Estimated Milestones – RFP/RFQ
Countering Weapons of Mass Destruction 7
The limitation of future contracting and organizational conflict of interest clauses will be revised. Vendors will be allowed to compete as a prime and/or sub on all three A&AS efforts (SSD, OSD & PPA). A&AS support task order awardees and their first tier subcontractors will not be allowed to compete for DHS/CWMD requirements to include contracts for detection and/or identification equipment (including supporting operations and maintenance), contracts for operations and/or maintenance support to other CWMD programs (e.g. BioWatch, NBIC, BD21, MDDP, etc.), contracts for support to CWMD’s budget and finance office, and IT support contracts. This restriction will remain during the life of the A&AS task orders. We are currently working on revising the applicable contract clauses. They will be provided with the final RFP/RFQ(s). A first tier subcontract is defined as a subcontract awarded directly by the contractor for the purpose of acquiring supplies or services (including construction) for performance of a prime contract.
Statement on OCI
Countering Weapons of Mass Destruction 8
• SB goals for PPA and OSD- The offeror shall provide a one page certified statement that the contractor will sub contract 20% of the total proposed value of this Task Order to small business. This will be evaluated on a "pass" or "fail" basis. No evaluations will be completed without this certification. The awardees biannual report will include progress against the Task Order small business goal of at least 20%. The RFP has been revised to provide these clarifications.
• SB requirement for SSD- The SSD requirement is open to 00CORP PSS small business contract holders. In accordance with FAR Part 8, the Government will rely on the small business representations made at the contract level. Recertification at the time of quotation submission will not be required.

Responses
Countering Weapons of Mass Destruction 60
• Will CWMD provide a reading room of CWMD- generated reference documents?
No everything required will be listed in the RFP/RFQ. Beta.sam.gov is going to be the focal point for future documents and as a search option.
• If contractors are currently supporting DHS, are they OCI’ed out of bidding OSD, PPA, and or SSD?
No, unless their contract contains its own limitations. Those with Government contracts, including with CWMD should check with your Contracting Officer to see what your limitations to future contracting/OCI clause states. If you are currently engaged in Advisory and Assistance work, you are welcome to bid. If you are performing Operations, Training, Maintenance, you may be excluded from this work.
• What changes have or will be made in OCI RFP now that Jim McDonnel is gone?
None anticipated. We are moving forward. The requirements are in place and we need them to be filled.
General Q&A
Countering Weapons of Mass Destruction 61
• Why don’t you release the RFP’s in mid-November, so you can take away all the holidays? Ba
Humbug!
If our milestones slip again, we do not intend to drop or release an RFP until January. We have endeavored to work with everyone in sharing information. We understand your concerns which is why we have built in time to take into account the holiday period. This is an important requirement for us, and for that reason we cannot postpone it till January.
• As a reminder, still looking for the answer and legal reference to the JV questions about PSS schedule -> If a small business that has a GSA PSS schedule formed a JV with a large business, we understand that JV is a separate legal entity. As such, can the government please confirm that unless a separate GSA PSS schedule was awarded to the JV, the small business is ineligible for responding as a JV to the DHS CWMD SSD RFQ.
Correct. In order to make an award to a joint venture, the joint venture would need its own PSS contract.
• When will this be released?
January 6, 2020
General Q&A (Cont.)
Countering Weapons of Mass Destruction 62
• What work is a small business set aside?
SSD
• What contract vehicle will DHS be using to procure the small business work?
GSA Federal Supply Schedule (FSS) Professional Services Schedule (PSS) 00CORP Special
Item Numbers (SIN) 871-1 through 871-6 under North American Industry Classification System (NAICS) code 541330.
• Are the draft RFP/will the RFP materials only be available to specified contract holders (PSS small business, OASIS pool 1 unrestricted), or will they be published elsewhere for potential teaming partners to view?
RFP/RFQ materials will be posted on beta.sam.gov. For OSD and PPA, proposals will only be accepted from OASIS Pool 1 unrestricted vendors. For SSD, quotations will only be accepted from GSA Federal Supply Schedule (FSS) Professional Services Schedule (PSS) 00CORP Special Item Numbers (SIN) 871-1 through 871-6 under North American Industry Classification System (NAICS) code 541330 contract holders.
Countering Weapons of Mass Destruction 63
• In accordance with section B.2.5 of the OASIS master contract, “The contractor may provide separate and and/or blended loaded hourly labor rates for prime contractor labor, each subcontractor and/or CAD division, subdivision or affiliate…” Will the Government please amend the pricing matrix to include a column to identify which company each rate applies to? (Separate rate tables from each of the first year subs and the prime, or are you looking for one rate for each labor category)?
We are looking for one rate.
Countering Weapons of Mass Destruction 64
• The OCI clarification addresses what A&AS awardees can and cannot compete for after an A&AS contract award. Isn’t there also an OCI if the awardee already has one of the CWMD contracts cited in the OPO response?
