About this file

This request for proposal (RFP) from the Department of Transportation Maritime Administration solicits proposals for the decommissioning and license termination of the Nuclear Ship Savannah located in Baltimore, Maryland. Offerors must review the RFP attachments stored in the agency's portal and execute the Use Restriction Agreement Form to access them. The RFP seeks a contractor to dismantle major nuclear reactor components and transport and dispose of associated wastes. Proposals are due by May 1, 2020 and the contract award will fund industrial dismantlement, license termination activities, and transportation and burial of low-level radioactive waste. Questions from potential offerors are addressed in an attachment that provides additional clarification on requirements.

10LSubmission RequirementsTOTE ServicesSection L does not contain any instructions to offerors on how to submit hard copies of proposal. Please also advise if proposals can be hand delivered or if they will only be accepted by mail, along with complete information as to whom offers should be sent.Proposal submission format and instructions will be provided via a future amendment.Acq
11L.1Detailed Instructions for Submission of ProposalsTOTE ServicesSection L.1 contains a request to email proposals which will be potentially difficult due to the file size of the proposal as well as size restrictions on emails sent to government email addresses. Please provide more detailed instructions for email submissions or alternative methods of electronic delivery that will be setup by the government (i.e. file upload site).Proposal submission format and instructions will be provided via a future amendment.Acq
12L.5MER Page LimitTOTE ServicesSection L.5, Proposal Organization Table, Volume I, MER page limit- There is a 10-page limit noted in this table for mandatory eligibility requirement documents. Citizenship Affidavit information will easily exceed the 10-page limit. Recommend the government replace the 10-page MER limit with an unlimited page limit as done in recent past solicitations.MER: 10-page limit each for the Citizenship Affidavit and the NRC-licensed information. Contracts supporting NRC MER is unlimited electronically. Updated in amendment 0002.

