About this file
This is a sample bid bond form for the City of Owensboro, Kentucky, in connection with the RiverPark Parking Garage Elevator Modernization project. The bid bond serves as a financial guarantee that the bidder will execute the required agreement and provide any necessary performance and payment bonds within the timeframe specified in the bidding documents. The bond obligates the bidder and surety jointly and severally to pay the penal sum to the City of Owensboro should the bidder fail to deliver the executed agreement and required bonds by the deadline or any owner-approved extension thereof. Default occurs upon the bidder's failure to timely deliver the executed agreement and any performance and payment bonds required by the bidding documents.
The penal sum amount and bond number are to be completed on the face of the bond, with execution required by an authorized officer or agent of both the bidder and surety. The bond becomes null and void if the City accepts the bid and the bidder timely delivers all required documents and bonds, if all bids are rejected, or if the City fails to issue a Notice of Award within the timeframe specified in the bidding documents or any written extension not exceeding 120 days without surety consent. Payment under the bond is due within 30 calendar days of written notice of default from the City. No suit may be commenced prior to 30 days after notice of default or later than one year after the bid due date, and any action must be brought in a court of competent jurisdiction in Kentucky. The surety must attach a current Power of Attorney evidencing the authority of the signatory to execute and bind the surety to the bond.
