L.1 INCORPORATION OF REPRESENTATIONS AND CERTIFICATIONS
Certain representations and certifications must be made by the offeror and completed as appropriate. The signature of the offeror on the face page of this SIR/RFO constitutes the making of certain representations and certifications.
Award of any contract to the offeror shall be considered to have incorporated the applicable representations and certifications by reference.
All questions regarding the project/specifications/plans must be received via electronic mail (email) to Samantha.A.Pearce@faa.gov no later than 3:00 p.m. CDT, one (1) week prior to the date set for receipt of offers to allow for responses to be provided prior to the due date for receipt of proposals. Mark all emails with Solicitation No.: 6973GH-25-R-00145. Please include the solicitation number and project title with your questions. Oral explanations or instructions are not binding. Any information given to an offeror that impacts the solicitation or offer will be given in the form of a written amendment to the solicitation.
L.2 SUBMISSION OF SUPPORTING COST OR PRICING
(a) It is anticipated that price analysis will be based on adequate price competition; therefore, vendors are not required to submit cost or pricing data with their proposal. However, if, after receiving offers, it is determined that adequate price competition does not exist, uncertified yet detailed cost or pricing data may be required.
(b) If it is determined that adequate price competition does not exist, the offeror shall provide current, complete, and accurate cost or pricing data upon request from the contracting officer.
L.3 INFORMATION AND CONSIDERATIONS AFFECTING OFFEROR PROPOSAL SUBMISSIONS

(a) This acquisition will involve the use of streamlined acquisition procedures employing best practices for competitive negotiated procurements as authorized by the Federal Aviation Administration Acquisition Management System (AMS) of 1996.
(b) The Government intends to award a single contract to the contractor deemed responsive and responsible with the Lowest Price - Technically Acceptable Offeror.
(c) Specific attention is invited to AMS paragraph 3.2.2.3.1.2.2, Communications with Offerors. The FAA may communicate with one or more offerors at any time during the SIR process. Communications with one offeror do not necessitate communications with other offerors, since communications will be offeror-specific. Information determined to have common application and not considered prejudicial to offerors will be communicated to all offerors.
(d) This document constitutes a formal SIR/RFO for which an award may be made without further discussions/negotiations. Offerors are to consider all the terms and conditions contained in the formal SIR/RFO in preparation for the proposals set forth herein.
L.4 INSTRUCTIONS FOR PREPARATION AND SUBMISSION OF PROPOSALS
(a) Each Vendor will submit information identified in the volumes as outlined in paragraph (b) below. The data submitted should be complete, concise, and relevant to the requirements of the SIR/RFO and are required to be submitted in the prescribed formats subsequently identified herein.
(b) The titles and contents of the volumes should be as set forth below, with the required number of copies.

(c) Volume I - Contract Documentation / Cost/Price Proposal: This volume will be in both FAA and Offeror format. This will provide information to the FAA for preparing the contract document and supporting file. Offerors must complete and submit:

TAB CONTENTS OF THE TECHNICAL PROPOSAL
#1 Factor 1, Understanding the Requirement #2 Factor 2, Past Performance
UNDERSTANDING THE REQUIREMENT – Factor 1
Factor: The Offeror must have submitted a separate narrative document within their proposal submission that clearly demonstrates they understand the magnitude of this requirement and how they intend to accomplish the work. Raycap requires a 50% upfront investment before manufacturing and an additional 50% upon delivery. The following key items must be addressed explicitly in this narrative:
- Description of the plan to procure identified SPDs in the attached Bid Sheet from RayCap
- Description of the plan to meet the delivery lead times The narrative must contain no pricing information. General statements to the effect that the work will be performed in accordance with the plans and specifications without describing the work to be performed will be considered non-responsive and will not be considered for the award.
Evaluation: Offerors will be rated either as ACCEPTABLE or UNACCEPTABLE based on the following evaluation criteria:
ACCEPTABLE: The submitted narrative describes how the Offeror intends to accomplish the requirements solicited in the SOW/Specifications
AND
Submitted narrative addresses all key items in Factor 1 description.
AND
Submitted narrative demonstrates a clear understanding of the work to be accomplished.
UNACCEPTABLE: The submitted narrative does not describe how the Offeror will accomplish the requirements solicited in the SOW/Specifications provided.
OR
Submitted narrative fails to address all key items in Factor 1 description.
OR
Submitted narrative does not demonstrate a clear understanding of the work to be accomplished.
Proposals with an UNACCEPTABLE rating for this factor will receive an overall rating of UNACCEPTABLE for Evaluation Factor 1 and will be determined ineligible for the award.
PAST PERFORMANCE – Factor 2.
Factor: Demonstrate the experience of the offeror, including expertise for the same/similar work as described in the Statement of Work (SOW).
The offeror must submit a minimum of three (3), but no more than five (5) Organizational Experience Questionnaire (OEQ) provided in Section J of the SIR within their proposal submission describing their recent past performance experience relevant to this requirement. Additionally, the FAA reserves the right to evaluate the offeror's past performance using records available in Government repositories, including but not limited to CPARs and SAM.
Evaluation: Offerors will be rated either as ACCEPTABLE or UNACCEPTABLE based on the following evaluation criteria:
ACCEPTABLE:
Offeror has provided references for at least three (3) projects that are the same/similar in scope and magnitude and meet the following criteria:
- Projects submitted were completed or underway within the last 3 years.
- Projects submitted were valued at least $2,000,000.00.
- The project submitted appears to be the same/similar in scope to this requirement.
- Projects submitted contained phone numbers and email information of customers of the respective project.
- Do not use your own templates.
AND
If further evaluated, findings in Government information repositories appear to pose little to no risk to the FAA if the offeror is awarded a contract.
UNACCEPTABLE:
Offeror failed to provide references for at least three (3) projects that meet the following criteria:
- Projects submitted were completed or underway within 3 years or less.
- Projects submitted were valued at anything less than $2,000,000.00.
- The project submitted does not appear to be the same/similar in scope to this requirement.
OR
If further evaluated, findings in Government information repositories appear to pose a significant risk to the FAA if the offeror is awarded a contract.
Proposals with an UNACCEPTABLE rating for this factor will receive an overall rating of UNACCEPTABLE for Evaluation Factor 2 and will be determined ineligible for the award.

L.5 RELATIONSHIP BETWEEN SECTIONS L AND M
Your attention is directed to the functional relationship between Sections L and M of this SIR/RFO. Section L provides information for organizing the proposal and is not intended to be all-inclusive. Section M describes evaluation factors for the award. Since the Government evaluation of proposals will cover all areas identified in Section M, proposals should address all such areas for evaluation.
L.6 PROPOSAL ACCEPTANCE
(a) Only one proposal from each Offeror shall be considered.
(b) The FAA reserves the right to consider as acceptable only those proposals submitted in accordance with the requirements outlined in the SIR/RFO that demonstrate an understanding of the complexity and scope of the requirements.
(c) The FAA further reserves the right to reject, as unacceptable, proposals deleting or altering technical requirements.
L.7 DISPOSITION OF UNSUCCESSFUL PROPOSALS
Offers received after the proposal due date will be considered "late" and will not be eligible for contract award, nor will they be evaluated in any way.
Unsuccessful offers may be notified before the award is made, or afterwards. If a proposal received is late, grossly inadequate, incomplete, or requires significant rewriting to be acceptable, the Contracting Officer intends to notify such unsuccessful offerors immediately upon reaching a determination that their proposal is otherwise ineligible for the award. The FAA reserves the right to issue all notices to unsuccessful offerors at any time during the evaluation or post-award procedures.
The FAA will retain one copy of all proposals received.
