The Federal Emergency Management Agency (FEMA, or the Agency) Logistics Management Directorate
(LMD) provides an efficient, transparent, and flexible logistics capability to procure and deliver goods and services that support disaster response and recovery for survivors and communities. The primary mission of
LMD is to deliver the right resources to the right place at the right time in support of state, local, tribal
Governments and territories.
The Transportable Temporary Housing Unit (TTHU) Program, within the LMD, is seeking project management construction support services to support the Agency’s direct housing missions. Project oversight work may include, but is not limited to, surveying, debris cleanup, site grading, site utility infrastructure, water distribution system, electrical service, roads-surfaces-pads, construction fencing, TTHU transportation, TTHU site inspection, TTHU installation, TTHU maintenance, TTHU deactivation, and some other components of FEMA’s direct housing mission (e.g., Multifamily Lease & Repair Program, Permanent Housing Construction/Repair). Work may also include (but is not limited to) performance of area feasibility determination, design package preparation, and other components of FEMA’s direct housing mission, as directed.
B.1 PRICE/COST SCHEDULE

SECTION C – DESCRIPTION/SPECIFICATIONS
Performance Work Statement
Logistics Construction Support Contract (LCSC)
C.1 General
The Federal Emergency Management Agency (FEMA, or the Agency) Logistics Management Directorate
(LMD) provides an efficient, transparent, and flexible logistics capability to procure and deliver goods and services that support disaster response and recovery for survivors and communities. The primary mission of LMD is to deliver the right resources to the right place at the right time in support of state, local, tribal
It is expected that the Contractor will furnish all design, labor, equipment, material, manufactured articles, transportation, supervision, and all else necessary to accomplish project management for each task order
(TO) written under this Logistics Construction Support Contract (LCSC). All direct housing options are authorized under Section 408 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act as amended (Stafford Act).
Construction support for TTHUs must be in compliance with established industry standards—e.g.
Manufactured Homes with U.S. Department of Housing and Urban Development (HUD) standards, set forth in 24 CFR 3280 the Manufactured Home Construction and Safety Standards; Recreational Vehicles must be constructed under the consensus standards promulgated by the Recreational Vehicle Industry
Association (RVIA); etc. In addition, FEMA has developed performance requirements for TTHUs that enhance the HUD standards and describe the types of manufactured homes that FEMA requires. These requirements are found in the most current TTHU manufacturing contracts, including FEMA’s Rugged
Based Requirements.
Disclaimer: All Prime and Sub-Contractor on HSFE80-17-R-0005 (FY18 LOGHOUSE Contract) are prohibited from competing on the LCSC contract due to the potential for a conflict of interest between service providers.
C.2 Objectives
FEMA’s principal objective under this contract is to provide technical and project management expertise in direct housing services to assist impacted disaster survivors as promptly as possible. In assisting the
Government with fulfilling this requirement, and ensuring that taxpayer money is used efficiently, the
Contractor shall provide project management support.
FEMA anticipates that this solicitation will result in a multiple award Indefinite Delivery Indefinite
Quantity (IDIQ) contract for logistics construction services for manufacturing oversight. FEMA will issue task orders under this contract, as required to meet the needs of the Agency’s disaster response/recovery operation.
The work will be required on an as-needed basis during the life of the contract. Labor and overhead rates will be negotiated prior to award of the contract. Escalation rates for the option year periods will be negotiated prior to award of base contract. FEMA anticipates issuing a solicitation to deliver a broad range of project management services related to FEMA Logistics’ direct housing missions to the Agency to investigate, analyze, and recommend changes to TTHU manufacturing processes when issues are discovered in FEMA’s TTHUs. To facilitate this solicitation, the Agency is seeking information from several different communities that would be able and willing to provide the types of services described above to FEMA.
FEMA anticipates the need to provide support for up to five (5) Presidentially-declared disasters within any given 12-consecutive-month period, and the Contractor shall have the capability to respond to three (3) simultaneous disasters.

(1)The agency need for services is of such urgency that providing an opportunity would result in unacceptable delays and/or, (2)Only one awardee can provide the services required at the level of quality required because the services ordered are unique or highly specialized and/or, (3)The order should be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to a task order already issued under this contract, provided that all awardees were given fair opportunity to be considered for the original order. When deciding whether to negotiate a sole source logical follow-on task order with the current Contractor consideration will be given to the
Contractor’s past performance and price, and/or, (4)It is necessary to place an order to satisfy a minimum ordering requirement of the contract.