13Extending due date of ProposalsAPTIMWe respectfully request a three week extension to the due date. This is necessary considering the short time between the March 17 presentation onboard the vessel and March 18 walk through, and current April 3 due date. To ensure fair competition, all bidders need the opportunity to assess the vessel, formulate questions, consider MARAD’s answers and formulate their optimal approach and pricing. The current due date will afford less than two weeks for bidders to factor in MARAD’s response to post site visit questions. Granting this extension early allows us to make the best use of time versus potential extensions granted near the due date.RFP closing date has been extended to 05/01/2020. See amendment 0002.Acq
14L.13Eliminate Small Business Subcontracting Plan as requirementOnPoint Power, LLCThe RFP in L.13 indicates that the Small Business Subcontracting plan is NOT required to be submitted with the proposal but will be required of the successful Offeror only upon award. However, page 149 still lists the small business subcontracting plan as part of the proposal volume submittal? Please correct. The RFP has been updated accordingly. See amendment 0002.Acq
15KReps & Certs SubmissionOnPoint Power, LLCPlease clarify if Offerors should submit a hard copy of a completed Section K Representations and Certifications or if they just need to update them online in SAM and provide a statement that indicates they have been updated. It is not clear if anything needs to be submitted with the proposal to fulfill this requirement. If hard copy is required (which we do not recommend), than specify which volume to include them in – Volume I or Volume V.FAR 52.212-3 requires that Offerors complete EITHER paragraph (b) OR paragraphs (c) through (v), as applicable. The applicable reps and certs shall be included in Volume I. Proposal submission instructions will be provided via a future amendment.Acq
16L.5Decomposed WBSOnPoint Power, LLCIs the Decomposed WBS included in or excluded from the 10-page limit for Volume III. We recommend excluding it from page count to allow more space for narrative elements of Volume III.Proposal: 10 pages Decomposed Work Breakdown Structure (WBS)- (excluded from page count)Acq
17L.1Submission InstructionsOnPoint Power, LLCSection L does not contain any instructions to offerors on delivery of the hard copies of the proposal (where they should be delivered – how to arrange hand delivery, address for overnight mailing, etc.). 20L.5/146Proposal OrganizationPage Count totals for graphic elementsOnPoint Power, LLCIf an Offeror uses an 11x17 page size for a graphic element for its proposal section within the 25 or 10 page counted sections, does that 11x17 graphic count as one single page or two pages when determining the page count for the section? Please clarify.11x17 maximum size when printed-(2 pages for each chart added to total count)
Acq
21L.5/Pg 146Proposal OrganizationLetters of CommitmentOnPoint Power, LLCThe RFP states that the letters of commitment should be provided in Volume II following the resumes in one place (page 146) and that they should be in Volume I in another place (page 149) and that they should be in Volume III in yet another place (page 147). Please clarify where MARAD would like Offerors to include these Volume I or Volume II or Volume III?Offerors shall include Letters of Commitment in Volume II. The RFP has been updated accordingly. See amendment 0002.Acq
22Section CCATS DatabaseRSCSIn Section C-7.2 it states: “In addition, the Contractor shall assume and perform the outstanding activities contained in the CATS database (included in Section J). No such list was provided in Section J or Section J attachments. If Offerors are to provide a fixed price for the work on this list, please provide sufficient details on the items to be remaining and the CATS database and a description of the work required to close out those items in enough detail to allow all bidders to bid a fix price for the work. This information is being finalized and will be provided via a future amendment.Program
23Section CCLIN 0009RSCSSection C, Page 50: This section states, “… the Contractor shall have a deck officer available who can perform complex trim and stability calculations; direct actions to adjust or maintain the vessel’s list and trim when required; and monitor the stability effects of industrial and decommissioning activities.” Does MARAD expect the bidders to include the rate for the deck officer under CLIN 009 as opposed to the fixed price CLINs?It should be included under CLIN 0009 if this person is anticipated to be used on a case by case ONLY. If the FFP personnel proposed posesses this expertise, then that may suffice.Program
24Section CPricing conflict between requirements (CLINs 1-5)RSCSSection C, Page 41: This section states that “Classification and Other Third-Party Surveys and Inspections” shall be the subject of a change order, but pricing sheets for CLINS 001 thru 005 list “Surveys and Inspections” as a fixed price line item.Program
25Section CReplacement of mooring equipment/equipment pricingRSCSSection C, Page 41: “Contractor shall maintain a program to periodically rotate and replace mooring equipment, including fenders, as they wear.” Please clarify who is responsible for the replacement of the mooring equipment. The cost of items such as mooring lines and fenders are very expensive and would have a large impact on bidder’s firm fixed price proposal. Please clarify if MARAD or the pier owner will provide the replacement gear and it shall only be the responsibility of the Contractor to periodically rotate this gear.It is the responsibility of the contractor to periodically rotate the gear. Replacement of any gear may be accomplished via a change order.Program
