SIR DTFAWA-20-R-00014 /

Amendment 0002

PART IV - SECTION L

INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS

L-1

L.1 GENERAL INFORMATION

All representations and certifications must be made in Section I and K by the Offeror and must be filled in as appropriate. The signature of the Offeror on the cover page of this Screening Information Request (SIR) (Standard Form 33) constitutes the making of the included representations and certifications, with the exception of the Federal Aviation Administration Acquisition Management System (AMS) Business Declaration Form, which is specifically required to be completed, signed, and submitted with offer. Award of any contract to the Offeror must be considered to have incorporated the applicable representations and certifications and the proposal will be considered a part of the contract.

L.1.1 Point of Contact The Contracting Officer (CO) is the sole point of contact for this acquisition. All questions or concerns must be addressed to the CO.

L.2 INFORMATION AND CONSIDERATIONS AFFECTING VENDOR

PROPOSAL SUBMISSIONS

(a) This acquisition will involve the use of streamlined acquisition procedures employing best practices for competitive negotiated procurements as authorized by the Federal Aviation Administration Acquisition Management System (AMS).

(b) The procurement process will involve the evaluation of the technical and price proposals.

Evaluations involved will permit the FAA to select an offer that provides the best value to the

FAA.

(c) The FAA may communicate with one or more Offerors at any time during the SIR process.

Communications with one Offeror do not necessitate communications with other Offerors since communications will be Offeror-specific. Information determined to have common application and not considered prejudicial to any Offeror will be communicated to all Offerors.

(d) This document constitutes a formal SIR for which an award may be made without further discussions or negotiations. Offerors are to consider all terms and conditions contained in the formal SIR in preparation of their proposals.

(e) The following table shows the projected schedule for this SIR:

Milestone SIR Release 07/21/2020 Questions Due From Industry 08/12/2020 Responses to Questions Released 08/21/2020 Proposal Submissions Due 09/02/2020 Contract Award 09/18/2020

L.3 INSTRUCTIONS FOR PREPARATION AND SUBMISSION OF PROPOSALS

(a) Each Offeror will submit information identified in the volumes as set forth below. The data submitted should be complete, concise, and relevant to the requirements of the SIR, and are required to be submitted in the prescribed formats subsequently identified herein.

L-2

(b) The Offeror must submit two emails, one per volume to the point of contact identified in Section L.8 below.

• Email #1: Volume 1 submission

• Email #2: Volume 2 submission

(c) The Offeror's proposal submission should be organized as follows:

L.4 PROPOSAL PRESENTATION, FORMAT, AND CONTENT

(a) The first page of each volume submission should include the volume number, volume title, the solicitation number, and the Offeror's name.

(b) The proposal pages must be numbered sequentially. Font size must be 12, in Times New Roman font, with top and bottom margins equal to 1.0 inch, and left and right margins equal to 1.0 inch. The line spacing must be single spaced. The FAA may make black-and-white copies of Offerors' proposals for evaluation purposes.

(c) Each volume should be organized in such a way that an extensive search of Government-required documents is not necessary to review the proposal. Information not in its appropriate

L-3 section and not appropriately referenced may be assumed to have been omitted.

(d) Any items embedded within a document should be objects only, not links.

(e) Proposals must contain comprehensive, concise, factual information and complete and substantiated price data. Submittals must provide documentation to substantiate any statement of fact. General statements indicating that the Offeror understands the requirements of the work to be performed, or rephrasing or restating of the Government's requirements, will not be considered adequate. Similarly, submittals containing omissions or incomplete responses to the requirements of this SIR, or that merely paraphrase the Statement of Work (SOW), or that use nonspecific phrases such as “in accordance with standard procedures” or “well-known techniques,” will also be considered inadequate. Deficiencies of this kind may be cause for rejection of the offer.

Submissions that do not specifically address all specifications or requirements will not be evaluated. The information provided is assumed to be accurate and complete.

L.5 REQUIREMENT TO NOTIFY CO OF DISCREPANCIES, QUESTIONS,

EXCEPTIONS, AND DEVIATIONS FOUND IN SIR OR MADE IN OFFERORS’

PROPOSALS

In the SIR, if an Offeror believes that these Section L instructions contain an error, omission, or are otherwise not correct, the Offeror must immediately notify the CO in writing with supporting rationale. If discrepancies are not noted prior to Offer submission, then none are presumed to exist.

In addition, Offerors are instructed to explicitly document all exceptions and deviations that it believes are contained in any part of the SIR, and to address them to the CO with supporting rationale.

