About this file
This document is an Affidavit of Compliance with Foreign Entity and Human Trafficking Laws issued by the Town of Palm Beach Procurement and Contracts Division. The two-page form requires entities seeking to contract with the town to attest that they are not affiliated with foreign countries of concern as defined in Florida Statutes Sections 287.138 and 692.201. Specifically, entities must certify they are not owned, controlled, or principally located in countries such as China, Russia, Iran, Cuba, or Venezuela, and do not have connections that would compromise personal identifying information access.
The affidavit also requires entities to affirm compliance with anti-human trafficking regulations under Section 787.06 of Florida Statutes, specifically confirming they do not use coercion for labor or services. The document mandates that entities signing the affidavit understand the legal consequences of making false statements, which can result in significant penalties including civil actions, financial penalties up to twice the contract amount, ineligibility to contract with governmental entities for up to 5 years, and potential placement on suspended vendor lists. The form is part of a broader legislative effort to prevent contracting with entities that might pose national security risks or engage in exploitative labor practices.