26Section CRSCSSection C, Page 33: “The Contractor shall maintain the existing stock of consumable and expendable items that are conveyed at vessel delivery, and provide all additional consumables and expendables required during the term of the contract. Consumables and expendables include materials and supplies to carry out: a) preventative maintenance actions, b) maintenance, repair and housekeeping duties, c) restocking of medical supplies (first aid kits, AED pads and batteries, eye wash fluid), and d) stocking and restocking of PPE The current list of consumable and expendable items is included in Section J.” This RFP statement is in conflict with the request for pricing of consumables and expendables under CLIN 006 instead of CLINs 001 thru 005. Please clarify. In addition, Section J attachments do not include a list of all consumable and expendable items.MARAD intends for the C&E pricing to be included in CLIN 0006. The list of consummables will be uploaded to SharePoint.Program
27RSCSSection C, Page 32: “Maintenance & Repair includes all tasks necessary from initial identification of a deficiency or unsatisfactory condition through final acceptance of the corrected item (also see Work Identification, Control and Management, C-2.1.1.4). This may include, overhauling, repairing, or replacing machinery, equipment, installations and spaces (including structure, habitability areas, cargo areas, etc.) to remedy deficiencies or unsatisfactory conditions.” Please clarify that all subject repairs would be the subject of a change order to the contractRequired repairs in excess of normal preventative maintenance may be subject to a change order.Program
28RSCSSection C, Page 30: This section discusses fixed hazardous materials and states that such materials are anticipated to be left undisturbed for the performance of this contract, except when repairs, modifications or upgrades are contemplated. Please clarify that costs associated with such repairs, modifications and upgrades, including the hazmat remediation and removal will be the subject of a change order to the contract.Except for radiologically controlled areas undergoing decommissioning, MARAD does not intend to order work that disturbs fixed hazardous materials. If MARAD orders work that disturbs fixed hazardous materials, a change order will be issued to cover the requisite repair, modification and remediation costs. If the contractor disturbs fixed hazardous materials, without approval of the CO, the contractor will be responsble for all repair, modification and remediation costs.Program
29Section CRSCSSection C, Page 25: This section discusses minor and major deficiencies. Please clarify that any repairs requiring material, parts or industrial assistance would be the subject of a change order to the contract.A repair that requires industrial assistance or materials or parts not available in the ship's inventory, are subject to change order.Program
30Section BRSCSSection B, Page 21: Travel defines locations, but does not specify quantity. How many trips per year to each designated location should be included in bidder’s fixed price? The NRC and MARAD HQ locations are local to the ship (site of contract activities), and travel will be infrequent. For pricing purposes, bidders should assume one trip to MARAD HQ per year. Travel frequency to NRC, waste repository sites and for accompanying waste shipments must be determined by the bidder. Any other MARAD-directed travel will be subject to a change order at FTR rates.Program
31Section BRSCSSection B, Page 21: Off hours alarm response states to include two (2) four-hour alarm events in CLIN 006. Does this mean that any events above two will be the subject of a change order?Correct. Any response above two per year, is subject to a change order. Please note that the reference should be C-2.1.1.5.3. This has been edited with amendment 0002.Program
32Section BRSCSSection B, Page 20: Labor 9 (CLIN 009) states, “… minimum labor categories are listed below”. No labor categories are listed. Please clarify. This statement has been removed. See amendment 0002.Program
33Section BRSCSSection B, Page 19: MARAD requests pricing to perform “Additional decommissioning project work activities identified in CATS-NSE”. Please define these work activities for all bidders. This information is being finalized and will be provided via a future amendment.Program
34Section BRSCSSection B, Page 19: Does MARAD want all bidders to include 5% overtime allowance in our pricing for all radiological work staff? In previous Savannah proposals this requirement was deleted.Yes, that is correct. Prior SAVANNAH proposal or contract activities do not apply to this RFP.Program
35Section BRSCSSection B, Page 18: Bottom of page states, “Phases II and II”. Please clarify. It has been corrected to read Phases II and "III". See amendment 0002.Program
36Section BRSCSSection B, Page 18: The RFP requests Consumables and Expendables quoted under CLIN 006. This line item appears to be better associated with CLINs 001 through 005 as it more relates to Baseline Support than Decommissioning Support. How should bidders address consumables associated with baseline ship husbandry and maintenance if the consumables and expendables are only charged against CLIN 006?CLIN 0006 is correct. We expect C&E to be common across all aspects of the contract work, and not differentiated among contract tasks such as ship husbandry and decommissioning.Program
37CLIN 0008RSCSThe RFP requests that we include all costs associated with “disposal” of the steam generators as LLRW in the cost of CLIN 0008. We assume that the intent is to include costs associated with removal, handling, packaging and transport of the SG’s as well – please clarify. The assumption is correct;. However, note that the RFP contemplates retaining the SGs in-situ after the heat exchanger tube bundles are removed. If this proves successful, MARAD expects a credit against CLIN 0008.Program
38Section LPage LimitsRSCSSection L.5, Proposal Organization Table, Volume I, MER page limit- There is a 10-page limit noted in this table for mandatory eligibility requirement documents. Please clarify that the 10-page limit applies to the NRC MER and that for the Citizenship Affidavit information there is no page limit since that documentation may be more than 10 pages by itself.MER: 10-page limit each for the Citizenship Affidavit and the NRC-licensed information. Contracts supporting NRC MER is unlimited electronically. Updated in amendment 0002.

