About this file

This is a Business Confidentiality Claim Form submitted in response to the Utah Department of Transportation (UDOT) Request for Proposals for C-V2X and Related Equipment. The form allows bidders to assert claims of business confidentiality for specific information included in their proposals, in accordance with Utah Code Annotated Subsections 63G-2-305(1) and (2) and Section 63G-2-309. Bidders may claim confidentiality protection for non-public financial statements, specific employee names and contact information, customer information, client lists, subscription lists, or other specified proprietary information. However, pricing and cost proposals cannot be classified as confidential and will be considered public information. Additionally, entire proposals cannot be identified as "Protected," "Confidential," or "Proprietary."

Confidentiality claims must be supported by documentation that the protected information constitutes trade secrets as defined under Utah law or qualifies as commercial information where disclosure could result in unfair competitive injury. Bidders claiming confidentiality must identify the specific pages and paragraphs of their proposal subject to protection and provide detailed reasons for the claim. The form requires the signature of an authorized company representative and the date of submission. Bidders will be notified if any claimed protected information is classified as public or if the governmental entity determines the record should be released after weighing relevant interests under applicable Utah statutes.