Questions/clarifications about the SIR must reference the applicable contract section and the appropriate section or paragraph within the section. The Government will provide all Offerors all questions and associated responses. The source of the questions/clarification will not be identified.

In an Offeror’s proposal, the Offeror must explicitly state all assumptions, exceptions, deviations, and contingencies made with respect to, or underlying the content, of, the Offeror’s Proposal and include them in this part of Volume 1. Each assumption, exception, deviation, or contingency in an Offeror’s proposal must be mapped, or have a reference to, a specific paragraph/section of the SIR and the Offeror’s proposal.

Note with respect to Offeror proposed exceptions or deviations: Because the FAA will be evaluating proposals on a basis of Lowest-Priced, Technically Acceptable criteria, the Government will not be considering offeror proposed exceptions or deviations. In order for a proposal to be evaluated as Technically Acceptable, all of the technical evaluation criteria set forth in Section M.6 VOLUME 2 - TECHNICAL EVALUATION M.6.1 TECHNICAL EVALUATION must be met.

RELEVANT PAST PERFORMANCE

(a) The Offeror must demonstrate relevant experience and past performance or affirmatively state that it possesses no relevant experience and past performance. Relevant experience and relevant past performance is experience and performance under current contracts or contracts within the past five years. The contracts cited must be similar or have a scope that is directly related in terms of magnitude and complexity to that described in the solicitation and as defined below. Projects of a shorter duration, or recently awarded, may be considered as slightly less relevant and/or presenting a higher performance risk given the shorter period of performance. The Government will also consider the quality of the Offeror's past performance, as reflected in completed

L-7

Attachment L.2.

The Offeror must complete up to three (3) Experience forms, Attachment L.1, that provide information on the projects/contracts that the Offeror believes are relevant to this solicitation.

Where subcontracting arrangements are proposed, an additional maximum of three (3) projects for each subcontractor may be submitted. Three (3) Experience forms must be submitted for the prime contractor. The maximum number of Experience forms for a single subcontractor is three (3).

Concurrent with the Experience form, the Offeror is to provide to each of the customers referenced a corresponding Past Performance Questionnaire, Attachment L.2, to be completed by that customer and returned to the FAA by the date, time and email address provided in section L.8.(a) .

Information provided in the response to this factor will assist the Government in determining the degree of risk associated with award of this project to the Offeror in question, based upon that Offeror's past and present performance on other relevant projects. It is the Offeror's responsibility to follow-up with their customers to ensure that the completed questionnaires are provided to the FAA by the deadline provided in section L.8(a)

(b) If the FAA needs additional information to assess the Past Performance rating, the Government reserves the right to obtain information from sources other than those identified by the Offeror. An evaluation of relevance will be done for no more than three (3) projects submitted by the Offeror for itself and for no more than three (3) projects submitted for each subcontractor. The Offeror is therefore cautioned to submit only its three (3) most relevant efforts, and is cautioned to submit only the three (3) most relevant efforts of each subcontractor. If the Offeror or its subcontractors submit more than three (3) projects each for consideration, only three (3) per entity will be reviewed. The three (3) reviewed for each entity will be the first three (3) as displayed within the proposal from front to back.

(c) Where Offeror subcontracting arrangements are proposed, a narrative should be submitted as part of the proposal which clearly details the roles, responsibilities, and distribution of effort (by type and percentage) between the parties in performance of the Government's requirement.

(d) Where an Offeror provides projects performed by its managers, key personnel, subcontractors, or other partners for consideration, the Government will evaluate the past performance of its proposed managers, key personnel, subcontractor, or other partners separately and consider its findings about them, in conjunction with information provided as required in paragraph (a) above, when determining the risk associated with the proposal and assigning the appropriate rating to the proposal. The Government will determine whether the past performance of a contractor's managers, key personnel, subcontractors, or other partners offsets the risk of doing business with a prime contractor that has no or limited experience and past performance of its own.

(e) If the government attributes to the successful Offeror the past performance of its proposed managers, key personnel, subcontractors, or other partners, the successful Offeror's proposal will be incorporated into the resultant contract as a requirement. In such cases the subject managers, key personnel, subcontractors, or other partners should not be replaced without prior approval of the Contracting Officer.

L.8 TIME, DATE, PLACE, AND SUBMISSION OF PROPOSALS

L-8

Proposals must be received by the FAA on 09/02/2020 no later than 4:30 pm Eastern Time through secure electronic submission to Contracting Officer Robert C. Taylor II at robert.c.taylor-ii@faa.gov. Offerors must request receipts for proposals if one is desired. All Amendments issued, if any, must be signed and submitted with the Offerors proposal.