39Section LLimitation of email/attachment sizeRSCSSection L.1 contains a request to email proposals. Please provide the email attachment size limit that can be received by the provided email address. Due to file size, multiple emails may have to be sent (one for each volume). Alternately, the Government may choose to provide a file upload site for electronic submittal. Please advise.Proposal submission format and instructions will be provided via a future amendment.Acq
40Section LInstructions for Offerors regarding submission of proposalRSCSSection L does not contain any instructions to offerors on delivery of the hard copies of the proposal (where they should be delivered – how to arrange hand delivery, address for overnight mailing, etc.). Please provide.Proposal submission format and instructions will be provided via a future amendment.Acq
41Manafort BrothersIs the Price Anderson nuclear indemnification applicable to this work?Offerors should proceed as if the "Price Anderson nuclear indemnification" is not applicable to this procurement.Legal
42Formation of teamming arrangementsOnPoint Power, LLCI am supporting a team of companies that is forming a brand new LLC created specially to join together the NRC decommissioning experience and ship husbandry capabilities into one single fit-for-purpose entity just for this opportunity. However, the RFP says the "prime Offeror" must possess the mandatory eligibility requirements. My guess is that MARAD intends to extend the term the prime Offeror to mean the parents of the entities forming such a JV/LLC? However, I am concerned an unsuccessful bidder may protest and delay the award by saying that the new LLC did not meet the requirements because it has no past performance (and technically it is the prime Offer) of its own and therefore has no NRC experience, or no experience at all since it is a newly formed entity. Please add a sentence to L.2 and L.10 that clearly states that experience and MER requirements may be met by the parent companies when a new JV/LLC is formed.TBDProgram
43Include P.L. 85-804ORANOWould MARAD consider amending the RFP to include Public Law 85-804?No. Offerors should proceed as if the indemnification provided under P.L. 85-804 is not applicable to this procurement.Legal
44Pricing for barge crane and availabilityORANOCan MARAD please provide additional details on the availability, capabilities and costs associated with the use of the barge crane mentioned as a resource in the solicitation?Proposective offerors need to identify sources and obtain estimates for services.Program
45Pier 13 InformationORANOPlease provide any/all structural data on the pier that the NS Savannah is currently berthed at.Included in Section J (Attachment J-1: Other Technical Documents)Program
46Section CORANOPage 67 of the Solicitation – Please provide the refueling SAR, procedures and any construction reference documents mentioned in the first sentence of solicitation Section C-7.2.1.3 to assist with understanding the sequencing of dismantlement activities.Refueling SAR and procedures are in STS SP at RM- Topical - FSAR - Folder "Fuel Shuffle"; please copy over to J-X Other Documents listed in the SOWProgram
47Equipment on the PierORANOPlease provide clarification of what components and equipment can/cannot be placed on the pier. Is it the correct understanding that no activated or contaminated reactor equipment removed from the NS Savannah can be placed on the pier for segmenting or other activities? Must each package be placed directly onto the mode of conveyance (rail, truck, barge, etc.) to respect the license boundary of the vessel? All handling activities, including segmenting (if performed) or other, must be performed on the ship. Only crane(s), transport vehicles, and loaded waste packages may be landed on the pier. Depending on the size of the package and mode of transportation (e.g., reactor vessel, rail), waste packages may be transhipped (e.g., heavy lift truck or barge) to another Baltimore terminal for final loading and departure survey.Program
48D&D experienceORANOTo clarify, the PRIME Offeror must be the one with D&D experience at a licensed NRC facility?CorrectProgram
49Section JFormatting and PDF submissionORANORFP Section J-3 lists using Microsoft Project for the integrated master schedule (IMS) and final schedule for activities. To ensure EVMS project reporting, we used P6 as our scheduling tool. Would MARAD consider allowing the contractor to manage its schedule using the P6 tool? Would a PDF version of both the IMS and Final Schedule of Major Activities be acceptable for proposal submission purposes? All proposal submissions and contract deliverables must be compatible with the Microsoft Office Suite 2016 (Word, Excel, PowerPoint, Project) or Adobe Acrobat Pro DC.Program
50ORANODuring the performance of the contract do we use our/sub’s procurement processes or NSS Process? The resulting contract will be a commercial item contract. The offeror shall use its commercial purchasing procedures and consider all applicable STS procedures when making purchases.Acq
51Quality Classification ListORANOCan the bidders receive a copy of the current Quality Classification List? The list will be uploded to SharePoint.Program
52Section LPast Performance QuestionnaireORANOTo help MARAD understand the scope of work that was performed and evaluated on in the past performance questionnaires, can we submit our past performance reference projects as an attachment to Volume IV Past Performance? If so, can we request a 5 page limit per project?Offerors shall provide past performance narratives IAW L.10 of the RFP.Acq
53Abatement/RemediationManafort BrothersBased on our review of the RFP documents thus far (keep in mind we lost the link) it is not clear if all asbestos containing materials have been removed entirely from the NSS. We believe someone on the call Tuesday mentioned that the asbestos had been abated. Can you confirm if, in fact, all asbestos containing materials (ACM) have been removed. If not, has a comprehensive asbestos survey been completed that identifies all types, quantities and locations of ACM in the NSS?ACM-containing insulation has been removed from the Containment Vessel, and will be disposed of prior to contract award. Minor residual ACM may be present within the CV in hard-to-reach areas. See the response to questions 28 for additional information.Program
54Manafort BrothersHave the paints inside the CV been sampled for PCB content?Due to the age of the vessel, all paints are presumed to contain lead; all steel surfaces (except stainless steel) are presumed to be primed with zinc chromate paint; and pcb is present in paint inside the CV.Program
55JJ-1 Index of Technical DocumentsAPTIMWill MARAD provide a complete inventory (MS Word or Excel) of the J-1 Technical Documents to assist bidders in comprehensive understanding and review?Yes. It has been uploaded to SharePoint.Program
56JMARAD SharePoint site:

