The Owner is under no obligation to consider or accept any proposed alternative. The Owner shall have the right to reject any and all bids or to waive informalities or irregularities in a Bid received and to accept the bid which, in the Owner’s judgment, is in the Owner’s best interest.

7.3 The Owner shall have the right to accept alternates in any order or combination, unless otherwise specifically provided in the Bidding Documents, and to determine the low bidder based on the sum of the base bid and alternates accepted.

The Owner may accept the adjusted bid price or disqualify the Bidder. In the event of either withdrawal or disqualification, bid security will not be forfeited.

Final acceptance of payment by the Contractor shall be and shall operate as a release to the Owner of all claims and all liability to the contractor for all things done or furnished in connection with this work and for every act and neglect of the owner and others relating to or arising out of this work. No payment, however, final or otherwise, shall operate to release the Contractor or his sureties, from any obligation under the contract or the performance and payment bonds.