Yes there is. We ask that you look at the language in your contract for limitation of future contracting and the OCI clauses which identify those areas. If you are currently supporting operations and maintenance, the answer is yes, there is OCI.
• Is there a restriction on second tier subcontractors (subs to subs)?
Assuming this is pertaining to OCI, we will research and gain clarification on this. At the moment, we are reviewing the limitation of future contracting clause to ascertain if it extends beyond first tier subcontractors to all contracts. Outside of OCI, there are no restrictions on second tier subcontractors.
• Please clarify the ability to propose labor categories that are not on a prime’s GSA schedule (not under a CTA), can a prime map labor categories and rates under a sub’s schedule contract under a standard prime/sub relationship?
No, must be CTA or prime’s labor categories.
Countering Weapons of Mass Destruction 65
• Are primes and/or their subs able to either team or develop a JV as solution providers on the CWMD BSTC? (please clarify) We do not know what “BSTC” stands for, however, Subcontractor Contractor Teaming
Arrangements (CTA) and Joint Ventures are acceptable for SSD. For SSD, assuming that the original vendor (small business) has a PSS Schedule contract, if this company formed a separate joint venture with another company they would need to have a separate PSS contract awarded to the joint venture in order to award to the joint venture. In order for award to be made to a joint venture, the joint venture would need its own PSS contract.
• Can current CWMD performers, e.g. BD21 still prime CWMD OSD/PPA ? Can you clarify the OCI restrictions for vendors currently working on programs listed? (i.e. bio watch, BD21, etc.
If you are currently providing operations, equipment, maintenance or training, you will be conflicted out. Those providing advisory and assistance services will be able to compete.
Countering Weapons of Mass Destruction 66
• Out of concern to industry, and to ensure the best quality of submissions, will the Government respectfully consider releasing the final RFP’s on January 2, 2020?
The date is set for January 6th
• Is the contractor supporting CWMD in the NTC now OCI’d out of these solicitations?
If you are currently providing operations, equipment, maintenance or training, you will be conflicted out. Those providing advisory and assistance services will be able to compete.
• For OCI, if you are supporting bio watch or NBC at HQ now, is that considered O&M?
This has been addressed previously. What you are doing specific to bio watch, i.e., advisory and assistance, or maintenance, training, equipment, operations must be considered.
• Will the Government provide a list of industry day attendees and their POC information?
Yes it will be posted unless you opt out.
Countering Weapons of Mass Destruction 67
• With the new release and due dates, it will significantly impact available contractor resources due to the Christmas and New Year holiday, would consideration please be given to shifting the schedule to release later in December or early January to allow for contractor personnel to spend holiday time with their family?
Please refer to a previously covered question pertaining to this subject.
• Can you delay release of the RFP’s till January?
Please refer to a previously covered question pertaining to this subject.
• Why are you ruining the holidays for everyone?
Please refer to a previously covered question pertaining to this subject.
Countering Weapons of Mass Destruction 68
• Will the Government provide an update on other relevant procurements at the CWMD office, for example, there had been other needs previously advertised for MDDP and training and exercises . Any details regarding the intent of these procurements/needs and whether they present an OCI with the procurements discussed today would be appreciated.
MDDP questions should be emailed to the CWMD Director for links to the Acquisition
Planning Forecast System (APFS) which provides access to posted information required.
You may first perform a search In the APFS Portal on all things Countering Weapons of Mass Destruction (CWMD) to access the potential planned activities for FY20.
Countering Weapons of Mass Destruction 69
• GSA’s consolidation of all GSA schedules presents the Government with a unique opportunity to consider having multiple applicable SINS for the SSD work combining acquisition, consulting, and engineering-based knowledge. Would the Government require offerors to have both 874-6 and 871-1? This would ensure offerors are appropriately qualified in both acquisition support and technical knowledge, and expand the possible labor categories available to use.
We feel comfortable with the market research conducted to date and have no plans at this time to include additional SINS.
• Are embedded analysts different from liaisons?
This question has been answered on another slide.
Countering Weapons of Mass Destruction 70
• Would the Government confirm that operations in this context should be interpreted as maintenance and in-service support related to the equipment itself and not interpreted as providing operations and associated training for first responders, e.g., MDDU tailgate training?
The Government is working to further clarify any potential OCIs in this area.
• Would the Government confirm the phrase ”contracts for operations and/or maintenance support to other programs (e.g. bio watch, NBIC, BD21, MDDP, etc.,)” should be interpreted to mean that an offeror could not be a vendor to provide the MDDP, NBIC, etc. equipment but would be eligible to provide overall SETA-type support to these programs in the future?
Yes
Countering Weapons of Mass Destruction 71
• Are you still pursuing a “Securing the pathways“ strategy?