J-1 Index of Technical Documents

APTIMWill MARAD provide a drawing list or index of the B&W and New York Shipbuilding drawings?Program
57Section CC-7.2.1.5Section C-7.2.1.5, Lifting and RiggingAPTIMLifting and Rigging, refers to STS-194 with regard to the load limits on the pier structure. As noted during the pre-bid WebEx meeting, we do not currently have access to STS-194. On this same topic, a Figure labeled “g2. SKM_C45819082116431” was found on the MARAD Savannah RFP website in the folder labeled “Other Documents identified in the SOW”. This Figure shows six shaded zones on the pier with “PSF” numbers for each zone. Are the load limit numbers shown on Figure labeled g2. SKM_C45819082116431 the current load limits on the pier in pounds per square foot? If not, will MARAD provide the current load limits?Yes, they are current.Program
58Section CC-7.2.1.5Lifting and RiggingAPTIMWill MARAD provide Decommissioning Operations Plan (STS-194) as soon as possible as it is critical to RFP response? It has been uploaded to Sharepoint.Program
59J-1 IndexMARAD SharePoint site:
APTIMMany bidders are having trouble accessing the MARAD SharePoint site evidenced by our own experience and the FAQ posted to the site. Will MARAD make all solicitation attachments available by another means such as CDROM?At this time, there is no plan for a wider release of the Section J attachments. Interested parties are encouraged to continue communicating access issues with Lisa Miles.Program
60L.10
VOLUME IV – PAST PERFORMANCEPPQ RequirementsAPTIMMany of our Commercial Nuclear clients have a policy prohibiting PPQ submission. Will MARAD accept a PPQ that was approved by the client and submitted for another proposal this year?We will consider approved PPQs for other proposals, as long it meets L.10 and cleary identifies that the submission is in response to this RFP.ACQ
61Minimum Eligibility Requirements (MER)APTIMIn addition to the MER, are any restrictions placed on foreign owned and/or influenced company(s) (as prime or as team member) in performing Decommissioning and License Termination work? No, outside the MER, there are no restrictions.ACQ
62L.8Volume II-Technical ProposalKey staff requirementsAPTIMThe ANSI N18.1-1971 key staff experience requirements focus on the operation of nuclear power plants and include extensive nuclear power plant experience. To secure a contractor with nuclear decommissioning experience, we suggest that MARAD reevaluate these key staff requirements to allow more relevant experience performing decommissioning of radiological infrastructure and materials at NRC (or Agreement State) licensed sites. For example, key staff with a minimum of 10 years’ experience in the decommissioning and disposal of major nuclear reactor components and associated wastes.Section C-3.3.2 of the SOW already allows for the consideration of decommissioning experience. "For the purpose of evaluating key personnel, MARAD will count nuclear reactor decommissioning experience as equivalent to experience with the design, construction, startup, or operation of nuclear power plants when assessing the years of experience for key personnel. Each year of nuclear power plant decommissioning experience will count as a full year of experience for the years of experience required. " Also "Within the above qualifications, MARAD requires at least one of the key personnel to possess an undergraduate degree in nuclear engineering. Where the above qualifications require a Reactor Operator license or qualification, MARAD will waive that individual requirement provided that at least one key person has been qualified as a Reactor Operator, either in commercial or naval service. MARAD may consider other exceptions and equivalencies to the required qualifications on a case-by- case basis. " Finally, in C-3.3.2.1, for the PM key person "a Senior Reactor Operator (SRO) License will
not be required, but rather experience in decommissioning under an NRC license will be prioritized." MARAD believe the SOW provides ample flexibility to incorporate relvant decommissioning experience into the selection of key personnel.Program
