Bid security in the form of a certified check or bid bond equal to 10 percent of the total bid amount must accompany each bid and be issued by a surety licensed to do business in Pennsylvania. The successful bidder must execute the Agreement and furnish required Performance and Payment Bonds within 15 calendar days of the Notice of Award. Liquidated damages are assessed at $500 per calendar day for each day of delay beyond the substantial completion date and for each day beyond the final completion date. The contract is subject to Pennsylvania Prevailing Wage Act conditions, requiring payment of prevailing wages to workers, along with Federal OSHA requirements, Pennsylvania Act 229 of 2002, the Pennsylvania One Call Act (Underground Utility Line Protection Law), the Pennsylvania Human Relations Act, and non-discrimination in employment regulations. The prime contractor must obtain and maintain PennDOT prequalification for Work Class Code "S4," with all subcontractors requiring appropriate PennDOT prequalification active at bid opening and throughout construction. Bid security of unsuccessful bidders will generally be returned within seven calendar days after bid opening, while the successful bidder's bid security will be retained until the Agreement is executed and contract security is furnished.
