Countering Weapons of Mass Destruction 1
• Are primes and/or their subs able to either team or develop a JV as solution providers on the CWMD BSTC? (please clarify)
We do not know what “BSTC” stands for, however, Subcontractor Contractor Teaming Arrangements (CTA) and Joint Ventures are acceptable for SSD. For
SSD: Assuming that the original vendor (small business) has a PSS Schedule contract, if this company formed a separate joint venture with another company they would need to have a separate PSS contract awarded to the joint venture in order to award to the joint venture. In order for award to be made to a joint venture, the joint venture would need its own PSS contract.
OSD and PPA: Subcontracting, Contractor Team Arrangements (CTA) and Joint Ventures (JV) are allowable under OASIS within OASIS GSA contract terms and conditions and any threshold limitations.
Under GSA OASIS Unrestricted Pool 1, contractors may establish CTAs and JVs, in advance of any known requirement or after requirements are publicized. CTAs must be fully executed prior to proposal submission and are required to be submitted to the Government as an attachment to the proposal package. The agreements will not be counted as part of the proposal submission page limitation. All CTA and JV vendors must have a GSA OASIS contract.
GSA OASIS contract holders may also form prime contractor/subcontractor arrangements. A subcontractor is not required to hold a contract with OASIS as long as the Prime Offeror confirms in their proposal submission that it would not violate the Offeror’s OASIS contract.
The Prime Offeror is required to submit with their proposal submission fully executed CTA and JV agreements. In addition, The Prime Offeror will need to submit a statement in the proposal that indicates that there is no conflict of interest among all parties to the proposal which would include the Prime Offeror, a Subcontractor, a CTA, JV or the Government. Also, the Prime Offeror will need to confirm in their proposal submission that all vendors have the required security requirements of this solicitation.
