About this file

Summary

This is a Limited Asbestos Inspection and Lead-Based Paint Survey report prepared for the State of Utah Department of Administrative Services, Division of Facilities Construction and Management (DFCM) for the Logan First District Courthouse located at 135 North 100 West, Logan, Utah 84321. The survey was conducted by Hill West Environmental on October 31, 2022, and July 16, 2026, to identify asbestos-containing materials (ACM) and lead-based paint in areas impacted by planned HVAC Controls, fire alarm, and emergency generator upgrade and replacement work. The inspection focused exclusively on renovation areas within the facility, specifically examining suspect materials including ceiling tile, block filler, and sheetrock wall systems. Mrs. Aubrey Staple, Project Manager for DFCM, requested the survey to ensure compliance with environmental regulations before renovation commenced.

The survey results indicate that no asbestos was detected in any building materials that will be impacted during the upgrade project, and no lead-based paint was identified in painted building components within the project area. Hill West Environmental collected samples of 2' x 2' ceiling tile from offices (estimated 6,000 square feet) and sheetrock wall systems, with all analytical results returning non-detect findings. The report establishes a protocol requiring contractors to cease work and notify DFCM immediately if any suspect materials not previously sampled are discovered during renovation, as such materials would require additional testing to determine regulatory status. No universal, hazardous, or toxic wastes were identified as being impacted by the project. The report was prepared under State of Utah Company Certification #ASBC-495 by Claude Dahlk, CHMM, CIEC.

EXECUTIVE SUMMARY

On October 31, 2022, and July 16, 2026, Hill West Environmental conducted a limited pre-renovation inspection for asbestos and lead-based paint of the Logan First District Courthouse as identified in Figure 1. The project includes HVAC Controls, fire alarm, and emergency generator upgrade /replacement within the facility, which is located at 135 North 100 West, Logan, Utah 84321.

Mrs. Aubrey Staple, Project Manager with the State of Utah, Division of Facilities Construction and Management (DFCM) requested this inspection to identify asbestos-containing materials (ACM) and building components with lead-based paint that need to be addressed before the building is renovated.

Suspect materials that will be impacted include ceiling tile, block filler and sheetrock wall systems. Areas in which renovations are to occur were inspected, and all other areas were not inspected as part of this survey. Hill West identified the following asbestos-containing materials (ACM) and lead-based paint during this inspection:

1.0 INTRODUCTION

As per DFCM’s instructions, Hill West Environmental conducted a limited asbestos and lead-based paint inspection of the Logan First District Courthouse within areas as identified in Figure 1. Due to the remodel and upgrade projects, Hill West was instructed to only inspect areas that will be impacted during the renovation project.

The purpose of this survey was to identify the existence, extent, and condition of both friable and non-friable asbestos-containing materials (ACM) and lead-based paint within the renovation areas.

2.0 SITE VISIT /OBSERVATIONS

2.1 Asbestos Inspection

On July 16, 2026, Hill West Environmental visited the site to survey the renovation areas of the building. A complete asbestos inspection of the areas that will be impacted during renovations was made to determine conditions and develop a sampling scheme for the areas. Table 1 summarizes the asbestos inspection results.

2.2 Lead-based Paint Inspection

On October 31, 2022, Hill West Environmental conducted a limited lead-based paint inspection of the Logan Court within areas identified in Section 1.0 of this report. Direct measurement of lead in paint was made using a Niton XL2 X-ray Fluorescence (XRF) Spectrum Analyzer. The Niton XRF non-destructively measures lead concentrations of painted surfaces, regardless of the number of layers present.

According to the manufacturer, the detection limit (lower limit of reliable measurement) for this instrument is 0.1 milligrams per square centimeter (mg/cm2) ±0.3 mg/cm2 with the instrument set on the “quick” measuring mode.

The quick mode provides 95% confidence that the lead concentration in the paint is above or below the set point of the instrument which, for this survey is 0.4 mg/cm2. For this survey, measurements below 0.4 mg/cm2 were not reported as lead containing.

The Niton XRF sometimes reports negative values. According to the manufacturer, negative values should be expected and interpreted as zero lead content due to the statistical variability of XRF measurement technology. Both HUD and the EPA recognize the statistical variability of XRF technology and the possibility of obtaining negative values where the lead content is near zero.

Table 2 summarizes the lead-based paint inspection results. Measurements are reported in milligrams of lead per square centimeter (mg/cm2). All the coatings tested during this inspection were in good to fair condition. Only positive readings (>0.4 mg/cm2) are summarized in Table 2. Appendix B contains all XRF readings for this survey.

