mailto:james.mowery@dot.gov mailto:Angel.Ellis@dot.gov mailto:Jane.Tamai@dot.gov mailto:james.mowery@dot.gov mailto:Angel.Ellis@dot.gov mailto:Jane.Tamai@dot.gov
Additionally, and in general, each offeror’s proposal shall achieve a conformance to the technical requirements set forth in this Solicitation’s Performance Work Statement (PWS) . It shall indicate the firm’s capabilities and the means used to satisfy the requirements stated in the attached Performance Work Statement. Each Offeror is encouraged to propose any innovative solutions that meet the performance and technical requirements specified in this Solicitation.
Technical Approach:
The Offeror’s proposal shall demonstrate the offeror’s understanding of, and approach towards, fulfilling this Solicitation’s requirements to include the following elements:
(i) provide information on how the project is to be organized, staffed, and managed that demonstrates the offeror's understanding and effective management of important events or tasks to enable project completion;
(ii) address qualifications for personnel assigned to the project; include resumes for key personnel and other relevant substantiating documentation of relevant skillsets and experience for proposed personnel;
The Technical Approach shall fully discuss how the contract requirements will be met and the means used to accomplish them. A proposal’s merely repeating this Solicitation’s specified requirements, and stating that they will be accomplished by the offeror, without discussing how the offeror will accomplish them, will not be acceptable to DOT.
Demonstrated Prior Experience
The Offeror’s proposal shall detail the offeror’s prior experience as it aligns to the requirements of the PWS, specifically in the planning, design, execution, and management of work similar to that listed in this Solicitation’s PWS.
Offerors shall also include Point of Contact (POC) information for a Contracting Officer (CO), Contracting Officer’s Representative (COR), Program Manager (PM) or equivalent (non-federal) for each project referenced. The POC information shall include name, phone number, and email address.
Ideally, an offeror’s proposal should include a showing of the offeror’s experience in performing at least two projects during the five-year-period immediately preceding the submission-date of the offeror’s proposal, in which the offeror served as the prime contractor specifically focused on the elements listed below in bullet form. The Offeror may cite prior experience in which it served at a prime or subcontractor. However, experience as a prime may instill higher confidence on the part of DOT. The Offeror must identify the Offeror’s role (prime vs. subcontractor) in all the prior experience projects cited in its proposal submitted to DOT in response to this Solicitation.
• Share an example, or several, where the Offeror began supporting a similar office within a federal agency and/or corporate entity encompassing many of the functional areas as listed in the PWS in Section 2.3.
• From within the examples listed above, share specific examples of how some of the functional areas were specifically supported by the Offeror.
• Demonstrate proven successes from similar projects where the Offeror provided qualified personnel that had experience from multiple functional areas. It may instill more confidence if the Offeror shares how they were able to recruit and retain qualified personnel.
Each offeror’s proposal should include, in conjunction with each experience citation, the following associated information:
• a brief scope
• contract/task order/agreement number (for federal government procurements)
• period of performance
• contract ceiling/agreement estimate and total obligated values
• The customer
• The impact to the customer
• Any major achievements
• Role as prime contractor or subcontractor.
• References:
o Name, email, phone number, and role within the experience submission of the Contracting Officer’s
Representative (COR), Program Manager (PM) or equivalent individual (not the Contracting Officer). This can be federal or non-federal.
The Government may contact any or all Reference POCs cited in any offeror’s proposal, to confirm the level and quality of this demonstrated prior experience submissions. In addition, the Government reserves the right to review any information contained within the Contractor Performance Assessment Reporting System (CPARS) or any other Government system, source, or individual.
3.2 Price Contents
Because the offeror’s revenues under any resulting contract will be received not from DOT but rather from the offeror’s food-service-customers, each offeror is hereby instructed to not propose any Federal-price for this project.
But each offeror could, if it chooses to do so, include, in its proposal, a sample-food-service-menu showing menu-item-customer-prices considered, by the offeror, to be currently realistic or currently typical.

