Design, Engineering, Construction, Integration, and Logistics for installation/relocation of Radiation Portal Monitors
THIS IS AN AMMENDED REQUEST FOR INFORMATION (RFI) ONLY. This RFI is issued solely for information and planning purposes; it does not constitute a Request for Proposal (RFP) or a promise to issue an RFP or Broad Agency Announcement (BAA). This RFI does not commit the Department of Homeland Security (DHS) Countering Weapons of Mass Destruction Office (CWMD) to contract for any supply or service. DHS CWMD is not seeking proposals at this time. Responders are advised that CWMD will not pay any cost incurred in response to this RFI. All costs associated with responding to this RFI will be solely at the interested party’s expense.
Not responding to this RFI does not preclude participation in any future RFP or BAA. The information provided in this RFI is subject to change and is not binding on CWMD. All submissions become the property of CWMD and will not be returned.
1. Background The U.S. Department of Homeland Security (DHS) is committed to using cutting edge technologies and scientific talent in its quest to make America safer. The DHS Countering Weapons of Mass Destruction Office (CWMD) is tasked with researching and organizing the scientific, engineering, and technological resources of the United States and leveraging these existing resources into technological tools to help protect the country. The CWMD Radiation Portal Monitor Program (RPMP) supports this effort through investigating systems and technologies to augment and enhance existing radiation and nuclear detection capabilities and to address specific homeland security requirements.
The CWMD RPMP is a continuation of the radiation and nuclear detection program initiated by Customs and Border Protection (CBP) after the events of 9/11. The RPMP develops, acquires, deploys, and coordinates the implementation of radiation portal monitoring solutions across five vectors: land border crossings, seaports, international airports (including international preclearance sites), and international mail and express consignment courier facilities (ECCF). The RPMP continues to provide the framework and capability to execute acquisition and deployment activities required to field radiation scanning and interdiction systems across the five vectors in accordance with legislative mandates as well as global architectural and operational requirements.
The fielded systems are required to meet governmental standards related to scanning and interdiction of illicit radioactive materials and commercial needs for minimal impediment to legitimate conveyances and commerce. CWMD is in the process of acquiring approximately 200 commercially available, fixed RPM systems between Fiscal Years (FYs) 2020 - 2022. The deployment of these fixed RPM systems and reconfigurations of existing RPM systems to install and become fully operational require design, construction, engineering, and technical services.
2. Description CWMD seeks information from architect/engineer (A/E) and/or construction firms for RPM site design, construction, engineering, integration, and logistics to install and support RPM systems.
This RFI supports the Government’s deployed RPM enterprise detection mission at land, air, and sea ports of entry (POE). CWMD is conducting market research to determine the level of capability available from commercial sources to support the Government’s RPMP detection mission.
The objectives of this RFI are to:
• Assess the number and capability of potential A/E and/or construction firms (including teaming) that have engineering, design, construction, and construction management services to support this mission
• Provide A/E and construction firms early insight to the potential acquisition (e.g.
expectations, requirements, and resources needed)
• Expose A/E and construction firms to potential RFP Statement of Work (SOW) language
• Request A/E and construction firm recommendations and comments on requirements notably the ability to execute design-build for RPM sites
• Allow A/E and construction firms to submit questions and review CWMD responses
• Assess A/E and construction firm experience with RPMs and system integration
• Obtain feedback on warehousing, logistics, and inventory management for RPMs
• Assess existing and potential small business teaming arrangements such as joint venture, mentor-protégé and prime/subcontractor relationships for potential small business set-aside
• Obtain industry opinion on different SOW tasks (e.g., cost plus fixed fee for site survey, time and material for shipping RPMs)
• Determine industry experience with algorithms and parameters of RPM system within associated detection capabilities
3. Attachments To support A/E and construction firm responses to the RFI, CWMD has supplied the attachments below that contain information pertaining to the Government’s programs to deploy, operate, and maintain R/N detection capability at POEs.
A. DRAFT SOW
B. Role of RPM systems in supporting detection of radionuclide materials at POEs including RPM variants for specific lanes and locations.
C. Lifecycle Support.
D. RPM ancillary equipment requirements.
E. Glossary.
F. RPM system performance statement for vendors.
G. Sample RPM site plan designs (requires a signed NDA submitted to the contracting officer in accordance with Section 5. Instructions).
H. Non-disclosure agreement (NDA). (Required for access to above designs.)

Responses to this RFI will be reviewed by technical experts within the CWMD and other federal agencies. DHS uses support contractor personnel to assist in the review of RFI responses. The support contractors are bound by NDAs with the Government. Nonetheless, the Federal Acquisition Regulation (FAR) at Subpart 9.505-4(b) requires that whenever a Government contractor gains access to proprietary information of other companies in performing advisory and assistance services for the Government, the companies must agree to protect the information from unauthorized use or disclosure for as long as it remains proprietary and refrain from using the information for any purpose other than that for which it was furnished.
The FAR further requires that the contracting officer shall obtain copies of these agreement and ensure that they are properly executed.
Accordingly, any submission in response to this RFI that is considered to be proprietary, and contains proprietary information must include a signed NDA with the following companies:

Added the NDA language
The Government does not dictate the form or content of the NDA; that is a business decision between the companies. However, a sample NDA is included as Attachment J, and this form of a NDA has been pre-approved by the companies named above. Use of the sample agreement, or one substantially similar to the sample, will expedite signature. It is important for all respondents to understand that without signed NDAs with all three above-named contractors, your RFI submission cannot be reviewed. It is the vendor’s responsibility to provide these signed NDAs in order to be responsive to this RFI. The two companies named above are under no obligation or compunction to agree to other more onerous company-provided NDAs, and potential respondents that submit onerous NDAs for signature assume the risk that the above-named companies will not agree to such terms.
IMPORTANT NOTE: If your response to this RFI does not contain proprietary information, and is not marked as such, there is no requirement for a Non-Disclosure Agreement.
CWMD appreciates responses from all capable and qualified sources from private or public companies. Please submit responses in Microsoft Word or Adobe PDF, formatted in at least 10-point Times New Roman font with at least 8-point type in figures and diagrams.
