SUBPART 13.5, SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL
PRODUCTS AND COMMERCIAL SERVICES
1. Contracting Activity.
The Naval Sea Systems Command, Naval Undersea Warfare Center Division, Newport (NUWCDIVNPT), Commercial Acquisition Department, Code 02.
2. Description of the Action Being Approved.
Award of a sole source contract with Firm Fixed Price (FFP) line items to provide clerical and administrative services in support of Submarine Maintenance Engineering, Planning and Procurement (SUBMEPP) command to Patrona Corporation, 1220 12th Street SE, STE 160, Washington, DC, 20003
3. Description of Supplies/Services.
Estimated Total Dollar Value: broken out as per month for seven (7) months. All work is to be completed within Fiscal Year (FY) 25.
The contractor shall provide clerical and administrative support, to include the Executive Office, Maintenance & Availability Planning Programs, Special Projects, Maintenance Instructions and Material Programs, Engineering, Corporate Operations, Information Management Technology and Financial Management Departments.
Each month of FFP services will be fully funded with Operations and Maintenance, Navy (OMN) funding.

This procurement is a partial follow-on to SeaPort-e Task Order N00178-14-D-7866/ N6660419F3000 awarded to Patrona Corporation on 3/11/2019 by Naval Undersea Warfare Center Division Newport (NUWCDIVNPT). Services are required to continue needed efforts to support SUBMEPP programs.
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304 (c) (1): Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
41 U.S.C. 1901 (e) (2): Special Rules for Commercial Products and Commercial Services
5. Rationale Justifying Use of Cited Statutory Authority.
SUBMEPP is an independent field activity of the Naval Sea Systems Command (NAVSEA) that is aligned under the Program Executive Office, Attack Submarines (PEO SSN).
SUBMEPP provides and maintains engineered life cycle maintenance products in direct support of the Fleet, shipyards, industrial facilities, and NAVSEA. In addition, SUBMEPP performs specific Life Cycle Engineering Management and technical functions, as formally delegated by NAVSEA and Fleet sponsors and customers.
These services are being provided by Patrona Corporation under Seaport Task Order N0017814D7866/ N6660419F3000, and the period of performance for these services will end on 20 December 2024. The follow-on for this task order is expected to be awarded in second quarter of FY 2025. As FFP services cannot be extended in Seaport and to prevent a lapse in critical services, this requirement needs to be awarded using Simplified Acquistion Procedures (SAP). Due to the urgency and direct mission support that is provided under this tasking, there are no other qualified offerors that could start performance and support the required effort by 21 December 2024. The clearance and onboarding process for an alternative vendor is estimated to push the timeline for award right at least (80) hours, which is time not available. Additionally, the employees under an alternate vendor may require training to complete the required tasking, which would render the Administrative Support ineffective until the award of the Follow-On requirement.
The support provided by the administrative tasking ensures SUBMEPP compliance with higher level guidance in Security, Training and Administrative Support, responsiveness to mission tasking, and Front Office communication and scheduling. Patrona is singularly capable of performing these administrative taskings due to their tailored services for SUBMEPP and their expertise in local policy and regulation. After conducting market research, it is evident that no other company offers the combination of specialized services and expertise required for this project. Other potential vendors lack the necessary experience and capabilities.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Patrona Corporation to provide the required services.
A combined solicitation and synopsis will be posted to the Government Point of Entry (GPE) shortly after this J&A is approved. Given the short turnaround time for this requirement, the posting will specify that this requirement is sole source and that this requirement is being solicited on a sole source basis to Patrona Corporation, and that the notice is not a request for competitive quotes. However, the posting will also specify that all responsible sources may submit a capability statement which will be considered by the Government and information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the services covered by this J&A will be fair and reasonable. The Contracting Officer will use a series of techniques to determine a fair and reasonable price. Examples include: historical rate escalation, review of substantiating information, regression analysis, as well as, historical price analysis. Service Contract Labor Standards (SCLS) Wage Determination (WD) labor rate minimums will apply to this contract, so a comparison of the proposed rates to the applicable SCLS WD will also be conducted.
8. Actions to Remove Barriers to Future Competition.
The current requirement is only a temporary measure executed to prevent a lapse in service support for necessary SUBMEPP programs. Upon completion of the current requirement, services will be provided through the competitive follow-on to Seaport-e Task Order N0017814D7866/ N6660419F3000, and future requirements for these services are expected to be competitive and fulfilled via Seaport-NxG.
