PART 1. INSTRUCTIONS TO OFFERORS

1. A. GENERAL

1.A.1 General Information

This Request for Proposals (RFP) is issued by the Federal Highway Administration, Eastern Federal Lands Highway Division (EFLHD), in cooperation with the Federal Highway Administration’s Puerto Rico Division (FHWA-PR), and the Puerto Rico Highway and Transportation Authority (PRHTA) to solicit competitive proposals for a Design-Build (D-B) contract for the Landslide Repairs in Utuado, Puerto Rico, Project No. PR ER DOT PRMNT RPR(14). This RFP is issued as a D-B selection process. Those Offerors selected are invited to submit Proposals to design and build the Project according to the requirements and procedures contained in this RFP. Selected Offerors are those firms/teams who were notified in writing by EFLHD inviting them to participate in the selection process, as a result of their performance in the Request for Qualifications (RFQ) process.

Offerors are directed to Federal Acquisition Regulations (FAR) Subpart 9.5 and must describe any actual, apparent, or potential organizational conflict of interest as part of their technical proposal if awarded the contract. Offerors shall also describe any action(s) it has taken or proposes to take to avoid or mitigate any conflict, and shall set forth any other information that the Offeror believes would be helpful to the Contracting Officer (CO) in analyzing the situation.

The Offerors invited to submit proposals are as follows:

1. *******

2. *******

3. *******

1.A.2 Description of Project

The project consists of repairing and restoring the roadway prism to reestablish safe and reliable access including repairing landslides, pavement washouts, reestablishing drainage, and performing other related miscellaneous work for addressing the damage caused by hurricanes Irma and Maria. The damages are located in PR-111 between kilometers 43.1 and 66.9; PR-123 between kilometers 48.8 and 60.4; PR-140 between kilometers 14.15 and 31.5; PR-611 between kilometers 1.3 and 7.1; and PR-6111 at kilometer 1.9 in the municipality of Utuado, Puerto Rico.

The intent of the contract will be to design and construct repairs to address the damages caused by the hurricanes and incorporate resiliency by including mitigation measures to reduce the possibility of recurrence within the site locations.

This RFP contains conceptual design documents for many of the sites prepared under previous contracts managed by the PRHTA. These government furnished documents are for information purposes only. The provided design files are conceptual in nature and were developed using data several years old. Therefore, the Offeror is to expect and shall consider in the proposal that actual size and scope of the repairs may have changed from what is represented in the government furnished documents.

1-A-2

NEPA Compliance: Eastern Federal Lands Highway Division (EFLHD) issued a Finding of No Significant Impact (FONSI) for National Environmental Protection Act (NEPA) compliance in August 2021. In addition, Categorical Exclusions (CE) for multiple individual sites have been approved based on the conceptual designs provided in the contract documents. The final design and construction for all sites shall adhere to the conditions and mitigation measures outlined in the FONSI and CEs included in the government furnished documents as well as those to be developed for the project sites included in this contract. Any CE’s not included in the government furnish documents will prepared by EFLHD as design progresses. The design will be subject to review by EFLHD, PRHTA, Federal Highway Administration’s Puerto Rico Division (FHWA-PR), and other government agencies and consulting parties.

Right-of-Way (ROW): The government furnished conceptual design documents may include ROW information. In some instances, the conceptual design repair fall within the existing PRHTA/DTOP ROW or the government has completed acquisition of the required ROW as shown in the conceptual plans. The Offeror shall consider in their technical and price proposal, that ROW acquisition may still be necessary.

All final designs, including Alternate Designs by the Offeror, will be required to be within the existing Right-of-Way or within the ROW necessary to complete the conceptual design shown in the government furnished documents, unless approved otherwise by the CO. A ROW certificate approved by the Government will be required before starting construction operations.

When the proposed project limits are outside of existing PRHTA/DTOP ROW, the Offeror will be responsible of performing the ROW studies to provide FHWA and PRHTA the necessary information to acquire the necessary ROW for completing the proposed repairs. The Offeror shall consider the timeframe required for completing ROW acquisitions in their technical and price proposals. Refer to Sections 112 and 121 of the Special Contract Requirements (RFP Part 5).

Design: Refer to Section 121 of the Special Contract Requirements (RFP Part 5) for the design development phases. When the government furnished documents include a proposed conceptual design solution for a site, the Offeror will have the option of developing the conceptual design into a final solution by correcting any deficiencies and/or adjusting the design to meet existing site conditions and other applicable RFP requirements. The Offeror may instead propose a different repair solution for those sites and if approved, continue into the design development phases. All costs for establishing and developing the design of the final repair solution are to be included in the Offeror’s price proposal.

Construction Notice to Proceed: The roadway plans may be submitted to the CO in logical subsections. No construction may be started until the Government reviews the Final Design submission for that element of work and determines it is satisfactory for the purposes of construction. The CO will notify the Contractor when the design is cleared for construction.

Refer to Subsection 2.H.8

Regardless of how the Offeror chooses to proceed, the Offeror is responsible for reviewing government furnished documents and confirm that the information contained is accurate and complies with contract requirements before its use. The Offeror accepts full responsibility of any

1-A-3 information and data adopted from the government furnished documents.
