About this file
This is a Non-Collusion Affidavit template for the Eby & Stumptown Road Bridges Repairs Project in Upper Leacock Township, Lancaster County, Pennsylvania, administered under the Pennsylvania Antibid-Rigging Act. The affidavit must be executed by the member, officer, or employee of the bidding firm responsible for making final pricing decisions and submitted with all bids for the associated contracts. The document requires bidders to certify that bid prices were developed independently without consultation or communication with other contractors, bidders, or potential bidders, and that neither bid prices nor approximate prices have been disclosed to competing firms prior to bid opening. Bidders must also attest that no attempts have been made to induce other firms to refrain from bidding, submit higher bids, or submit complementary or noncompetitive bids. The affidavit requires disclosure of any ongoing governmental investigations or convictions related to bid-rigging or collusion activities within the preceding three years. Failure to submit a completed affidavit in compliance with the stated instructions results in automatic bid disqualification.
The affidavit must be notarized and sworn before a notary public, with the notary's commission expiration date recorded on the document. In cases where bids are submitted by joint ventures, each party to the venture must submit a separate affidavit on its own behalf. Bidders are explicitly warned that bid rigging, efforts to restrain competition, and false sworn statements in connection with bid submission are unlawful and subject to criminal prosecution. The affidavit acknowledges that misstatements constitute fraudulent concealment and that the representations made are material to the government entity's contract award decisions. The government entity reserves the right to use disclosure of prior collusion or bid-rigging involvement as grounds for determining bidder responsibility, though such disclosure does not automatically prohibit contract award.