63L.8Volume IITECHNICAL PROPOSAL, SUB-FACTOR C: QUALIFICATIONS OF KEY PERSONNELAPTIMThe ANSI Nuclear credentials seem unwarranted for the Maintenance Manager position that also requires USCG Chief Mate or Chief Engineer oceangoing unlimited license. Will MARAD remove the ANSI requirement for this position given the extensive Nuclear qualified staff responsible for those areas of the contract? No. Note that the MM is not exclusively a marine function, and that the maintenance staff is not limited to marine husbandry. C-3.3.3 states "The Contractor’s Maintenance Manager shall guide and direct the Maintenance Staff in the performance of their duties. The Maintenance Staff is required to perform these duties in any area of the ship, including within Radiologically Controlled Areas (RCAs)." Section C-3.3.3.1 further provides that the MM "shall meet the ANSI N18.1-1971 4.2.3 Maintenance Manager standard for education and experience" and that such experience shall be "in one or more areas of industrial, marine or nuclear power generation facility operation or maintenance." MARAD believes that the SOW provides sufficient flexibility for selection of the MM.Program
64L.8Subfactor CQUALIFICATIONS OF KEY PERSONNEL AND MAINTENANCE MANAGERAPTIMGiven the extent of nuclear expertise across all key personnel positions, will MARAD consider revising the Maintenance Manager position requirements to meet those of a traditional Maritime Maintenance position? No, as above.Program
65Section C
3.3.3.1Nuclear power plant experienceAPTIMPlease clarify the requirement for nuclear power plant experience for this position. The RFP states that nuclear experience is one of several ways to meet the position requirement (use of the word "or) - "The MM must also have had prior hands-on and supervisory experience in one or more areas of industrial, marine or nuclear power generation facility operation or maintenance" While the ANSI N18.1-1971 standard states that 'a minimum of one of which shall be nuclear power plant experience'The SOW is the prevailing document, and the flexibility contained in the SOW is intentional. Use the ANSI document as a guideline; substitution of marine or industrial experience for nuclear is permitted for this position.Program
66C-6.6.Vessel and FacilityAPTIMWill MARAD provide historical data on the incumbent TSIM Contractor’s scope and historical quantities/costs of consumables, expendables, and spare and repair parts to ensure all potential bidders an equal understanding of this scope element? Specifically, provide a recent copy of NSE repairs to include 5 years of repair history and costs, all outstanding WO’s, SO’s, and SR’s.380 was going to determine what of the current (and predecessor) contracts might be releasable. Note that we don't have a WO history in NSE, as the application only went live in 2019; and then only for PMs.Program
67C-6.6Vessel and Facility Turnover and AcceptanceAPTIMWill MARAD provide information on any currently planned maintenance projects that fall within this contract’s period of performance?Yes, as part of the CATS documentation. The CATS documentation will be uploaded to SharePoint under J-1 "Other Technical Documents."Program
68Various ship reconfiguration examplesAPTIMDoes MARAD have any other planned vessel changes that will be performed prior to the start of this contract?NoProgram
69Section C2.1.1.5.2SITE INSPECTION AND PATROLAPTIMPlease clarify the hours and days that in-person inspections and patrols are required. The section seems to be open-ended regarding the requirement for in-person monitoring - here it states 'when ship is staffed', elsewhere (2.1.1.5.1) refers to core working hours for manning.Same as Q74 - see answer below.Program
70Section C2.1.1.5.3ALARM MONITORING AND RESPONSEAPTIMIs the novated alarm contract part of the fixed fees? If so, please provide a copy of the contract.Yes. A copy will be uploaded to the MS SharePoint site for the RFPProgram
71Section C2.1.1.5.4FIRE PROTECTION AND SUPPRESSIONAPTIMIs the fire inspection and servicing part of the fixed fees? If so, please provide an inventory of the type, size, and location of all fire extinguishers.Yes. See SIC-MA-A-4 for fire extinguishers. The offeror is cautioned to carefully review all SICs.Program
72Section C2.1.1.5.5EMERGENCY PREPAREDNESS AND RESPONSEAPTIMWe understand the Contractor shall take precautions to protect personnel and the ship during an event, please clarify what services the lay berth operator is required to provide? (MARAD contract)The layberth contractor has limited direct roles in NSS management. The layberth contractor's primary role in an event is to secure access to the pier when and if such action is required. STS-007-EPOP and STS-007-001 are the governing procedures for event response. The basic services provided by the layberth provider are the berth itself (pier, mooring bitts, lighting, fencing, fendering) and utilities (fresh water supply; electricity and garbage and ferrous/non-ferrous metallic scrap removal).Program
73Section C2.1.1.7.1SAFETY MANAGEMENT

