About this file

This is a Proprietary Information disclosure form from the City of Arlington, Texas, Office of Procurement for a Design Build Contract for HVAC Replacement at 501 W. Sanford Street. The form establishes the procedures vendors must follow when submitting proprietary or confidential information as part of their proposal response. Vendors must clearly identify pages containing proprietary information by marking them with the word "PROPRIETARY" in all capitals and highlighted in yellow on the bottom center of each page at the time of submission. The City will make reasonable efforts to protect marked proprietary information from disclosure to the extent permitted under Texas law, though the final determination regarding disclosure rests with the Texas Attorney General. The form includes a chart where vendors must list specific page numbers believed to contain proprietary information and indicate whether only specific sections within a page qualify as proprietary.

Pricing information may not be designated as proprietary and will be made publicly available following review of all submissions in the form of a bid/proposal tab. By submitting a response, vendors agree that pricing is not proprietary and may be released. The form explicitly states that failure to properly identify and mark proprietary information will result in all unmarked sections being deemed non-proprietary and available upon public request. All material submitted to the City becomes public property and is subject to the Texas Public Information Act upon receipt.
