Amendment No. 7
To
DOT Guard Services Solicitation No. 693JK423R500001
This Amendment No. 7 publishes further questions asked by one or more prospective offerors, and DOT’s answers.
71.QUESTION: Can the Government confirm that this is the same level of effort of the last/current contract?
71.ANSWER: Each offeror shall compile its proposal based upon the information presented in the subject FY 2023 Solicitation and in all of that Solicitation’s Amendments. And DOT has nothing to add to this Answer 71 at the present time.
72.QUESTION: Can the Government confirm on average, historically, how much TAS they used annually over the past contract term of five years?
72.ANSWER: Each offeror shall compile its proposal based upon the information presented in the subject FY 2023 Solicitation and in all of that Solicitation’s Amendments. And DOT has nothing to add to this Answer 72 at the present time.
73.QUESTION: In Section C of the subject Solicitation, all pages after page 25 are page numbered page 90. Can the Government provide an updated Solicitation with correct page numbers?
73.ANSWER: Please accept the contracting officer’s confession that his word-processing skills /
IT-skills are not up to any quick performance of any such page-number-reformatting-chore at the present time. The contracting officer hopes to hereafter award a contract-document whose page-numbering-system is complete and continuous. But the contracting officer, here in this pre-award-phase, is respectfully asking that all prospective offerors please carefully study the published FORMAL Solicitation and its published Amendments, for any ambiguity in substantive meaning, and is asking that prospective offerors please notify DOT concerning any detected ambiguity in substantive meaning.
74.QUESTION: Re: Solicitation page 106 – Section H -H.10 Insurance - When will the Insurance
Coverage need to be presented? Is this the same insurance required in Volume 5 – Business proposal?
74.ANSWER: Each offeror’s Proposal Volume 5 shall contain proof, such as one or more Certificates of Insurance (COI), showing that the offeror possesses currently-valid insurance complying with the insurance-requirements of FAR Part 28.
75.QUESTION: Based on the statement on page 150 in Section L regarding ODCs that are T&M can the Government detail what should be included in the FFP price CLINs and what should not be included as it would be billed as T&M or reimbursable? See statement below.
“L.1 Type of Contract
The Government contemplates the awarding of a hybrid contract containing certain features usually associated with a Firm Fixed Price (FFP) contract, but also containing special Line Items for Temporary Additional Guard Services on a Labor-Hour basis, and also containing an invoice deduction- feature more akin to a Labor-Hour contract, and also containing one additional feature— potentially-reimbursable Other Direct Costs and
Guard-Training costs and Travel Costs—typically seen in a Time & Materials contract.
More precisely, each offeror’s proposal, and the resulting contract, will be priced out based on a prescribed / estimated number of staffing-hours to be worked by each particular labor-category (job-title) in each particular period of the contract (Base Period, Option Year One, Option Year Two, Option Year Three, Option Year Four), at each particular DOT-location, at a proposed / agreed-upon fully-loaded hourly pay rate for the particular labor category at the particular DOT-location in the particular contract-period in question, so that the resulting aggregate total of such priced-out labor costs, for a particular contract-period, will be the “Fixed Price” for that particular contract-period.
And under that scheme each offeror’s Cost Proposal, and the resulting contract, will specify a total Fixed Price for the Base Period, a separate total Fixed-Price for Option
Year One, a separate total Fixed Price for Option Year Two, a separate total Fixed-Price for Option Year Three, and a separate total Fixed Price for Option Year Four. However, DOT will deduct, from the invoice payments to be made to the contractor under each such Fixed Price, all labor-costs (and all associated profit) relating to staffing-hours not actually worked by the contractor; and so in that sense the contract will resemble a
Labor-Hour arrangement. But the contract will also have the Time-and-Materials feature in that Other Direct Costs reasonably and allocably and allowably incurred by the contractor, as well as any costs for any necessary Government-approved Guard-Training, and also any allowable costs for any Government-approved Travel, would be reimbursed to the contractor by DOT (but in accordance with Federal Travel Regulations / Joint
Travel Regulations, in the case of travel costs). “
75. ANSWER: DOT’s estimate, at the present time, is that Other Direct Costs and Travel Costs, in any resulting contract, would either be comparatively-small or else non-existent. Accordingly, this Amendment No. 7: (a) confirms that no offeror is required to include any Other Direct Costs or Travel Costs in its Cost Proposal submitted to DOT in response to this Solicitation; and (b) confirms that any offeror who finds a cost-realism-based need to include such costs in its Cost Proposal may graft the offeror’s best estimate of such costs into the proposal-pricing-spreadsheet which was provided by DOT as a part of the subject FORMAL Solicitation.
76.QUESTION: Re: Solicitation page 162 Section L Tab B – Price Proposal:
Can the Government clarify that they are requesting a copy of the full CBA agreement in the response in this section or just a reference to the CBA name, date and revision #?
76.ANSWER: All offerors shall please find and study and carefully consider the CBA-related statements made in the subject FORMAL Solicitation and in its Amendments. Further, DOT’s contracting officer is hereby asking that each offeror please include, in its Volume 5 Proposal submitted to DOT in response to the subject FORMAL Solicitation, a full copy of each and every
Collective Bargaining Agreement (CBA) which is held by the offeror and which could plausibly be interpreted as being fully or partially applicable to the DOT Guard Services project envisioned in this Solicitation.
77.QUESTION: Per solicitation Page 132, Section L-8, Volume 3, Tab A Resumes, it says, "The
Offeror shall include, in Tab A of its Volume 3 Personnel proposal, three (3) references for the
Offeror’s proposed Project Manager and Deputy Project Manager, from companies or organizations that substantiate that proposed individual's ability to successfully manage fifty (50) or more persons in a structured work environment." In order for a Key Person's work experience to be substantiated by a company or organization, is DOT requesting that the offerors provide written references from each of the 3 work references for the Key Person or just the work reference point of contact information and DOT will contact them to substantiate their work history?
77.ANSWER: At a minimum, each offeror’s proposal shall include current contact-information for each cited work-reference-person, so that DOT, on its own effort, could contact any of those reference-persons and / or obtain any clarifications needed by DOT. This Solicitation does not prohibit any offeror from going a step further and actually including, in the offeror’s proposal submitted to DOT, a reference-statement from one or more of the offeror’s cited reference-persons.
This Amendment No. 7 conveys no further information regarding the subject Solicitation.
