About this file
This document is an Affidavit of Compliance with Foreign Entity and Human Trafficking Laws issued by the Town of Palm Beach Procurement and Contracts Division. The affidavit requires entities seeking to contract with the town to certify that they are not owned, controlled, or principally located in foreign countries of concern as defined by Florida Statutes 287.138 and 692.201. Specifically, the affidavit covers entities from countries including the People's Republic of China, Russian Federation, Islamic Republic of Iran, Democratic People's Republic of Korea, Republic of Cuba, and the Venezuelan regime of Nicolás Maduro.
The document mandates that entities affirm they do not use coercion for labor or services and comply with anti-human trafficking statutes. Key requirements include attesting that the entity does not give access to personal identifying information, is not owned by a foreign government, and does not have a controlling interest from a foreign country of concern. Violations can result in significant penalties, including civil actions, ineligibility to enter contracts for up to 5 years, placement on suspended vendor lists, and potential fines equivalent to twice the contract amount. The affidavit must be signed under penalty of perjury and notarized, with implementation dates for various compliance requirements ranging from January 1, 2024 to July 1, 2025.