2.1.1.5.2

SO-2010-004 Security Guard Duties

APTIMPlease clarify the hours and days that in-person inspections and patrols are required. The referenced section seems to be open-ended regarding the requirement for in-person monitoring - it states “when the ship is staffed”, elsewhere (2.1.1.5.1) refers to core working hours for manning. The section refers to SICs for daily site inspections and patrols. These inspections and patrols are carried out in-person when the ship is staffed, M-F (i.e., during core or working hours). For weekends and Federal holidays when the ship is normally closed, the daily site inspections and patrols are performed with available remote means. This is also true on days when the ship is ordered closed due to inclement weather or for other reasons. If for some reason the remote systems are unavailable on days when the ship is closed, then the Contractor must send workers to the ship to perform the daily inspection and patrol.Program
75Section CC-2.2.1NRC Licensing and Regulatory Compliance
APTIMPlease confirm the Government will not indemnify the contractor for nuclear liability under Price Anderson Amendments Act or any other Federal Nuclear Liability Program, or provide any compensation coverage against liabilities or claims arising from nuclear incidents.Offerors should proceed as if the "Price Anderson nuclear indemnification" is not applicable to this procurement.Program
76Section CC-7.2.1, Pg 65Ventilation SystemsAPTIM9th bullet states: ‘Remove and package all remaining auxiliary systems and associated components for shipment as they become nonessential to the vessel removal operations (e.g., waste collection and processing systems, electrical and ventilation systems, etc.); Paragraph C-7.2.1.1, Page 66, last sentence states: ‘Ventilation systems shall be maintained until license termination, and shall not be removed thereafter’. Please clarify the conflict with respect to the Ventilation Systems. The ventilation systems to be maintained until license termination are the new climate control and exhaust systems installed during Phase I. Those to be removed are the inactive, original ship systems.Program

91Section JWDOLORANOThe DOL Wage Determinations provided in J-11 do not include CBA and current wages and aggregate fringes for the incumbent mariners on the NSS. Will you please obtain and share updated Wage Determinations so we can ensure compliance with the SCLS?Please see the “The Incumbent Contractor’s CBA,” documents now available in the NS Savannah RFP SharePoint Site.ACQ
92Contaminated Water DisposalRSCSGiven the current management of water in the systems and storage tanks aboard the ship and requirement to transport and dispose of the potentially contaminated water, what volume of water should Bidders assume for pricing purposes? The existing LLRW (solid and liquid) waste inventories are uploaded in MS SharePoint. Whatever volume is anticipated to be created by the Contractor during the course of its operations should be included in the FFP proposal.Program
93Section LRevision of RFP-re: COVID19RSCSCan MARAD eliminate the hard copy submittal requirements due to concerns regarding COVID-19? If hard copies are still required, can MARAD eliminate the need for an "original" for each volume? We have recently experienced poor service by commercial couriers whereby the time commitment for delivery has not been met. In addition, due to shelter in place requirements, we are not able to go into corporate offices to obtain the original signatures. Please add language that states that scanned signatures are acceptable for all hard copy submittals and no original signatures are required.MARAD agrees with this recommendation and will modify the RFP accordingly.ACQ
94Section C-2.1.1.10Pg. 20Public Access Events, Security,Housekeeping/CustodialRSCSSection B.3 contains a price table listing a category named “Ship Lay-berth Support” along with three subcategories listed as “Public Access Event”, Security Services” and “Housekeeping/Custodial”. Please define what MARAD expects to be included within these three subcategories. The RFP does not discuss requirements for a “Public Access Event”. Under Section B.3 (Page 20) the RFP states that temporary security services should be entered under CLIN 009. Is there some specific security services that must be included within the fixed price? Section C-2.1.1.10 states that the Maintenance Staff shall perform housekeeping. Is MARAD requesting some type of additional housekeeping beyond that required by the maintenance staff? The RFP will be revised to eliminate security from B.3 (CLINs 0001-005), in favor of the CLIN 0009 additional security. See STS-002-007 Public Access for descriptions of the various types of public access events. MARAD anticipates that future public access events will not require substantive contractor support, and can be accomplished within normal day-to-day operations. There is no specific security service specified in the SOW; however, it has been common practice in prior TSIM and predecessor contracts to provide contract security guards to perform the watch standing function. The housekeeping and custodial line item refers to activities above the normal range of duties performed by the maintenance staff. For example, annually the ship exterior is cleaned of accumulated dust and debris, such as gypsum dust from the adjacent terminal.Program
95Section H.6.2IndemnificationRSCSThe RFP states the following: "Notwithstanding anything in this Contract to the contrary, the Contractor agrees to indemnify and hold the NSS, United States of America, MARAD, and its employees and agents harmless against all claims, demands, or causes of action to which the Government, the NSS or its owner(s) might be subject as a result of damage or injury (including death) to the property or person of anyone other than the Government or its employees, or the NSS or its owner, arising in whole or in part from the performance of work under this Contract by the Contractor and its agents and employees, or the Contractor’s subcontractors or their agents or employees; except to the extent caused by the fault, error, act or omission, or negligence of the Government, its agents or employees.”

