About this file

This is a Questions and Answers document for federal contract Solicitation 70FBR226R00000006 issued by the U.S. Department of Homeland Security's Joint Recovery Office Region 2 in Puerto Rico on March 25, 2026. The solicitation seeks Level II Armed Protective Service Officers and Patrol Vehicle Services to support disaster recovery operations across multiple disaster declarations (DR-4339-PR for Hurricane Maria, DR-4473-PR for Earthquakes, DR-4671-PR for Hurricane Fiona, and DR-4850-PR for Tropical Storm Ernesto) and the Logistics Management Directorate Distribution Centers Caribbean in Puerto Rico. The contract is subject to a local set-aside restriction requiring offerors to maintain their main operating office in Puerto Rico and generate at least half of gross revenues and employ at least half of permanent employees from that location during the preceding twelve months.

The applicable wage determination is No. 2015-5707, Revision 28 (dated 12/03/2025) under standard labor category 27102 – Guard II at $10.87 per hour; Federal Executive Order 13658 does not apply to work performed in Puerto Rico as it covers only the 50 states and District of Columbia. Each protective service officer post requires an assigned two-way radio or equivalent communication device. Contractors may utilize individually owned and licensed firearms and equipment, provided they comply with applicable Puerto Rico laws and the Statement of Work requirements; the contractor remains responsible for ensuring all PSO equipment, firearms, and ammunition meet contract compliance standards. Once selected, contractors may manage staffing decisions, including recruiting new officers or retaining incumbents, with the government's requirement being that PSOs report on time, fully equipped, qualified, and trained. Questions regarding incumbent contractors and current contract values require submission of a Freedom of Information Act request.

The Federal Executive Order 13658 per 29 CFR 10.3(c) explains that the EO only applies to contracts with the Federal Government requiring performance in whole or in part within the United States, which is defined in 29 CFR 10.2 to mean exclusively the 50 States and the District of Columbia. If a covered contract is to be performed in part within and in part outside the United States, the Executive Order would apply only to that part of the contract performed within the United States (again, defined as the 50 states and the District of Columbia). The United States territory, such as Guam, the Commonwealth of the Northern Mariana Islands, or Puerto Rico, are not covered by the Executive Order.
