About this file
This is a Questions and Answers document from FEMA addressing contractor pricing and customs procedures for logistics operations to the U.S. Virgin Islands (USVI) and Puerto Rico (PR).
FEMA expects contractors to include all customs clearance costs, duties, port charges, and related fees within their pricing proposals. While there is no specific Contract Line Item Number (CLIN) designated for these costs, contractors should incorporate them into the CLINs for moving commodities from the Port of Debarkation to FEMA's dedicated points of need in USVI and PR. Regarding duty exemptions, FEMA is not believed to be eligible for tariff or duty relief; however, FEMA will deploy personnel at customs centers to handle all processes that require direct government staff involvement with local customs systems.

Questions & Government Response - PT 2
1. Is FEMA expecting contractors to include all customs clearance costs, duties, port charges, and related fees in their pricing? This question arises because some vendors have previously handled FEMA shipments and indicated that FEMA typically expects the contractor to manage the entire logistics process. However, they do not see a specific section in the pricing spreadsheet to capture these costs.
FEMA is expecting contractors to include all customs/port/and related fees in there pricing. There is no specific CLIN for that but it is anticipated that they will include those fees in the CLINs moving commodities from Port of Debarkation to FEMA dedicated points of need in USVI and PR.
2. Do we know whether FEMA, as a U.S. government agency, will be eligible for any tariff or duty exemptions? In Puerto Rico, certain customs clearance procedures must be completed directly by FEMA through local customs systems, and some vendors have indicated that these processes may need to be handled by the consignee.
I am unaware of FEMA being eligible for tariff or duty exemptions but FEMA will have personnel at the customs center to handle all processes that need to be handle by our staff.