(c) The Contracting Officer has a broad discretion in determining which awardee should receive a task order. Proposed price, timeliness, and past performance will always be considered for task order award. Task orders may be awarded to other than the lowest priced Offeror.
(d) When placing orders, the Contracting Officer is not required to prepare formal evaluation plans, score Offerors, post notice in the Federal Business Opportunities, or hold discussions or negotiations with each awardee. Even though the Contracting Officer does not have to comply with the competition rules in Part 6 of the Federal Acquisition
Regulation and does not have to conduct discussions before issuing a task order, there will be an internal record of why an Offeror provided the best value on the particular requirements of each task order.
(2) TASK ORDER PROPOSAL REQUESTS (TOPR)
(a)The Contracting Officer will issue a written TOPR and will forward it to all awardees unless one of the exceptions to the fair opportunity for consideration listed above in section
(A)(1)(a)(b) if this clause applies. The TOPR will include, as a minimum, the following information:
(1) The due date for proposal submission
(2) Location of place of performance
(3) Description of the requirements
(4) Estimated period of performance
(5) Task order specific technical evaluation factors (if applicable)
(6) The basis for task order award
(7) Any additional instructions for proposal submission not contained in this section
(b)Offerors will be required to provide rapid response to the TOPRs. Offerors may only be given 24 hours to submit a task order proposal due to urgent and compelling circumstances.
If an awardee is unable to submit a response to a TOPR, they must provide the Contracting
Officer with a brief statement as to why the awardee is unable to submit a proposal. This statement is due on the closing date and time for the proposal requested.
(c)Failure to submit a response to a TOPR may be considered as negative performance information, which may jeopardize the award of future task orders.
(d)Proposal submission.
(1)Every TOPR will require the Offeror(s) to submit a proposal. The TOPR may require the Offerors to submit a technical proposal addressing past performance and task order specific technical evaluation factors (if applicable). Product literature may be requested for proposed equipment.
(e) If all Contractors have exceeded their capacity (e.g. contract ceiling or use of assets on other FEMA Task Order under this contract) or are unable to perform a given Task Order, a
TOPR may be sent directly to an awarded Contractor uncompetitive.
(3) TASK ORDER AWARD
(a)Upon the completion of the evaluation of each task order proposal, the Contracting Officer will issue a task order to the Offeror whose proposal is most advantageous to the Government considering the evaluation factors set forth in the TOPR.
(b)Task orders will be issued in writing signed by the Contracting Officer
(c)In the event issues pertaining to a proposed task order cannot be resolved to the satisfaction of the Contracting Officer, the Contracting Officer reserves the right to cancel the proposed task order.
In such an event, each Offeror shall be notified of the Contracting Officer’s decision. This decision shall be final and not subject to the Contract Disputes Act.
(4) COMMENCEMENT OF PERFORMANCE
(a)Upon award, a task order will be transmitted to the successful Contractor. Service shall commence in accordance with the delivery schedule set forth in the task order.
(b)Failure to begin services as required may result in the termination of the task order and reconsideration of the other task order proposals received in response to the TOPR. The
Government reserves the right to terminate the contract and/or task order for cause if the Contractor fails to begin services.
(5) COMPLETION OF TASK ORDERS
Within thirty (30) days of physical completion of work under each task order, the Contractor shall submit a final voucher. If additional time is needed, the Contractor shall submit a written request for a time extension that explains the extenuating circumstances.
(6) PAYMENT FOR TASK ORDERS
If the Contractor is performing more than one Task Order simultaneously, separate invoices are required for each Task Order.
(7) CLOSEOUT OF TASK ORDERS
(a)All task orders issued under this contract shall be closed out in accordance with FAR Subpart
4.804 and 4.805, and established FEMA policy. Upon completion of each task order and the receipt of the final voucher, the Government will begin closeout procedures.
(b)OMBUDSMAN. The ombudsman shall (1) review complaints from Contractors regarding the award of task orders and (2) ensure that all Contractors are afforded a fair opportunity to be considered, consistent with the procedures of this contract.