1.0 Task Order Overview
This acquisition is being conducted to establish a single-award contract for food services located in the William T. Coleman, Jr. and Norman Y. Mineta Federal Building (DOT HQ), Department of
Transportation (DOT), 1200 New Jersey Ave, SE, Washington, DC 20590. DOT HQ consists of two office buildings totaling 1.7 million square feet that provides offices for a workforce of approximately 5,000 personnel. The daily building population fluctuates with an anticipated range from 700 to 2000 persons. The Contractor shall provide all management, supervision, labor, equipment, supplies, and materials necessary to perform cafeteria services indicated in this solicitation.
As a Performance Based Services Acquisition (PBSA), the solicitation describes the requirements the Contractor must meet in terms of outcome or results. The "how" is left to the
Contractor, within certain regulatory guidelines, as referenced herein. This enables the
Contractor more flexibility in achieving the desired results. The Contractor shall execute its responsibilities under the contract in a manner that is consistent with the performance standards contained herein.
Subject to the detailed provisions stated in this Performance Work Statement (PWS), Contractor operations shall be subject to the review and approval of the contracting officer (CO) or the designated contracting officer representative (COR). The Government agrees to grant to the
Contractor for the stipulated period, subject to the contract requirements and conditions herein, the right to establish, manage and operate a cafeteria or similar food service function, employing a variety of food and service delivery options. The government understands that varying on-site populations can directly influence profitability and is open to varying business models employing techniques to match service offerings/levels to on-site population. Should a variety of service levels/offerings be proposed, the quality of service and food must remain high in each scenario. This service will be conducted in the DOT HQ as described herein and in connection therewith to prepare and sell food, nonalcoholic beverages and such other products as the Government may authorize.
The Cafeteria and similar food services offered will be at no cost to the Government. The Contractor shall receive and retain all income derived from sales and is responsible for all costs of the operations. The Government will not be responsible for any losses by the food service contractor.
The Contractor shall have the responsibility of satisfactorily performing all requirements in this contract as an independent contractor. Neither the Government nor the Contractor intends that this
Agreement shall be construed as an establishment of a partnership or joint venture between the parties.
The Contractor shall comply in full with the Performance Work Statement herein. The performance as described and specified shall not be deemed to constitute a detailed specification having the effect of excluding other needed work not specifically mentioned that will be necessary for the successful completion of this project as generally described. The Contractor is required to furnish all effort necessary to successfully fulfill the overall objectives set out in this contract.

1.2 PRICING ADJUSTMENTS AND REPAIR AND REPLACEMENT FUND
DOT’s Office of Facilities reserves the right to investigate and to determine the reasonableness of any such adjustments, in full and close cooperation with DOT’s contracting officer.
In performing any such determination of price-reasonableness, DOT, at its discretion, may consider the following factors, but would not be limited to a review of them:
1) A market survey of at least 3 similar food facilities in the local area (COR accepted locations).
2) A comparison of actual costs of goods from suppliers over the period in question.
3) Monthly profit/loss reports.
The request shall include documentation that supports a reasonable menu price increase based upon the factors above. ln situations where one or more critical food or supply items have a dramatic spike upward in price fluctuations due to a natural hazard, etc., the COR/CO shall be contacted with a request for a temporary surcharge or menu change. Once the subject prices have stabilized, the former approved price is to be reestablished or the item returned to the menu as specified.
The Contractor shall deposit 1.5% of all profits into an escrow account called the Government
Furnished Equipment (GFE) Repair and Replacement Fund (GFE- R&R Fund). The contractor shall provide a monthly bank statement showing the balance of the GFE-R&R account. Funds in the GFE-

2) Replacement of GFE identified in the initial major equipment list that has outlived its expected service life.

Use of GFE-R&R funds to purchase food service equipment, cleaning of hood and fire suppression systems, utensils, or the preventative maintenance cost of GFE is not allowed.
The CO may elect to increase the payment percent based upon the overall financial performance of the contract by giving the Contractor sixty (60) days’ notice. The increase will not exceed 1% in a 12-month period.
Upon final inspection of the GFE provided to the contractor in the initial major equipment list, any funds that remain in the GFE-R&R account upon contract expiration shall be returned to the Government.
Based upon the condition of the GFE and the quality of the preventative maintenance (PM) services provided by the contractor over the life of the contract, the contracting officer may return the GFE
R&R funds, or a portion of the funds, to the contractor at his or her discretion.