4.0 DISCUSSION/CONCLUSTIONS

In Utah, EPA asbestos regulations are administered by the Utah Division of Air Quality. Utah Occupational Safety and Health Administration (UOSHA) has adopted the Federal OSHA regulations. In addition, the Salt Lake Valley Health Department (SLVHD) regulates demolition activities in Salt Lake County. The SLVHD regulations for pre-demolition building inspections require an asbestos inspection, but also required building owners to inspect the building for other hazardous materials such as universal wastes, hazardous and toxic wastes and lead-based paint. Similar to asbestos, these wastes, if present must be removed prior to demolition/renovation.

A copy of this report should be on-site during all renovation activities.

This limited asbestos and lead-based paint inspection was conducted on the Logan First District Courthouse that will be impacted during renovation activities.

Only items that are believed to be impacted during renovation activities were inspected during this survey. This survey is not intended to represent exhaustive research of all asbestos or other hazards or conditions which may exist within other buildings located at this project site.

This report does not purport to represent future indoor conditions or events.

Situations or activities, which transpire subsequent to this report, which result in adverse environmental, construction and/or engineering impacts, are not to be construed as relevant to this study.

This report is intended for the sole use of Hill West's client. This report may not be used or relied upon by any other party without the written consent of Hill West.

The scope of services performed in execution of the evaluation may not be appropriate to satisfy the needs of other users, and the use or re-use of this document or the finding, conclusions, or recommendations is at the risk of said user. Appendix B contains all Company certifications and individual inspector certifications.

APPENDIX "A"

"This report relates only to the items tested. This report must not be used to claim product certification, approval or endorsement by NVLAP, NIST, AIHA-LAP LLC, or any agency of the US government."

NVLAP and AIHA-LAP LLC require laboratories to state the condition of the samples received for testing. The condition of these samples is acceptable for analysis unless there is a characteristic indicating otherwise. If a test item is not acceptable, requires a modification to the standard method, or has cause for analysis sensitivity, it will be identified by a note for that particular test item under the laboratory number on the final report. If the samples are non- homogenous, a statement will be included with the sample result. Each component or sub-sample is analyzed separately. The reported results and percentages of each material type are based on the sample received by the laboratory and may not be representative of the parent material. Orientation of top and bottom may not be specified due to uncertainty of orientation.

METHODS OF ANALYSIS AND LIMIT OF DETECTION

For air count analysis, samples are not blank corrected unless otherwise noted.

For air count analysis, the results may be biased when interferences are noted.

The accuracy of asbestos analysis in bulk samples increases with increasing concentration of asbestos. Pigments, binders, small sample size, and multiple layers may affect the analysis sensitivity.

There are two methods for analysis of asbestos in a bulk test sample: Visual Estimation and Point Count. Visual estimation with gravimetry is the most sensitive method. If an analyst makes a patient search, 0.1% or less asbestos can be detected in a bulk sample. Point count analysis is a method with a statistical approach.

Government agencies regulate asbestos containing materials (ACM) whenever the ACM is more than 1%. EPA will not accept visual estimation to verify that trace amounts of asbestos are less than 1%. EPA requires point count to verify less than 1% asbestos content. OSHA requirements apply on samples containing any amount of asbestos.

Due to higher charge for a point count analysis, Dixon Information Inc. does not perform a point count unless authorized to do so by the customer. If a sample is point counted, when possible, various chemical and/or physical means may be used to concentrate the asbestos in the sample. This is permitted by the EPA method and it increases the accuracy of the analysis.

The report must not be used by the client to claim product certification, approval, or endorsement by NVLAP, NIST, or any agency of the federal government. The Company reserves the right to dispose of all samples after a period of thirty (30) days, according to all state and federal guidelines, unless otherwise specified.

All components not quantified as asbestos content and non-asbestos content are considered to be non-fibrous matrix components. Matrix components may include, but are not limited to, gypsum, paint, silicate minerals, vinyl, binder, calcium carbonate, tar, and foam.

Inhomogeneous samples are separated into homogeneous subsamples and analyzed individually. ND means no fibers were detected. When detected, the minimum detection and reporting limit is less than 1% unless point counting is performed. Floor tile samples may contain large amounts of interference material and it is recommended that the sample be analyzed by gravimetric point count analysis to lower the detection limit and to aid in asbestos identification.
