Please note the majority of labor category definitions are defined from the Bureau of Labor Statistics (BLS) to establish the labor categories that the government believes will be most commonly used in CBP's aircraft modification environment.
This IDIQ does NOT incorporate or establish a Service Contract Labor Standards (SCLS). Again, the government only used the BLS definitions for the basis of describing the labor category positions.
Management Occupations: Workers in these occupations establish plans and policies, direct business activities, and oversee people, products, and services.
Business Operations Specialist: Performs work directly related to management or general business operations. May include work in functional areas such as tax, finance, accounting, budgeting, auditing, insurance, quality control, purchasing, procurement, advertising, marketing, research, safety and health, personnel management, human resources, employee benefits, labor relations, public relations, government relations, computer network, internet and database administration, legal and regulatory compliance, and similar activities.

The RFP states "The Contractor shall comply with the FAR clauses in this paragraph (c), applicable to commercial services, that the Contracting Officer has indicated as being incorporated in this contract by reference..."
No FAR clauses relevant to Service Contract Act (SCA) requirements in this section have been selected, however
Attachment_3_Pricing_Template Tab LC Definitions uses SCA DIRECTORY OF OCCUPATIONS Job Codes and Job Descriptions which would normally be used for SCA contracts.
Can the Government clarify that SCA Job Codes and Job Titles in the Pricing Template are not contractual requirements as the FARs governing these have not been incorporated by the Contracting Officer? The following definitions were added to the Pricing Template. 1. Is the Program Manager '1,200 hours per year' intended to be used on a task order basis only?
Or does AMO anticipate having an IDIQ Program Manager available at all times including 12 months per year for calls and project planning?
2. The same question applies for the Deputy Program Manager.
3. Will CBP/AMO please provide additional explanation for the labor hours used in the pricing model?
4. Is any routine or depot maintenance anticipated to be required and included with any major or minor modifications support, during contract years 1, 2 and 3? 1. The Program Manager is intended to be used on a task order only basis. It is the government's intent to issue a task order to allow for initial services to commence such as on-boarding, planning, and other startup tasks.
However, a full time Program Manager is not anticipated for this IDIQ.
2. The Deputy Program Manager will also be tasked in the same manner as the Program Manager.
3. The labor hours are for evaluation purposes.
4. Depot/heavy maintenance is not anticipated for the first three ordering periods.
SOW Pg. 13, Para. 17a, FAA Certification In Section 17, Paragraph (a), FAA Certification, it references existing STC's.
Question: Could the government please clarify if the STC's are the "Held by and issued to the Government"- or held by and issued to the Contractor with Government retaining unlimited rights?
If so, will the government be able to provide the STC technical data or will the government -or the Contractor- be required to obtain technical data from the OEM? The government does not own the STCs. The government will provide any technical data if it is available.
The contractor will be required to obtain any necessary technical data or STCs required to perform a task order.
SOW Section 25 Warranty, pg 19 "Warranty work will be conducted at the Contractor’s facility unless agreed otherwise by both the Contractor and the Government."
Question 1: If warranty work is conducted at the Contractor's facility, is the Contractor expected to cover the cost of the aircraft transit to and from their facility?
In this Section under Warranty, it states that, "These Warranties shall start at aircraft acceptance." Normal OEM warranties are for 1 year and begin upon receipt.
Question 2: Will the government accept a shorter warranty period for "prototype" hardware/components?
Reasoning: Due to integration program schedule and procurement timelines, it may take several months to obtain hardware/components for integration, testing, and acceptance activities - which inherently will use several months of the initial OEM warranty period.
Answer 1: No, all cost to transit the aircraft will be covered by the government.
Answer 2: No, the warranties shall start at aircraft acceptance from the government.

There are two Program Management positions identified in the pricing template. The first being the Overall IDIQ Program Manager (Prime Contractor). This position will handle the overall logistics of the IDIQ throughout the span of the ordering periods.
The second Task Order Program Manager position will provide support for the specified task order. This could entail for overseeing the task order work either performed by the prime contractor or respective subcontractor (if applicable).

In the Evaluation of Factor 1 Experience, the Government states, "In evaluating Factors 1 and 2, each factor will have its own confidence assessment. The government will consider the offeror’s approaches to arrive at a confidence assessment of the offeror’s likelihood of successfully performing the work and meeting the objectives. Factor 1 is the most important factor."
Question: Will the Government explain what "consideration will be given for aircraft types in the CBP inventory" in the Evaluation Criteria?
Question: Will the Government explain how "extensiveness of the experience" will be given consideration in the Evaluation Criteria? 1. The government understands that not all offeror's have directly worked on a CBP aircraft.
