About this file

This document appears to be an amendment to a solicitation for the CO FLAP SH 5(1) Mount Blue Sky Highway project. The project involves reconstructing 0.7 miles of Colorado State Highway 5 in Clear Creek County, Colorado, including roadway reconstruction using an air convection embankment and replacement of culverts.

The amendment provides details on two potential local material sources that the contractor may use for rock embankment or granular rock material, subject to certain requirements. It also includes revised language regarding maintaining the roadway and limitations on construction operations, such as maximum lane closures and administrative access above the project site. The amendment also removes Appendix A, the Free Use Mineral Permit, from the contract.

105.02 Material Sources.

(a) Local Material Sources. Two potential material sources have been identified. The maintaining agency has acquired a Free Use Mineral Materials permit from the USFS for the material sources. The quantity and type of material provided in the Free Use Mineral Material is an estimation. The Government will not acquire additional permits or rights for material. Use and work will be in accordance with the Free Use Mineral Materials permit and in coordination with the maintaining agency. The permit is included in the appendix.

These identified sources are listed as information to aid the Contractor in locating a source. The decision to use an identified source is solely that of the Contractor.

(1) Local Material Source #1: Behind Overflow Parking Lot - The Contractor may use materials located within the temporary easement to generate rock embankment or granular rock material. Regrade and restore disturbed area to closely match surrounding ground contours.

(2) Local Material Source #2: Abandoned Roadbed - Located one mile southeast from the end of project. The Contractor may use materials located within the temporary easement to generate rock embankment or granular rock material. Finished excavation and grading will match surrounding terrain and topography.

The Government has not performed testing on the materials. The quality and quantity of material at available sources is considered useable but may contain layers or pockets of unacceptable material. It is not feasible to ascertain from visual inspection that the quality of material for an entire deposit meets material standards and therefore variations should be expected. Determine the quantity, appropriate evaluation, verification of materials, type of equipment, and work necessary to produce acceptable material prior to incorporating into the project.

Do not perform work within a source until a source development plan is approved by the CO.

Allow 7 days for approval. Include the following as applicable:

(1) Requirements of written agreements;

(2) Requirements in Sections 107, 157, 204, 205, 624, and 625;

(3) Source development details; and

(4) Restoration plan and details.

Determination by the Authorized Officer of the quantity of materials taken is binding on Purchaser subject to appeal only as provided in Sec. 14. All materials in the contract area in excess of the estimated quantity listed above are reserved by Government.

Sec. 3. Payments, passage of title, and risk of loss. Title to materials sold hereunder passes to Purchaser immediately before excavation and upon proper payment for such materials. No part of the material sold hereunder may be severed, extracted, or removed by Purchaser until payment for such materials has been made in accordance with the following:

If Purchaser fails to remedy all violations, the Authorized Officer may, by written notice, cancel this contract and take appropriate action to recover all damages suffered by the Government by reason of such violations, including application toward payment of such damages of any advance payments and bonds.
