezer preferably using R404A refrigerant but accepting alternative refrigerants if specifications are met); and CLIN 0002 (26 single-serve coffee brewers operating as standalone units with refillable water reservoirs, not direct-plumbed). Additional amendments removed FAR 52.211-11 (Liquidated Damages) and FAR 52.219-14 (Limitations on Subcontracting) from the solicitation. The NAICS code was updated from 335220 to 561210 (Facility Support Services), and the Nonmanufacturer Rule does not apply due to the procurement's anticipated value being below the Simplified Acquisition Threshold. Quoters may submit small business concerns, including qualifying retailers or wholesalers, without requirements to furnish products from small business manufacturers.

# Questions Answers

We are requesting clarification regarding CLIN 0006 / the TurboChef Countertop Microwave requirement.

In Attachment 1 – Statement of Work, the TurboChef section references a TurboChef i5 microwave/high-speed oven;

however, the replacement description appears to state “New commercial undercounter refrigerator” while also listing 208/240V electrical requirements.

Could you please confirm the intended equipment and specifications for CLIN 0006, including whether TSA requires a TurboChef i5 or an equal high-speed oven?

SOW Section 3 has been amended to remove the erroneous reference to a “commercial undercounter refrigerator.” CLIN 0006 is for a countertop TurboChef i5 microwave/high-speed oven, or equal. The unit shall be countertop-mounted and compatible with the existing 208V power connection. The TurboChef i5 is the model currently in use at the facility.

CLIN 0006 - TurboChef Countertop Microwave / High-Speed Oven The Statement of Work identifies the existing equipment under CLIN 0006 as a TurboChef i5 high-speed oven;

however, the Minimum Replacement Requirements associated with this CLIN appear to describe a commercial undercounter refrigerator.

a. Please confirm that CLIN 0006 requires a TurboChef i5, or brand-name-or-equal commercial countertop high-speed oven, rather than an undercounter refrigerator.

b. Please provide or confirm the minimum required technical specifications for the replacement unit, including cooking technology, capacity, dimensions, and other required performance characteristics.

c. Please confirm the required electrical service, including voltage, amperage, phase, and required plug/receptacle configuration.

d. If an equal product is proposed, please confirm the salient characteristics TSA will use to determine technical equivalency.

Please see answer to question #1. This unit is to be brand named or equal to Turbo Chef I5. SOW Section 3 has been amended to include the following minimum requirements: "electrical 208, touchscreen 24-in.-wide cooking chamber, intended for countertop use, rapid cook, insulated chamber preserves energy, internal catalytic converter, smart voltage sensor technology, digital display with touch controls, removable rack and grease collection pan, top and bottom jet plates, door with pull-down handle, multispeed impingement blower, equipped with oven cleaner, oven guard, aluminum paddle, standard rack, and 2 trigger sprayers, side hand grips, made of stainless steel, requires 19-in. top clearance and 2-in.

clearance on sides, ventless... electrical 208 Voltage 208/240 VAC, Frequency 60 Hz, Current (Max Circuit Requirement), 48 amp (50 amp), Max Input 9500/11500 watts Equivalent- TurboChef I5-TC."

CLIN 0004 - Refrigerator Capacity The Statement of Work describes the refrigerators under CLIN 0004 as having a capacity of "21.3 cubic-inch."

a. Please confirm whether the intended minimum capacity is approximately 21.3 cubic feet.

b. If 21.3 cubic feet is not the required minimum, please provide the minimum acceptable refrigerator capacity for

CLIN 0004.

The maximum capacity is 21.3 cubic-feet. SOW Section 3 has been amended to clarify the maximum capacity and to remove the phrase "or greater" from the minimum replacement requirements.

CLIN 0007 - Reach-In Freezer Refrigerant The Statement of Work specifies R404A refrigerant for the reach-in freezer under CLIN 0007.

a. Please confirm whether R404A is a mandatory salient characteristic.

b. Will TSA accept a currently manufactured commercial reach-in freezer using an alternative refrigerant, provided the proposed unit meets or exceeds the required capacity, temperature, electrical, construction, and performance requirements?

The reach-in freezer under CLIN 0007 must meet the SOW requirements. R404a is currently used on other units at the facility and is preferred for standardization. If the Quoter cannot source a freezer that uses R404a, then a commercial reach-in freezer using an altrernative refrigerant may be acceptable provided the quoted unit meets or exceeds the required capacity, temperature, electrical, construction, and performance requirements.

CLIN 0002 - Single-Serve Coffee Brewer Water Configuration The Statement of Work contains references to both reservoir operation and water-line connections for the single-serve coffee brewers.

a. Please confirm whether all 26 replacement coffee brewers are intended to operate using internal/refillable water reservoirs, direct-plumbed water connections, or a combination of the two configurations.

b. If a combination is required, please identify the quantity and location requiring each configuration.

c. For any direct-plumbed units, please confirm whether existing water supply connections are currently available at each intended installation location.

SOW Section 3 has been amended to clarify that there is no water line requirement. Units shall be standalone with water reservoirs that can be refilled by the users.

Optional CLINs The RFQ instructions state that quoters must provide pricing for all CLINs, including optional ones; however, the Schedule of Services identifies CLINs 0001 through 0007 and does not appear to separately identify any optional CLINs.

Please confirm whether CLINs 0001 through 0007 constitute the complete pricing schedule and whether there are any optional CLINs that quoters are required to price.

The "Quote Instructions" section of the RFQ has been amended to remove the reference to optional CLINs. This RFQ includes seven CLINs (0001 - 0007) and there are no optional CLINs.

FAR 52.211-11 - Liquidated Damages The solicitation incorporates FAR 52.211-11, Liquidated Damages - Supplies, Services, or Research and Development.

Please identify the applicable liquidated damages amount/rate, the performance milestone or delivery requirement to which liquidated damages apply, and any applicable maximum assessment period or amount.

The solicitation has been amended to remove FAR 52.211-11.

Small-Business Nonmanufacturer Rule The solicitation is identified as a Total Small Business Set- Aside under NAICS 335220 and includes FAR 52.219-14, Limitations on Subcontracting. Because the acquisition includes commercially manufactured appliances that may be supplied by manufacturers other than the prime contractor:

a. Please confirm whether the SBA Nonmanufacturer Rule applies to this procurement.

b. If the Nonmanufacturer Rule applies, has TSA obtained, or does TSA anticipate obtaining, an SBA class waiver or individual waiver applicable to any or all products being acquired under CLINs 0001 through 0007?

c. If a waiver has been obtained, please identify the CLINs/products covered by the waiver.

d. If no waiver applies, please confirm the applicable manufacturer requirements that a small-business prime contractor must satisfy when furnishing the appliances required under this RFQ.

The Nonmanufacturer Rule (NMR) does not apply to this procurement. This procurement is a total small business set-aside with an anticipated value below the Simplified Acquisition Threshold. As a result, a NMR waiver is not required. The "Solicitations Clauses and Provisions" section of the RFQ has been amended to remove FAR 52.219-14 "Limitations on Subcontracting" as it is not applicable to this requirement.

Additionally, the NAICS code has been updated from 335220 to 561210 "Facility Support Services". Small business concerns, including qualifying retailers or wholesalers, may submit quotations in response to the solicitation and are not required to furnish products manufactured by a small business manufacturer.
