About this file

This Non-Collusion Affidavit is required for bidding on the Leola Community Park Project being solicited by Upper Leacock Township in Lancaster County, Pennsylvania. The affidavit must be executed by the member, officer, or employee of the bidding firm responsible for making final pricing decisions and submitted with the bid. Bids for the Leola Community Park Project—which includes construction of a new pickleball court, parking lot expansion, new walking trail, and associated stormwater management facilities—must be submitted electronically through PennBID no later than 2:00 PM local time on Thursday, August 13, 2026. Questions regarding the project must be submitted online via PennBID and received by 4:00 PM on Tuesday, August 11, 2026, with no pre-bid meeting scheduled. Bids shall remain open for 60 days from the date of bid opening, and bidders may not withdraw their bids during this period. Upon award, the successful contractor must provide a warranty bond in the amount of ten percent and performance and payment bonds in the amount of 100 percent of the contract price.

The affidavit requires bidders to certify under oath that bid prices have been developed independently without consultation, communication, or agreement with any other bidder; that prices have not been disclosed to other potential bidders; that no attempts have been made to induce other firms to refrain from bidding or submit noncompetitive bids; and that the bidder and its affiliates have not been convicted of or found liable for bid-rigging or collusion in the past three years. The affidavit must be notarized and sworn before a notary public. Failure to file a compliant affidavit will result in bid disqualification. In the case of a joint venture, each party must submit a separate affidavit. A certified check or bid bond equal to ten percent of the total bid amount, issued by a surety licensed in Pennsylvania, is required with bid submission. The project is subject to the Pennsylvania Prevailing Wage Act, the Architectural Barriers Act, the Americans with Disabilities Act, OSHA requirements, Pennsylvania Act 229 of 2002, the Pennsylvania One Call Act, and non-discrimination regulations.
