SCR changes

Special Contract Requirement (J Pages) changes

1. Add the following to Section 107 of the Special Contract Requirements, page J-4:

Add the following after Subsection 107.11:

107.12 Protection of Threatened, Endangered, and Sensitive Wildlife Species. The project site may provide habitat for the federally listed Northern Long-eared Bat (Myotis septentrionalis). Protect the species and their habitat as follows:

(a) Comply with the avoidance and mitigation measures outlined in the Categorical

Exclusion Form for NASA Goddard Space Flight Center dated August 29, 2023, and the

Programmatic Biological Opinion for Transportation Projects in the Range of the Indiana Bat and Northern Long-Eared Bat, February 2018 Revision, and the Amended Biological

Opinion, March 2023, found at https://www.fws.gov/program/endangered-species/bat-consultation-conservation-strategy.

(b) Do not disturb wildlife species found nesting, hibernating, estivating, or otherwise living in, or immediately nearby, the work site. If bats are encountered during construction activities, cease work and notify the CO immediately. Continue construction activities upon approval by the CO.

(c) At the preconstruction conference, submit a Bat Exclusion Management Plan according to Subsection 623.02A to the CO for approval.

2. Add the following to Subsection 108.01 of the Special Contract Requirements, page J-5:

(e) No work will be permitted during the active bat season from April 1 to November 14 without the use of an approved bat exclusion system. Prepare and submit a Bat Exclusion

Management Plan according to Subsection 107.12.

3. Add the following after Section 617 of the Special Contract Requirements, page J-54:

Section 623 — GENERAL LABOR

623.01. Add the following:

This work consists of implementing a bat exclusion system including the services of a specialty sub-contractor or experienced biologist, preparing and implementing a Bat Exclusion

Management Plan, assessing and monitoring the site, installing, maintaining, and removing exclusionary devices.

Add the following after Subsection 623.02:

623.02A Bat Exclusion System. Provide a bat exclusion system before project work begins and continuing until all project work is completed for all schedules.

https://www.fws.gov/program/endangered-species/bat-consultation-conservation-strategy https://www.fws.gov/program/endangered-species/bat-consultation-conservation-strategy

SCR changes

Provide a specialty contractor or biologist experienced in performing bat exclusions to prepare and implement a "Bat Exclusion Management Plan".

Install bat exclusion devices on the structure prior to beginning work on the structure. Address or include the following in the plan:

(1) Procedures for assessing the existing structure to identify potential bat roosting areas;

(2) Identifies and outlines entry and exit point(s);

(3) Process for selecting appropriate exclusion devices and methods based on the specific characteristics of the project site;

(4) Timing of device installation and removal to comply with the specified time period;

(5) Methodology for securing all identified openings, preventing bats from entering;

(6) Methodology for monitoring the effectiveness and maintenance of the exclusionary system during the specified time period; and

(7) Identifies the individuals responsible for implementing, monitoring, and maintaining the plan and exclusion devices.

Maintain all exclusion devices throughout work on the structure. Immediately repair or replace damaged, malfunctioning, or altered exclusion devices that could allow reentry of bats. Ensure repairs are conducted by a qualified specialty contractor or experienced biologist.

If exclusion devices are not repaired in a timely manner, the CO will provide notification the devices are not in compliance with the contract. If the Contractor fails to bring the exclusion devices into compliance within a 24-hour period, the CO may assess a reduction in payment to the Contractor of $2,500 per day. The CO may continue to assess the reduction in payment until the items are corrected. This reduction in payment will be subtracted from the Contractor’s progress payments and will be unrecoverable. Use of this reduction in payment does not waive the CO’s right to suspend the work in whole or in part according to Subsection 108.05.

Maintain records of the site assessment, selection, installation, operation, maintenance, and effectiveness assessments of the exclusionary system during the specified time period.

Remove the exclusion devices upon completion of construction. Notify the CO if bats, bat remains, or new evidence of roosting is found.

623.05. Add the following:

Payment for lump sum pay item for bat exclusion system will be prorated based on the progress of the work under this Section.
