DRAFT LCSC Performance Work

Statement

3rd Para, 2nd line

3rd Para, 6th line

Referenced paragraph refers to the audit of overhead rates prior to submittal of rates proposals by DCAA or other 3rd party. Please clarify the intent here. FAR 15.403(a) and (b) assert that when there is adequate competition -- no additional data is necessary in order to determine the reasonableness of price. No additional data necessary meaning pricing does not require the breakout into the different cost elements of overhead, G&A, FCOM. There is competition up front in this procurement -- and that will drive rates and pricing to the best they can be as each contractor wants the coveted single IDIQ award.

Furthermore the intent of the award and subsequent Task Orders issued will be Fixed Price -- all the risk on the Contractor. Given all of the foregoing, we believe an audit of indirect rates and submittal with the proposal is not necessary for this particular circumstance. Can you elaborate on why the need for an audit when FAR 15.403 allows for price reasonableness be determined by competition?

DRAFT LCSC Performance Work

Statement

3rd Para, 6th line

3rd Para, 11th line

Referenced paragraph states that "…a broad range of project management services related to FEMA Logistics'…" calls for an array of project labor skills that specialize in project management, construction, transportation, inventory, cost analysis, financial planning, demolition, excavation, site preparation and much more. In pricing the broad scope of this effort, the identification of the project labor categories that will be needed to provide solutions during emergencies can be done so they are allocated in the IDIQ upon award and exercised accordingly by each TO (and different specific scope) award subsequent to that. Each project labor category will have allocated its FIRM FIXED PRICE rate -- that is a fully burdened rate plus profit -- and the competition evaluation between offerors can be made on the basis of those rates. The menu of project labor categories should be the same -- and therefore issued in the RFP --thus requiring all offerors populate those project categories with fixed rates allowing for a clean competitive evaluation for every offeror.

The result is evident with a competitive evaluation of proposals --price and other factors considered. This methodology can be a consistent, flexible mechanism to implement an effective tool for the long term in responding to requirements. Please consider this approach or like methodology for the pricing requirement of the RFP.
