About this file
This document contains the evaluation factors for a Federal Emergency Management Agency (FEMA) Request for Proposals (RFP 70FBR226R00000006) for Level II Armed Protective Services Officers (PSO) and patrol services in Puerto Rico. The requirement is a small business set-aside for local firms defined as companies residing or primarily conducting business in Puerto Rico under the Stafford Act Section 307 and FAR 26.202-1.
Award will be made to the responsive, responsible contractor providing best value based on three evaluation factors in the following order of importance: Factor 1 – Technical Capability (significantly more important than Factor 2), Factor 2 – Past Performance, and Factor 3 – Price. Combined non-price factors are significantly more important than price. Technical Capability evaluation requires offerors to demonstrate ability to staff all FEMA locations, provide available PSOs, furnish required uniforms/equipment/firearms, provide patrol vehicles, comply with hours of operation and labor requirements, and detail compliance approaches. Responses must include proof of minimum qualifications, insurance, state and corporate licenses, weapons licenses, detailed weapons inventories by manufacturer/model/caliber/serial number, uniform and equipment checklists, and draft transition plans per SOW Sections 5, 6, 9, and 15.1.3. Past Performance evaluation covers contractual work from the last three years of similar size, scope, and complexity with government, state, local, and commercial clients, assessed using rating categories of Superior, Satisfactory, Unsatisfactory, or Neutral. Price evaluation requires completion of Attachment 8 CLIN Pricing Sheet with fixed labor rates; the Government evaluates total price for base and all options plus six months of the final option period under FAR 52.217-8, with price becoming critical only if offerors are essentially equal on all other factors.

Factor 2 - Past Performance
The submitted past performance experiences shall be of contractual work that are like the requirements set forth in this solicitation. Past Experience summaries shall be for projects completed in the last three (3) years or currently in process, which are of similar size, scope, and complexity relevant to the effort required by this solicitation. Contracts listed may include those entered by the Federal Government, Agencies of State and Local governments, and Commercial customers. Contracts with the parent or an affiliate of the offeror may not be used. The following information shall be provided for each referenced contract:
a. Program title or product name
b. Contract number
c. Contract type
d. Brief synopsis of work performed.
e. Brief discussion of how the work was performed and how is relevant to this solicitation.
f. Contract Value
The Government will consider the above information, as well as information obtained from any other sources, when evaluating the offeror’s experience. The past performance evaluation will assess the Offeror's record of relevant and recent work for government and private sector clients.
Factor 3 - Price
Offerors shall complete Attachment 8 CLIN Pricing Sheet. Do not change the government provided spreadsheet; simply Page 108 of 114Page 108 of 114 insert the fixed labor rate.
EVALUATION FOR TECHNICAL CAPABILITY
The Government will evaluate the offeror’s comprehensive approach to achieving the overall objectives outlined in the
Statement of Work (SOW) based on the responses to the technical questions. Each response will be assessed based on the evaluated criteria. The adjectival rating and price shall be considered in determining the best value. Please note, lowest price does not necessarily equate to best value. The adjectival rating scheme and definitions are provided below.
RATING DEFINITIONS FOR TECHNICAL CAPABILITY
Rating Definition High Confidence The Government has high confidence that the Contractor understands the requirement, proposes a sound approach and will be successful in performing the contract with little or no Government intervention.
Low Confidence The Government has low confidence that the Contractor understands the requirement, proposes a sound approach or will be successful in performing the contract even with Government intervention.
EVALUATION FOR PAST PERFORMANCE
The Past Performance evaluation will assess the offeror’s probability of meeting the SOW requirements based on overall performance records of previous FEMA contracts, other government contracts, reviews of CPARS and any other performance history relevant to assessing the offeror’s probability of meeting the SOW’s requirement. The Offerors' past performance will be rated using the evaluation rating definitions for past performance provided in the below table.
RATING DEFINITIONS FOR PAST PERFORMANCE
Rating Definition
Neutral No relevant performance record is identifiable upon which to base a meaningful performance rating. This is neither a negative nor positive assessment.
Superior Based on an offeror’s past performance record, essentially no doubt exists that the offeror will successfully perform the required effort.
Satisfactory Based on an offeror’s past performance record, it is likely that the offeror will successfully perform the required effort.
Unsatisfactory Based on an offeror’s past performance record, it is not likely that the offeror will successfully perform the required effort.
EVALUATION FOR PRICE
The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Although all non-price factors combined are considered significantly more important than price, price is still an important factor. Price may become a critical factor if two or more offerors are determined to be essentially equal following the evaluation of all factors other than price. In any event the Government reserves the right to make an award to the Offeror(s) whose proposal provides the best overall value to the Government.
The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. To account for the option periods possible under FAR 52.217-8 (maximum of six months), the Government will evaluate the option to extend services by adding six months of the offeror’s final option period price to the offeror’s total price.
This amount will be the total evaluated price.
The Government may choose to exercise the Option to Extend Services at the end of any performance period (base or option period). Prices for the base and option periods, including the 6-month option available under FAR 52.217-8, will be evaluated to ensure that they are fair and reasonable for performance of the requirements established in the solicitation and as proposed in the technical submission. The price for the effort associated with FAR 52.217-8 will not be included in the total awarded value at contract award. If, at the end of the contract’s/order’s period of performance (the end of the base period or any option period) and within the time established in the clause, the Government chooses to exercise this option, the pricing will be pursuant to the rates specified in the contract for the preceding performance period.