This wording is very different than that associated with the MARAD SM Contract for the RRF vessels and the previous NS Savannah contracts. The previous contracts include clauses stating that the government will self-insure against such claims. By placing the risk on the bidders, all bidders would have to build in costs to cover premiums, anticipated increases to premiums over the years, and deductibles. Costs would have to be based on assumptions that may result in higher costs to the government.

Can MARAD revise the RFP wording such that MARAD takes an approach to P&I similar to the previous NS Savannah contracts as well as the RRF contracts?

No, the language in the RFP will not be amended.Legal
96LElectronic Proposal SubmissionAPTIMI am writing to ask if you have made a decision regarding electronic submission versus hard copy? An all electronic submission would be welcomed by APTIM and I have to believe all offerors. Submitting electronically mitigates numerous challenges we are all facing presently with offices closed, a hold on non-essential travel, and less dependable delivery service.MARAD agrees with this recommendation and will modify the RFP accordingly.ACQ
97Amendment 0002Registered in SAM at submissionAPTIMIt is our understanding of the FAR that an award cannot be made if an entity is NOT registered in SAM prior to the time an offer or quotation is submitted. Please clarify MARAD’s response to question 2.An Offeror is required to be registered in SAM when submitting an offer or quotation, and shall continue to be registered until time of award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation. (See FAR 52.204-7)ACQ
98C-6.1.Work ScheduleAPTIMWe understand core hours when the vessel must be staffed and available to accept visitors, contractors and deliveries are 7:00am - 3:00pm, Monday-Friday. Are there any restrictions on the hours the contractor can work to perform this contract [outside the core hours]? Visitors, contractors and deliveries are 7:00am - 3:00pm, Monday-Friday. Are there any restrictions on the hours the contractor can work to perform this contract [outside the core hours]?No. For clarity, the core hours have never been a limiting factor on working hours. NSS operations are flexible based on circumstances, and have included such alternative schedules as extended (10-12 hour) shifts; double shifts; and weekend shifts. MARAD's core hour requirement is not intended to constrain the Contractor. Offerors should understand that any anticipated extended working hours shall be included in the FFP. Any proposed regular weekend and federal holiday work should be carefully considered.Program
99C-7.2.1Pg. 65Removal of contaminated waterAPTIMWill the Government provide the actual volume, or an estimated volume, for bidding purposes? The existing waste inventories will be posted to Microsoft SharePoint.Program
100L.2 & L.14MERAPTIMFor determining Eligibility experience could the Government please reconcile the additional language added under L.2 and the insertion of L.14 if a new partnership or joint venture or LLC does not submit its fully executed agreement at the time of bid submission? If the Offeror is comprised of an existing or a new partnership or joint venture or LLC, the fully executed agreement must be included in Volume I of the proposal.Program
101C-7.2.1.3Cupola Head RingAPTIMCould the Government please confirm that the Cupola Head and Shield Ring are currently removed and stored on Pier 13?Yes, they are removed and stored on Pier 13.Program
102B.2 & B.3CLINs 0007 & 0008APTIMCLIN 0007 includes all activities to support industrial dismantlement and license termination activities as specified in the SOW, and CLIN 0008 includes costs associated with performing the direct work and expenses to transport and bury/dispose of LLRW equipment and components. Could the Government please explain the difference between waste handling, packaging, transportation, and disposal referenced/included in CLIN 0006 and the like services referenced/included in CLINs 0007 and 0008?CLIN descriptions are included in the RFP, under section B.2. Table and Instructions for the pricing of CLIN 0007 in the RFP, under section B.3 will be revised to clarify that activities and pricing associated with CLIN 006 and/or CLIN 008 shall be separated as approporate.Program
103B.3Technical Specifications for CLINs 0001-0005APTIMPlease provide Technical Spec 3.7.3.3. so that accurate pricing can be included in our fixed price for CLIN 0001-0005.The RFP will be revised to delete the second bullet U/W Hull (Tech Spec) survey, because that 4-year survey is inadvertently subsumed in the ABS annual u/w hull survey; TS 3.7.3.3 is included in the license amendment 17 document in MS SharePoint. Offerors are also advised to review the relevant implementing SIC for this TS, as well as NPWCD-011 ABS Lay Up Plan.Program
104B.3 & B.4Clarifications of service contractsAPTIMSection B.3 and C-6.6 indicate service contracts for central monitoring and sanitary services not provided by the layberth contract should be part of the CLIN 0001-0005 fixed fees.

Section B.4 and C.6.2 seem to indicate that a sanitary trailer is installed per the layberth contract.

Section C.6.6 further states that those contracts will be novated. No information has been provided as to the terms of those contracts that are to be priced into our fixed fees Please…
